I am rejecting this response because:This company has not performed as they indicated they could. To begin with I never stated I was "terrified" of the phone. I am an Emergency Department nurse, at the time I was also working on a Cardiac unit taking care of patients and I also work on call as a Sexual Assault Nurse Examiner. From this schedule you can see I am very busy working jobs. I work to days a week, sometimes over night. When I am on duty for my hour shifts, I am busy taking care of patients, these patients could be your family members, do you want me talking on the phone when I am caring for them. I explained this, in detail, to *** at the very beginningI am unable to take or make phone calls but can make and receive texts and emails. He assured me he could get the job done for me. It has now been months and he has failed to perform as he said he would. His lack of follow through has cost me money and time, I could have had this refinance done months ago at a much lower rate than I have now. The time line he provided, not only is not a full representation of all our conversations, we had many conversations by texts. He also did not include the conversation where I specifically asked him if he was not going to be able to get the job done he needed to let me know right away. He assured me that he could do it. From his response, it shows he let weeks go by without letting me know the documents he needed and didn't have. I sent documents the documents he requested in the beginning of our conversation. He had copies of my tax returns, but he failed to follow through and let me know what he needed. I am a very busy person and I can't read minds. If you didn't have the document you should have told me sooner, instead of waiting weeks to tell me you needed itI hired you to do a job and can't anticipate what you need, that is your job to tell me and remind meI explained in a a text that I am very knowledgeable in the world of medicine but very ignorant when it comes to the mortgage world, that's why I hired him. He assured me again, he understood and could get the job done.I continued through the month of November into December to contact him to find out where we were with the loan, he said he couldn't help me because the rates had gone up. If he had done his job in October and November, advising me of the imminent rate increases and kept at it, this loan would have been closed in October. My guess is he forgot about me because he was too busy with other loans. He has even stated to me that he has never had a case like mine and has closed loans in the same period of time. This just further emphasize that he neglected my file from the beginningI questioned my realtor friend, ***, about his ability because she was the one who referred me to him. She said that he was able to get the job done. I contacted her in December to ask her if she had ever had problems with *** or his company. She was amazed that I was still trying to get this loan closed a two months later. Her statement to me was " I thought your refinance had been taken care of months ago, why is it taking so long. Do you want me to reach out to *** to find out what is going on?" I told her yes, this might help get things going. She did contact *** and he sent me a scathing email attacking me for talking to my friend, ***, about this loan processHe attacked me for questioning his integrity and yes I do question it. It is now months later and still no closingI also wanted *** to know of the troubles I have had getting this loan processed so she would be aware of this company before referring other clientsLast week I was contacted by *** telling me that I would be required to file my taxes directly with the IRS for his company to process my loanThis is after he has seen my tax returns for the last years, seeing my bi weekly pay stubs and requiring me to jump through a ton of hoops. Paying off a credit card balance. He even gave my credit and personal information to a *** Insurance Agent friend of his, with out my permission or checking with me first. I then was required to change my home owners insurance to this company to be able to get this loan processed. Even after I changed from my current insurance carrier to the farmer agent *** spoke to and got quotes from without my knowledge, his company put the requirement of filing my taxes for 2015This is an impossible requirement, which his company knows. I worked, from the day they told me, every day for at least hours. They told me I would have to accomplish this by 2/8/for the loan to close on the projected closing date of 2/15/2016. I would have had to travel to downtown Denver, take all my paperwork, which I had not even received, including my Wforms. I would have had to have an IRS employee complete and sign off on my tax returns in their office, for this company to process my loan. I have this requirement, from *** the co owner of American Dream Mortgage in writing on an email. This company offered me no alternatives or solutions. I asked them to tell me if they couldn't process my loan, to let me know. They have cost me money and time and I could have had this taken care of months ago

When the customer enrolled their two children at Creative Treasures Preschool on January 8, 2015, they signed registration
formsThe registration documentation included a clear statement that the registration fees were not refundableThis provision is very common in preschools in our area, since once a child is enrolled, the preschool incurs costs for documentation preparation, database updates, equipment purchases, classroom supplies, school bag purchases, supplies for class parties, craft and snack purchases, and for holding open the classroom spots for the childrenThe registration fees were clearly stated as being not refundable
In this particular case, there was no change whatsoever in the teaching situation for the older childSandy *** was to have been the teacher, and Sandy *** remains the teacher for that classNo change
At the time of the younger child's enrollment, the teacher for this class had not yet been selectedLater, Mrs*** (a planned new hire) indicated her intention to accept the teaching position for his class; however, when she later declined to accept the teaching position for personal reasons, the teaching assignment was given to another staff member, Mrs*** Preschools can never guarantee that a specific teacher will be available for a specific class, due to resignations or other personal situations that can arise either before the start of a school year, or even during the school yearMrs*** is well qualified to teach this classAt no time after Mrs*** stated her intention to decline the teaching position was the customer told that Mrs*** would not be teaching this class
Creative Treasures does not normally refund registration feesIn particular, in this case, the notice of cancellation was not provided until very late (July 29th), which was well after enrollment services had been performedIn the other case mentioned in the complaint, we found that there was an unusual extenuating circumstance that made a registration refund appropriateThere is no such an extenuating circumstance in the present situation
In summary, the Creative Treasures registration documentation clearly indicated that the fees were not refundableWe believe it would be unfair to other parents who have abided by the no-refund policy for Creative Treasures to provide a registration refund in this case
