I am rejecting this response because: House foreclosed 2010, our last payment for homeowner's dues was 12-21-09. [redacted] paid all fees for this property when they took it back . We were never told this was being reported we found out by running our credit report. This is affecting our credit worse than the actual foreclosure! Both myself and my wife are being reported.

Review: This debt has gone past the statute of limitations. Please remove this from my credit report. The account is officially closed.Desired Settlement: Removal from credit report with [redacted]

Response:

Thank you for advising our office of the enclosed consumer Complaint. We had prior mailed four letters to the same address provided by the consumer in his complaint with no response. The address was prior provided to our office by the U.S. Postal service as the forward address from the original Lincoln, California property address.

The consumer complaint of statue of limitations refers to the time allowed for creditors to file a law suit to enforce a claim, in most cases four years in California. Since receiving his complaint through your office the consumer has filed a dispute with [redacted] Credit Reporting, which we will be responding to and mailing the account verification direct to the consumer for his review and consideration.

Please advise if additional information is needed as we value our business reputation and our relationship with the Revdex.com.

Sincerely,

Review: Our 2nd property foreclosed on us due to [redacted] back in 2010. This company is trying to collect on home owners dues from this time and reporting it to the creditors. Our last payment to this account was 12/21/09. It is past the statute of limitations for CA. Their reply was it can be reported up to 7 years and they changed the collection date to 11-08-11.Desired Settlement: This is for a home that we lost due to foreclosure it caused many hardships and we want this dept with added bogus charges removed from our credit report.

Response:

This collection account was assigned to our office on 11-08-2011. We on behalf of our client mailed 6 letters of notification between 11-9-2011 and 8-26-12. All letters were mailed to the consumer's address at that time which is the same as the one on this complaint. The last date of charge provided by our client was 11-02-2011. Since our office had not received any response from the consumer we reported the account to [redacted] 7-9-2012. We have not received any notifications from [redacted] with reference to this account as being disputed. We have provided the consumer with account support and a copy of the deed of trust showing the property being foreclosed in their names. On 3-29-2016 we received a letter thanking us for clarification of the dates of the debt, noting that had caused great hardship to them and they refused to pay any of it. They also noted in the letter that the refused to discuss this with us any further. We updated our report to [redacted] that they were disputing after being provided with verification and refusing to pay. We have made no further efforts to contact the consumer and we would be happy to discuss this further should they request to do so.

Response:

As a result of the consumers rejecting our prior response, we forwarded a copy of the entire complaint to our client for a due diligence audit/review. They responded that funds were not advanced and (paid) by the senior mortgagor ([redacted]) to bring the H.O.A. dues current as claimed by the consumer. The foreclosure did not extinguish the personal obligation for amounts assessed to the owner of this property, or additional collection costs incurred since then. Our client sent notifications to the consumer advising them of their obligations and our firm has also sent letters of notification and advised them of possible reporting of the debt to a credit reporting firm. Our client advises that when the debt is satisfied, the credit reporting firm will be notified. We will mail a copy of the full response to the consumer.
