We chose Lemel Homes to build our new houseDuring the design process, we specifically stated our budget for the houseWe then built our dream house on paper and received an estimate to build from Lemel HomesWe then had to remove items from the contract to get the cost closer to our budget that was set forth on our first meetingIn the process of removing items from the contract, Lemel Homes neglected to inform us that they would be charging their markup/management feeThat is not true. If an item was removed from the estimate, the mawas also removedAt that point a final contract price was presented that also included credit values to the owner should he decide to complete that scope of work himself. They presented the cost for an item, and I agreed while having no way to confirm the accuracy of that priceWe are a guaranteed price builder. He was presented a contract and a spec book as to what was includedMy understanding of the situation is that if there is no cost, then there would be no markup to payAgain, no one informed us of that they were charging their markupAfter finding out that they charged a markup, I inquired if that was standard practice and was told, sorry, that is the price you agreed toHe did hire two subcontractors and was given the appropriate credit that was listed in the contract/spec book which was reviewed and signed by the ownerAll changes during the construction process were agreed to and signed off on change orders by the owner. All credits and debits for changes were presented and the owner had time to review prior to any work being done. If Lemel Homes had informed us of how they charge their markup, I wouldn't have build my dream house on paper only to scale back to get somewhere close to our budgetI realized that I paid over $10,for Lemel Homes to do nothing but provide a quoteIf we were informed of this right away, I would have build a basic house, then upgraded where needed.No credit is due to the owner. The project was completed to the owner’s satisfaction. We are currently in the warranty stage and fulfilling our warranty duties per the contract

We will not be refunding any money to this customer. This is based upon the following:s Values for all debits and credits were presented, reviewed and accepted by this customer and Lemel Homes. Final numbers are presented and it is up to the customer to determine if they are interested in proceeding with the scope of the project.s Our contract and specs were signed by this customer and Lemel Homes, Incfor a specific amount. This value was reviewed numerous times by both parties prior to signing.s Any changes to the contract or specs were noted on change orders and signed off by this customer and Lemel Homes, Inc.I will be sending the signed contract and specs

*** *** There is one common theme among my many aspects of dissatisfaction with Lemel Homes and they all start with a lack of adequate communication on your partAfter reviewing your response, let’s recap the events that I have on paper using real numbersLemel Homes provides a preliminary budget of $380,with $20,to be removed for a metal roofThe accuracy of this rough estimate is +/- 3%There is also the added charge for site work, which is not part of that numberWith enough room in our budget, we change a few minor itemsThe house then goes out for bidAfter several weeks of bidding, Lemel Homes presents me with an estimate of $414,000(no site work included)Having no other choice, I attempt to figure out how to reduce that price to fit into our stated budgetAfter realizing that the final estimate is exactly 15% higher than the preliminary estimate, I also realized that Lemel Homes failed to disclose any reason for such a large jumpMy initial thought was that your markup was left out of the preliminary estimate; however, an employee at the startup meeting confirmed that your markup was indeed factored inI figured that I had missed something and I would review it laterAfter figuring out what projects I was willing and able to work on during construction, the overall budget was reduced to $394.405(site work not included) with several allowances for other work and managing my own subcontractorsDuring the process of reducing the budget, Lemel Homes presented the costs for certain projectsI agreed to the costBecause there was zero communication stating otherwise, I also expected their markup to be removed separatelyIt is only logical that if there is no cost, there is nothing to markup, which is the same as other contractor estimates that I have dealt with in the pastAs I was busy planning/implementing the projects for the house, I didn’t have a change to fully examine all the issues that came to mindOnly after moving into the house and having time to decompress, was I able to examine all the issues and review paperwork to see if I had missed something along the wayAfter reviewing our communications a handful of times, I realized that Lemel Homes failed to disclose several key items which ultimately led to me paying a lot of money for them to provide a quote As Lemel Homes is in a position of knowledge, it is their duty to educate the customer to level the playing fieldLemel Homes’ response included “the owner accepted all changes and the project was completed to the owner’s satisfaction”They are correct that I accepted all changes, however, not being properly informed of your standard practices, I was at a significant disadvantage in my decision makingAs for being satisfied, I think all my prior emails to Lemel Homes’ clearly state my level of satisfaction of this whole processLastly, in response to Lemel Homes’ assertion that they removed their markup during the estimate phase of the project, they are wrongUntil the customer signs the contract, they are still in the estimate phase of the project as they can still make changes without any penaltyThat is how the contracts with my subcontractors workedAfter dealing with Lemel Homes’, I fully understand why so many people regret building a house

*** *** After thinking about this nightmare even more, I have decided to present the circumstances in an easier to understand format. 1) Lemel Homes intentionally neglects to inform the customer that they are still charging their markup. 2) Customer approves the contract with the understanding that the markup was removed. 3) When customer discovers that the builder markup wasn't removed, the customer questions Lemel Homes. 4) Lemel Homes responds with "Customer accepted and approved of all deductions".5) Customer realizes that his decision was based on flawed information as Lemel Homes failed to properly inform customer. It seems that Lemel Homes is at fault, but based on past issues, it seems like standard practice to work in an unscrupulous mannerAfter dealing with Lemel Homes, it seems like they operate under the idea of "what the customer doesn't know, won't hurt them".
