The patient who m**e this complaint has very complex medical issues, which I cannot go into because of [redacted] regulations. It is very difficult to respond to this absurd complaint without sharing pertinent information about the patient’s condition mental state and previous medical conditions and...

medical management of those. But that information would require a release of records.  So I will respond the best I can with my hands tied, sharing what the sequence of events were. What I can say is that the patient requested that I do a metabolic program for his mental and physical health issues. This was decided on by him, after the program and what it entailed, was carefully explained, both orally, and in writing, before he decided to do the program. We discussed it multiple times during his treatment office visits.The Metabolic Program of [redacted], is an individualized, customized assessment and evaluation of the Neuro and physiological chemistry, antecedents, triggers, medical history, laboratory results, dietary and nutritional questionnaires as well as health appraisal questionnaires, which I couple with the patient’s physical exam and history/consultation, and renders a treatment program to **dress the biochemical, metabolic and neurotransmitter imbalances in any given patient.  In this person's case, the metabolic program function medicine was described on multiple occasions orally, in **dition to a four page written description, which was provided to the patient on his second office visit, which I personally reviewed with him on multiple occasions.  He was aware of the many hours of work that went into designing and producing this individualized treatment protocol, which was customized and designed specifically for him.  He was very much aware of what the program would consist of. Partially this involved replacing costly and toxic pharmaceuticals with specific nutritional medicines, mostly in the form of nutritional supplements, and combination with specific dietary guidelines, recommendations,  and lifestyle changes.  He was fully aware of the nature of the program, and what it consisted of. My office staff and clinical assistants can verify what I am saying is true. He was very excited to get started and have me set up the program for him.  I have a three hour audio recording of the actual report of findings and presentation of nutritional medicine program, with the patient present and him commenting on how impressed he was with the program, how the tools that was being given would be able to change his life for the better, and how useful the information was regarding specifically designed individualized functional medicine program, and the accompanying prescribed nutritional medicines.The patient voiced enthusiasm, satisfaction, and agreement with the application of the program.  Each of the nutritional medicines are medically necessary and all were described in detail in regards to their neurological, physiological, and neurotransmitter function. The patient even took **ditional notes beyond the roughly 75 page written program that was provided to him, and expressed satisfaction, interest and delight with what he received. He was so excited about the program that I spent an extra hour and a half with him (for which I do not get paid), responding to questions he h**.  He was given a thorough understanding of the process of nutritional functional medicines and their relationship to the neurophysiology of multiple conditions.  Unfortunately, he did not follow my instructions regarding the implementation and use of supplements and building a foundation that would **dress his complex health issues.I became acquainted with this man before he became a patient.  I spoke with and counseled him informally, as a neighbor and friend, in a non-professional relationship. The person involved in making this complaint is going through a very bitter divorce, which has resulted in interactions in our neighborhood involving the police coming to intervene. He is experiencing huge amount of emotional distress in regards the divorce.  This in conjunction with his health issues, which I cannot go into for privacy issues, but is certainly spilling out to non-divorce interactions, like those with his neighbors. I say this because I am a neighbor and my family experienced totally unwarranted and irrational hostility and volatile behavior from this patient prior to him deciding that he was “overzealous” in his quest for good health.  The latter being a statement that he repeated after discussing his finances to someone over the telephone from the mainland who h** no knowledge of his conditions, medications, or functional metabolic program, but did apparently have a vested interest in having him hold onto more money.  The trigger for his hostility and volatile behavior actually started when my family failed to heed and obey his instructions for us to” move out of our home” with the approach of the tropical rain storm, which ended up doing no harm to anyone in West Hawaii.  Because of his condition, and background in emergency services, he speculated and told me, that we were "not safe in our house" and “needed to evacuate.”   He said he " h** a plan for us," and he told me we (my fiancé and I, and maybe our 5 dogs and parrot?) " should move into his house across the street."When we didn't comply with his instructions, he become hostile and irate and the cycle of irrational manic behavior began. He apparently was used to people doing what he told them.  As a 30 year resident of Kona, I have experienced many storms and m**e my own determination that we would be safe.  The storm here turned out to be a non-happening.  This apparently further infuriated him. (Again, this was prior to any mention of his nutritional medicine program or very supplements). But the next morning we received, at home, a nasty note from our neighbor, which he placed in our mail box. We are talking about a mentally unstable individual who h** within the week threatened to attack his wife, two other women and another man, by jumping out of the bushes where he was hiding with a machete and a saws-all, as weapons.  This is a matter of public record and a police records.I am a Doctor of Chiropractic, specializing in Functional Medicine, for over35 years.  My background and training includes two degrees in Psychology, including a Masters, as well as post-doctoral training in [redacted], and post-doctoral certification in Functional Medicine.Because I value him both as a patient, friend, and neighbor and was concerned about his emotional and psychological condition, I, in fact offered to make a one-time exception to our office policy regarding the return of nutritional medicines, which for health and safety reasons cannot be returned or re-sold.  I wrote him a very nice conciliatory e-mail expressing concern, compassion, understanding, and offering him a refund, on multiple options. I twice offered in writing to take the supplements back and give him a refund.  He completely ignored all of these offers.  So, it would appear that the terrible urgency and crisis that he portrayed, was more of a psychological catharsis, attack and venting, as opposed to wanting to actually get the results that he stated he was looking for. I have copies of detailed letters in which I responded to him in a rational compassionate and solution oriented manner. These included multiple offers to take back the supplements and issue him a refund. I even offered to meet him at his house, which is across the street, or at our house, to save him having to make the trip into town. These offers were completely ignored.   In the office on Tuesday, July 26, we were in the treatment room and when he asked me about the supplements, my words were "I will do everything I can to help you" when asked me aggressively and with urgency, about getting an immediate refund, I started to explain to him, and tried to tell him, that for health and safety reasons, supplements were not generally  returnable, that my clinic is not [redacted] or a [redacted], but that I would help in any way I was able to. Some supplements need to be refrigerated, others are powders in capsules and can get oxidized, especially with the 90° plus temperatures we have been having the last few weeks. I purchase the nutritional medicines from multiple laboratories on the mainland.  I can’t resell them once they leave the office. His comment about “getting my money up front” was ridiculous. Does [redacted] of [redacted] get their money up front? While I am an excellent doctor, I am not a bank. A don’t take installment plans for services or supplements as I have alre**y paid for these, in **vance. This man could have chosen to wait until he felt more comfortable financially.  That is, postponed for a week procuring the nutritional medicines, after his next pension check came in. That was his choice. He was very excited to get started, and even joked about having credit cards that he wanted to use for building his credit, before pulling out a couple of credit cards and choosing to put the purchase on one of the cards. Originally, he said he would use a check or cash for half of the purchase. How patients pay for their services and products is up to them.So on July 26th, it was like a switch was flipped and it was an “all or nothing”, black or white, “my way or the highway “response that he came back with. As he said, he in great haste, got off the examination table re -dressed and after being told that he would not be able to get a full and immediate refund that he requested, he stormed out of the office.He probably forgot that I h** m**e a recording of the entire three hour session, on the previous Friday, July 22, the date of his Nutritional Medicine Metabolic Program report of findings, which totally contr**icts his statements in the complaint to you, the Revdex.com.I also have the series of OCD emails he sent me (and my fiancée), filled with [redacted], abusive, toxic, vulgar, anti-[redacted], and foul language, and threats.  If you need these I can retrieve them and forward them to you. I was frankly quite concerned for our safety, that of my family and staff.  My fiancée was fearful after the interactions with this man. We were both quite fearful for our safety and wellbeing, based on threatening, hostile, and volatile notes and e-mails we received from him. Some of these occurring before he ever expressed any dissatisfaction with his functional medicine program supplements, and days before his last office visit/treatment at my clinic.His statements are false, and his behavior has been irrational and potentially dangerous.  His complaint is factually inaccurate.  If you need copies of these documents let me know.  It would be a disservice to your purpose, the Revdex.com, and those that depend on you to post or publish this erroneous complaint. The legal ramifications might become escalated as well.  Thank you for considering the forgoing.I have been a licensed doctor In Hawaii for 35 years, and as far as I am aware, have never h** a complaint.If you desire further documentation regarding this matter, please let me know.

I am rejecting this response because: Mr [redacted] did not accept the reasonable, medically necessary request that I offered. His Response is filled with Red Herring arguments and [redacted] attacks. Nowhere in his Response did Mr. [redacted] offer any excuse for his practicing Nutritional Medicine without a license, nor for the Psychoanalysis he performed on me, nor his Psychotherapy he offered to me. Mr. [redacted] is very good at showing how well-educated he is, but he completely failed to show his Nutritional Medicine license, his M.D. Psych license, or his current Therapist' license.With a hefty amount of evidence, I will gl**ly work up a detailed Rebuttal to Mr. [redacted]'s Response, as part of my complaint to the State of Hawai'i Regulated Industries Complaint Office (RICO), which will support his two previous complaints with that Office, [redacted] dated 1/13 2013 and [redacted] dated 9/9/2010. My complaint, when viewed in the light of those previous complaints, should establish a pattern of poor business practices. How many patients suffered mistreatment under Mr. [redacted]'s care without following through on the RICO complaint process, or the Revdex.com complaint process?
