March 25, Dear *** ***:The American College of Radiology is a national membership organization for radiologists, radiation oncologists and medical physicistsAs one of our responsibilities we evaluate and accredit medical imaging centers and hospitalsIn this regard we report to the Food and Drug Administration (FDA) for mammography accreditation and to the Centers for Medicare and Medicaid Services (CMS) for other diagnostic imagingIn this particular situation *** *** received treatment at two facilities we accreditShe was not happy with the services she received and filed a complaint with our organizationPer FDA regulations the ACR reviewed her complaint, contacted the two facilities involved and completed an investigation of her allegationsWe concluded that both facilities followed established medical processes, complied with FDA regulations and provided her with the services requiredWe advised her of our investigation in several letters, specifically addressing both facilitiesThe second facility was not mentioned in our first letter to her because we were not aware she was including that facility in her complaintThat was an oversight on our partSo we initiated an investigation into the Second facility and sent her another letter with the results of our investigationWe also advised her that if she was not satisfied with our conclusion, she had the right to appeal our decision to the FDA, which she has doneWe have complied with all our requirements under the lawThe fact that our investigation did not find any substantial agreement with *** ***'s complaint is not a sufficient reason to find ACR at faultThe only settlement she would find acceptable is if we were to agree with her complaintAs I am sure you are aware, not every complaint reaches a conclusion acceptable to the complainantAnd since she has filed an appeal with the FDA, as we advised her was her right, I do not see how the ACR should be held at faultSincerely,

At this time, I have not been contacted by American College of
Radiology regarding complaint ID ***. I have reached out twice to *** *** for a copy of their policy and regulations they've referred to in their so-called investigation of *** Imaging Facility and *** *** Sally J*** but they've refused to provide these.I find it disturbing that ACR, the accreditation association for imaging facilities is so egregious in their actions and responsibilities. My opinion is that the main interest of ACR is to make money and not ensure the safety and health of patients
