I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my complaint For your reference, details of the offer I reviewed appear below The stamped concrete will not be yrs till fallThe initial stain and sealing failed in monthThey brought an expert to review who explained to [redacted] how to fixA crew came back during a rain storm to resell to repair the damageWe told them per [redacted] and the company it could not sealed during a storm and to wait Crew sealed anyway after I left property in rainCrew also took stain with them that was purchased by us as company had told us they could not buyColor on concrete that was supposed to be in pour is showing through as whiteWe did do a walk through with [redacted] and I stated concerns my concerns with seal he'd said looked fine not me and suggested we have revealed in spring this yearIn spring before snow gone we could already see spots it needs to have coloredWe agree stamped concrete needs to bê sealed to maintain but this has not kept color since installedCompany was also supposed to come back and repair sagging retaining wallThey did notCompany states complete satisfaction on their website We are not and have estimated to repair the workI also have pictures of work if you need Regards, [redacted]

American Design was NOT hired to dig down 4" and install stone, drains ectNor were they hired to to bring the existing patio area to building codes. The stone subbase was alrady in the area the around the sliding door before American design was hired American Design did NOT set the stone subbase height for the patio and they were not asked to change the height of finish patio. Mr *** told ADC what he wanted and that is what was done. The stone subbase was in before they arrived As stated CLEARLY in American Design estimate on the first line it says "we will fill in low spots with stone". ADC did net set elevations nor were we asked to change elevations. This is cleary not Americans Design issue and ADC's Attorney is very confident that ADC did as instructed by *** ***. Pour a patio on the stone subbase that was laready there If the *** wanted ADC to do what they are asking now the price probably would have been triple and they were on a budget so it was not entertained. This issue is not ADC responsibilty in any way

I am attaching a copy of a disclaimer that is at the bottom of our contract, It clearly states NO Warranty is given on concrete, weather in the Northeast is very brutal on the finish of stamped concrete and ADC is not responsible to maintain the finish the homeowner is, We did more than our share to make this customer happy and it will never happen. We are very sorry her displeasure but we restained it last year and resealed it at no charge(only because she stiffed us on payment for the reseal) but we let it go to make the customer happy. Not to mention ADC did not purchase the stain the owner bought the stain and in our opinion it is not a good quality stain it is a eco friendly stain and appears it doesnt hold up in this climateOnce again we do not warranty concrete or the finish. We are 100% confident we did nothing wrong and should be exonerated from this complaintHere is the disclaimer Any altercations, deviations or unforeseen circumstances will be considered a change order and an extra charge will be appliedADC is not responsible for damage or repair of driveways or asphalt, walkways, sprinklers, cable, phone or other lines buried under ground. .After the damages occurred, American Design Contracting came to view the damages and agreed there were problems They offered to remedy the issue by cutting along the foundation wall to relieve the pressure ADC did not offer to repair any damages associated with the heaving of the concrete patio, ( the walk-out basement slider door and buckled siding.) We then had a structural engineer come to assess the damages His report report states "the current concrete patio construction does not comply with NYS Building Code requirementsA minimum of a six inch space is required from the grade to the bottom of the exterior wall framing Surface grade and slabs are required to slope away from the building to prevent water entry." In conclusion, the report states "that corrective work requires removing the slab and frost susceptible soils to a frost depth of feet The soils can be replaced with gravel or stone, compacted in layers The slab height must also be lowered to comply with building code requirements."We are extremely disappointed in the way that ADC has handled our concerns related to the damages incurred by their faulty workmanship.As cited on American Design's website, "we give every customer superior service and guarantee 100% satisfaction with each job We pride ourself on quality craftsmanship from design to finished product We are driven by customer satisfaction." However, their abrupt dismissal to remedy this situation has made it necessary for us to pursue third party assistance

American Design does not warranty concrete, selaing, cracks in concrete ect. It is on every estimate/ contract.    It is clearly stated in the disclaimer signed by [redacted]. Our website states it also.   ADC warranties Brick pavers and hardscape work for 1...

year but does not warranty stamped or any tye of concrete work or sealing.  ADC went back last year and did a re-seal at a discounted rate and the [redacted] did not pay us for it anyway!  After that was completed [redacted] one of the owners did a walk through with the customer and they agreed it looked good and signed off on it.  Now its 2 years later and they want us back again at no charge.  We even let it go that they did not pay us over $1000 for the re-seal.   Now once again the harsh winters in the North east is over and its time to do the maintenance the [redacted] want another free re-seal.  Please refer back to the contract. THERE IS NO WARRANTY ON STAMPED CONRETE WORK IT IS THE OWNER RESPONSIBILTY TO MAINTAIN THE FINISH.   ADC can provide a copy of the contract if need as proof. We are very sorry they are not happy with the work or the amount of maintenance needed but this is NOT ADC fault or responsibilty

American Design and Contracting built the patio as instructed by [redacted] the home owner.  Here are the details of the situation.   ADC did an estimated for the [redacted]'s back yard patio, Marc did the estimate with [redacted].  When estimating several things were came into play by...

[redacted].     There was already an existing crushed stone patio under the deck and sun room area in question.  There was already several inches of stone in the patio area.   The area was not level and had many low spots in the patio.  [redacted] had stated he wanted the patio leveled all the low spots filled in and then a concrete patio poured on top of the stone.    [redacted] told Marc what he wanted and it was clearly outlined in the first few lines of the estimate provided. ADC would level the ground and compact fill in the low spot with pea stone the homeowner already had on site.  ADC did not set the elevation  the homeowner told ADC clearly what he wanted!   After the low spots were filled and compacted ADC poured 4" of stamped concrete as per the estimate.  Over the winter it was extremely cold and 3-4 feet of frost entered the ground this large amount of frost heaved the ground and also heaved the patio pushing up on the sill plate of the back sliding door, once it lifted this area there was a gap under the door. [redacted] called ADC and let us know of the situation and within a week (in the winter) one of the owners Joe went out to look at the situation.  At that time Joe determined this was not ADC fault and it was caused by the extreme depth of the frost heaving the ground and the patio.  Joe told [redacted] in the spring after the frost was gone ADC would come back at no charge and cut the area in front of the door so the concrete would hopefully not push up on the slider if this was to ever happen again.   Both [redacted] and Joe seemed to agree and that was our plan.  It appears that the [redacted]'s changed there minds and were not happy with the solution we provided and wanted the patio removed and replaced.  This is totally unreasonable and was caused by mother nature and not ADC's fault we were just trying to help rectify the situation.   A few things are very important here.  ADC  is not responsible for heaving ground or heaving concrete, nor does it warranty concrete work as stated clearly in the signed estimate [redacted] signed.  Second [redacted] told ADC he wanted the low spots in the existing stone patio filled in and a new stamped concrete patio installed on top of it. He set the final elevation not ADC.   He never stated he wanted the patio lower or at any other elevation or we would of happily given him an estimate for that. This would of been more money and he was on a budget for this work Since the complaint ADC has retained an attorney and given the information to him and he feels very strongly with the signed estimate the facts are clear that ADC is not at fault.  ADC will no longer discuss this with the [redacted]s all communication must be done through our attorney from this point forward

A crew came back during a rain storm to resell to repair the damage. We told them per [redacted] and the company it could not sealed during a storm and to wait . Crew sealed anyway after I left property in rain. Crew also took stain with them that was purchased by us as company had told us they could not buy. Color on concrete that was supposed to be in pour is showing through as white. We did do a walk through with [redacted] and I stated concerns my concerns with seal he'd said looked fine not me and suggested we have revealed in spring this year. In spring before snow gone we could already see spots it needs to have colored. We agree stamped concrete needs to bê sealed to maintain but this has not kept color since installed. Company was also supposed to come back and repair sagging retaining wall. They did not. Company states complete satisfaction on their website . We are not and have estimated to repair the work.
