I am writing in response to your letter ID Number *** dated 07/14/regarding a complaint against my company I called your office about seven days ago and my interlocutor requested that I write a responseIf I am understanding this correctly: the customer, *** *** *** *** , who
purchased a vehicle from me is supposedly concerned that some sort of fraud has been committed He feels as though he's been misled in some way and would like a refund or for his car to be repaired
On 10/07/I was an intermediary between *** *** *** (to whom I sold a Subaru Legacy Outback Vin ending 603274; who asked me to resell it) and *** *** *** ***He saw my advertising on craigslist and called me to set up an appointment so that he could examine and test the Subaru*** *** visited my office twice and informed me that he knew a lot about carsHe checked the car, test drove it for miles, and then told me that he wanted to purchase itAt this point in time, the car was very safe and, if continuously taken care of, it would have remained this wayI informed *** *** that the vehicle was being sold to him "as is"He accepted the car in this condition, which means the car had no warranty Through this transaction , Adam *** *** accepted the responsibility for any and all repairs needed after the car was driven off of my lot
When the transaction was completed , I did not receive a complaint from Adam for quite some time This means thatif he was driving the car legally, the car indeed passed a Delaware Safety and Emission Inspection (since this is a requirement to get a tag and title under his name) And so, according to the state the car was safe at the time of purchase After Imonths he notified me of the issues he was having with the vehicleHe informed me that he had already hired a lawyer before he made the callThat he was already starting an action against my business and told me to either fix his car or refund his purchase
Because *** *** purchased the vehicle from me "as is", I am not responsible for any repairsAnother issue that arises is he's driven a year old car for months and never complained throughout this period He is not entitled to any form of refund and no fraud has been committed and I am sorry to inform *** *** *** that I cannot assist him in this way

Review: I purchased a 2000 Subaru Outback from [redacted] at American Dream Dealership on October 7, 2013 for $1900.00. During the test drive [redacted] assured me this was a very reliable vehicle for my family. He stated it only needed breaks and nothing more. I explained to [redacted] that I am a single father of two children and needed something reliable and safe. He then reiterated what he previously stated. He said he would keep the car himself for his own family, but he's in the business to sell cars, not keep them. From on family man to another, I trusted his word and purchased the vehicle from him that same evening. In June of 2014 while driving home with my kids, he heard and felt a loud noise from underneath the car. After we arrived home I looked underneath the car to find the rear suspension sub frame was cracked in half due to rust. Due to this failure it busted the drive train rod as well. I had the vehicle towed to a dealership to analyze the problem and a quote of 3500.00 for repair. I called [redacted] to inform him of the problem. He told me it wasn't his problem and hung up. Under the Consumer Fraud Act he gave me false information to sell this vehicle.Desired Settlement: I am asking for a complete refund of the 1900.00 purchase price or the costs of repairs to be covered by [redacted]. The quote to repair the vehicle exceeds the value of the car so perhaps it would be wise for him to take the car back and give me a refund.

At this point in time, the car was very safe and, if continuously taken care of, it would have remained this way. I informed [redacted] that the vehicle was being sold to him "as is". He accepted the car in this condition, which means the car had no warranty . Through this transaction , Adam [redacted] accepted the responsibility for any and all repairs needed after the car was driven off of my lot.

Another issue that arises is he's driven a 14 year old car for 8 months and never complained throughout this period . He is not entitled to any form of refund and no fraud has been committed and I am sorry to inform [redacted] that I cannot assist him in this way
