We are confirming receipt of your letter dated February 6, 2020 pertaining to case# ***pertaining to Mr. & Mrs. ***. We are appreciative of the opportunity to provide thefacts in hopes of reaching reconciliation. Our engagement with the *** family began with a garage addition, among other projects. Thisagreement was entered into for a total of $***, which included work in the hallbathroom, a concrete patio, a pergola, and gutters. We received a down payment of*. After the county denied the garage, the focus was redirected to other work, whichwas accompanied with a revised agreement dated October 14, 2019 with a scope of workincluding:-Master bathroom remodeling, including demo and install of customer selected & suppliedmaterials-Repair exterior soffit and facia on rear of houseTotal for above estimated @ $***-Upstairs bathroom remodel, in a separate estimate for $***The total was estimated at $***.There were several changes throughout the above referenced project, including a larger steamshower than what was in existence or considered. Another change was the tile for thebathroom was initially estimated assuming 120 pieces versus the actual 880 pieces. Attached isa letter we sent to Mr. and Mrs., dated January 6, 2020, outlining the work completed andthe work to be completed. It reflects the work completed totals $***, and the workremaining would cost an incremental $***. The bulk of the remaining work was alsoaccommodating a change from the original scope relative to the location of plumbing, vanity, drains, GFI electrical, and lighting. This letter outlines additional work that had been discussed. The net of this is that an incremental $*** was due to complete the work (taking intoconsideration the initial $*** already received). There has been a disconnect with Mr. on several occasions with respect to what materialsthey were to provide, versus materials they anticipated American Building Dynamics to provide. We have reached out via phone and email with intent to finish the work outlined. However, Mr. has demanded we owe him money. We desire to finish the work and only charge a fairprice for the work delivered and to be completed. We’ve offered concessions, including thatwe will provide a new full lite steel door and install it for only $***We look forward to bringing closure to this. Let me know if you have any questions.Otherwise, you can reach us at

Revdex.com:

I have reviewed the offer and/or response made by the business in reference to complaint ID, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.

The business continues to lie. There was never a signed agreement for $*** of work to be done.

The Jan. 6 letter they reference and appear to stand by makes clear that the business has received sufficient funds to complete the job. There is email documentation that materials were to be included in the estimate. While I do believe we are owed money, I am willing to settle for completion of the work we have ordered and already paid for.

you reference that the consumer provided additional clarification that will
help bring resolution to this complaint. We are eager to bring resolution to
this as well. The circumstances around this complaint
can find breakdown in communications from both sides. While there was room for
misinterpretation in the language of the estimate, it was never the intent that
American Building Dynamics would be providing the various materials involved. Further,
it was not feasible for American Building Dynamics to pick out some of the
materials; and when the customer did select/purchase certain materials (e.g.,
hall bath tiles), we estimated labor based on 120 pieces when the customer
purchased 880 pieces. The changes the
customer asked for have been accommodated for at a very reasonable cost, but
again under the premise the customer provided materials. We are willing to make concessions to
find the win-win outcome. A win-lose or lose-lose outcome is not beneficial. We
will reach out to the customer again this week to work through how we can find
the win-win.We look
forward to bringing closure to this. Let
me know if you have any questions. Otherwise, you can reach us at 540-895-7161. Regards,AJ Rcc:Rob R

This contractor has been consistently negligent in provid*** timely responses. We entered into a contract to build the garage in June 2018 and construction has still not begun. We have requested several chaes that each took a month or two to be resolved. Those issues took far too lo*** to be resolved, but they could be excused or attributed to a finicky customer preference. However, we have requested zero chaes to the plan since Sept. 28, 2018, and the project has continued to lauish.

The county denied a permit to build in February 2019, and the contractor has done noth*** to remedy the issue. We were told by the contractor on Feb. 22 that we would hear back from them "at the beginn*** of next week." They did not follow up at all. I inquired on April 30 as to the status of the project, and I received a response on May 3 that he would be call*** the county on Monday and have an update. It is May 20 and I have received no update. I have left phone messages that have gone unreturned. I am request*** Revdex.com's help in resolv*** the issue and complet*** the project for which we have already paid 50% of the bill.

Good afternoon,
We are grateful to hear from you and we apologize for our delay as we investigated the situation at hand. We spoke with Mr. today June 11 2019, and have come to a mutual agreement on a path mov*** forward to a mutual resolution for both parties. That starts with ABD hear*** back from the county build*** officials and anticipate hav*** answers from the county this week, with what we can and cannot do with Mr.’s garage, as the permit was originally denied due to a water main located in the footer system. Mr. is on board with this, as is ABD. We will keep you updated on this project for the next couple of days, as we get everyth*** resolved. Please feel free to contact M K at our office (540) 895-7161 if you have any questions or concerns.

I have reviewed the offer and/or response made by the business in reference to complaint ID, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.

M*** has not provided any assurance that his company is committed to complet*** the project. He has offered on three occasions to refund our deposit, which I do not accept as a reasonable resolution consider*** he has held our $*** for a year with no results. I want the project completed.

On June 13, M forwarded a request he put into the county on June 12.

Also on June 13, I emailed M request*** an estimate for a smaller garage that might fit the county code, and I requested an estimate for a patio. M responded that he needed to hear from the county before provid*** an estimate. We have not received any estimates, and we have not received any updates on the county response. M and his team has said since February that they are wait*** to hear from the county. I know local governments can be bureaucratic, but I do not believe they have received noth*** from the county in four months.

I am request*** a new estimate with an estimated date of completion to resolve this complaint.

Mr. K called from the business he stated that the original permit was denied because of a sewer line. He stated that he has been in constant correspondence with the consumer through the process. Mr. K stated that he emailed the county today a copy of the plans try*** to get the new permit approved. He stated he has offered a full refund to Mr., which was denied. Mr. wants the garage to be built still; Mr. K is work*** on that to get that go*** but still wait*** on the county approval.

Last year, American Building Dynamics (ABD) installed (1) new exterior shutter to my home and repaired damage to my neighbor's siding. Severe weather conditions blew my shutter off and subsequently damaged my neighbors siding. I took responsibility of the matter and covered all damages.
Once again, during severe weather conditions, the same shutter blew off and caused damage to my neighbors siding. I reached out to American Building Dynamics regarding the situation and was advised that my warranty had expired. Business is business… I understand this. Their customer service and response time had been pristine with me, so I made an appointment. An ABD estimator arrived to assess the damages in a timely manner and proposed to install (1) new exterior shutter in new holes. This is interesting. Where were these new holes during the initial shutter replacement? It is clearly visible that the holes had not been adjusted during the first work order.
I have placed numerous calls to American Building Dynamics and I have requested to speak to management. Each time I called I was advised, "he'll call you back in 10 minutes." Ten minutes has transitioned to hours and now, days. At this time, the manager of American Building Dynamics is refusing to speak with me at all. Moreover, through his staff, who has been nothing short of pleasant and professional, he has stated that the company is not responsible for any damages. Since when are paying customers not worthy of a conversation? What is the point of having a management/leadership level, if you are not willing to address the issues and concerns of the customer base?
I spent hard earned money with American Building Dynamics and I will continue to seek even handedness. However, I am fundamentally forced to take my business elsewhere and I strongly suggest that you do the same.
