Hi ***,Here is our response to *** *** accusations:Mr*** was never encouraged by me to sign up for classes, quite the opposite Mr *** entered our facility with the goal of "fighting in bars in the Pacific Beach area and learning striking to avoid using wrestling to fight
people in public" This is not a goal I/we support at American Boxing Unfortunately, my account notes were overlooked and he was invited to return for additional training through our follow up system When Mr *** entered our facility, I was surprised I feel its my social duty teaching a fighting art to keep my students and my community safe from this type of person and their dangerous mentality, so, I addressed the matter telling him that I am unwilling to teach anyone how to hurt someone for the sole purpose of getting drunk and starting fights I could see the look of unhappiness on Mr*** face, however Mr*** agreed that if I was to allow him to work with us that he would make every effort to avoid physical conflicts in public, specifically bars and only use what I taught him for self defense.Mr*** claims he was unable to sign up for classes This is of many complete falsehoods by Mr *** Once someone pays, our system AUTOMATICALLY gives them the ability to access all classes, absolutely no action is required on our end as can also be seen in the image below where Mr *** regularly checked in by himself and attended classes Again, Mr*** signed up online and did attend classes for week as can be seen by his attendance record from the business side of our software in the image attached(our software is 3rd party and cannot be manipulated after the fact) Mr *** contacted me on the 7th day regarding his inability to use "Open Gym" on 8/17, his last day of "unlimited classes" I clearly stated open gym is not a class and his trial was clearly for "Unlimited Classes" See attached image of our terms clearly stated...this is what everyone sees, agrees to, signs and has communicated to them by me personally.Mr *** used his week of unlimited classes and then requested a refund for his inability to use "open gym" on THE LAST DAY of his week A manipulative effort on Mr *** end to get his money back after using our services however, I told Mr *** I would be willing to refund his $49, he would simply need to pay per class for what he used Mr *** eagerly agreed and arrived at our location.The Policies and Participation waiver that Mr *** signed upon entering our facility clearly states that there is a $class training fee for non members. Participating in classes @ $per class would mean Mr*** in fact owes $to American Boxing minus the $he paid for the week trial (a contract he vehemently wishes to cancel as can be seen with this refund request), meaning Mr*** owes American Boxing $51. Mr*** has not paid his balance to date and we have yet to make an effort to collect the balance he owes in an effort to simply move forward, which Mr*** chooses to not do himself.Mr *** has defamed me and American Boxing and even convinced friends to assist him The of them have placed fake reviews with information on at least Yelp and Google...we are currently researching further efforts to defame and harass us on the part of Mr*** part and his associates We have full contact information on of the individuals involved and have DOCUMENTED proof that Mr *** has colluded with these people to write reviews on American Boxing (these people never having been to or even inquired about training @ American Boxing) We support the 1st amendment @ American Boxing and even support Mr*** right to write a review even with his creative point of view However, his gathering friends to write fake reviews to harass, attempt to coerce, defame and insult me and American Boxing, a small family business, will not be tolerated We will deal with him professionally and legally I personally hope Mr*** and his friends have money for attorneys since this will not be a small claims case, they will both definitely need one.Mr*** has days to remove all of his "friends" reviews on all sites or we will pursue him AND them to the fullest extent of the law at our first convenience.Move on Mr***...in years of business we have not lost in a courtroom for a reason We are fair and just in all of our business practices...judges see that We will not be coerced or manipulated by you or anyone else who attempts to use our services and not pay...in my book, that is called stealing. My attorneys all train with me, work pro-bono and love helping me, their friend, deal with people just wanting to start trouble...will yours go all the way for free??You have done enough harm to my business and reputation at this point, you should feel plenty good about yourself...now please do us both a favor and move on before this becomes more than is necessary.Good Luck,*** ***, President

Review: This is dual complaint about false advertisement as well as breech of agreed service. American Boxing Muy Thai MMA Academy states on its web site, as well as the owner [redacted] states in person, that the establishment offers training in "Kickboxing, MMA & Jiu Jitsu / Wrestling / Grappling." Links from the web site tittled, "Training Options" lead to various training options, advertising in extensive text, various classes of matrial arts training offered to customers. After speaking to [redacted] and taken complementary intro class I was encouraged to sign-up with $49 for a one week trial to "sample all the classes the gym offers" one is lead to believe fair access to all of these claimed classes. In between paying the $49 for a "week trial" the owner's staff is supposed to complete the necessary steps on their end enabling member's on-line profile to log-in and book classes. The insturctions to members after payment is to book classes 24hrs in advance and to resolve issues via text messaging a given telephone number. In my experience, the system or employees had difficulties completing my profile, I suffered the consequences of 2 wasited day that I could not have book a training session. After isses were resolved, only via text message communication, I was able to book classes. However once accessing profile members see that business only offeres training classes in "American Boxing", "Muy Thai", & "Open Gym." Later that week I scheduled a "Open Gym" session, but arriving at site, the busines was closed. Seeing [redacted] through windows, I called him to ask why the gym is closed during my booked class. He answerd phone to insist that I did not have access to "open gym" and that all issues must be resolved via text messaging. When I communicated via text message that I had 3 wasted days on this trial week, I have been given writen proof of owner's decision to give me full refund and instructions to appear for credit back to my card. Yet I've only been yelled at & challenged to a fight.Desired Settlement: I would like [redacted] to refund my credit card the $49.
