Attached are [redacted] 's down payment receipts21st Mortgage signature page, [redacted] Final Sales Order Her first down payment was $on October 7, then her second down payment was $5,on November 24, She signed her Final Sales Order with [redacted] on December 8, then she closed with 21st Mortgage on January 8, If at anytime [redacted] did not like the way her mortgage was structured then she had several months in which to talk with her loan officer at 21st Mortgage regarding a change As evidenced by the attached documentation, [redacted] did not bring any money to closingAll monies were paid months before closing [redacted] is an [redacted] employee therefore he does not have any say as to 21st Mortgage's requirements [redacted] 's down payment was approximately 10% of the sale price of the home It is my understanding, 10% is a typical mortgage down payment Again, [redacted] should have dealt directly with 21st Mortgage if she was unhappy with how her mortgage was structured Also, I do not know what "unfinished" means I cannot locate any written request for warranty or additional "finish" work on her home According to our service records, the last requested work was completed on March 19, It appears the work was satisfactory as we have not heard from her and, to my knowledge; we have not received another request.Sincerely, [redacted]

Our position remains as stated in our previous communication. We will reassess our position if new information becomes available. At this time we are closing our file for this case

The
*** home was installed in November In February 2013, *** *** was made
aware that the *** home had a potential water intrusion and mold
problem. As a result on February 21, 2013, our service manager, Jason
*** inspected the home and found a roof vent leak which ran
into the wall
cavity of the utility room. Environmental Solutions, a licensed
mold consultant, was hired to test the home for mold. The mold test was
positive therefore *** *** contracted with Environmental Remediation Services,
Inc, a licensed mold remediation company, to professional clean the home.
Once the remediation was complete, Environmental Solutions retested the home
and found it was clear of mold contamination (see attached report dated March
18, 2013). We were cleared to make the repairs and allowed the *** family
to move back into the home
On
December 15, 2014, *** *** was contacted by *** *** complaining of mold
contamination. Again *** *** sent a service representative to inspect
and Environmental Solutions to test the home for mold contamination. Environmental
Solutions’ report, dated December 24, 2014, found a low count of Cladosporium
which appeared to be from condensation due to moisture buildup during bathing
activities and/or elevated humidity results within the home (see attached
report). They found a high humidity level in the home but no
moisture damaged building materials or suspect microbial growth was noted
during their evaluationNo remediation was recommended
Oak
Creek also received a mold test (Pro-Lab report attached) from Mrs***.
Page of her report summary states, “Unusual Mold Conditions(s) Exists: No.
If NO: The samples in this report do not indicate the presence of
elevated indoor mold spores or colonies for the specific locations
only.
Based
on the information provided in the above listed reports, *** *** denied the
claim and sent an email (attached) along with the Environmental Solutions
report to Mrs***

It is my understanding, the Texas Department of Housing and Community Affairs has inspected the home. TDHCA is the state regulatory agency for ***-code homes. If TDHCA finds any code violations in the home then they have the authority to require the manufacture to make repairs. *** *** is waiting for the TDHCA report

It is my understanding, Statewide resolved this issue with the city yesterday and contacted Mr. Elmdahl.  Please let me know that is not the case.Sincerely,Ronda McAllen

No matter the levels there is still mold in here and it has made me and my family very I'll I believe [redacted] was erroneous in just looking in one place when my roof caused the issue it was never replaced. I will get to the bottom of this I just have no understanding of how u sell a new home to people find mold in it and not accept any responsibility when the home is causing illness. New home ownership doesn't include all the stress and pain I have dealt with regarding this whole mess. Each time it rains my hives are ten times worse further proving there is still a problem here somewhere.

We regret [redacted]'s disappointment with her [redacted]
purchase but according the attached contract, it was well documented the home
only included an 18 c.f. refrigerator and electric range (see attached home
spec sheet and floorplan).  Furthermore,
according her Final Sales Order,...

she purchased the home, delivery, setup, a caliche
pad, A/C install and a set of steps.  She
did not pay for skirting.  If [redacted] would like to purchase the skirting for her home then we would be
happy to work with her.  [redacted]’s
finance agreement, how the mortgage is structured and the amount she was
required to put down are determined by her mortgage company not [redacted].   As to the exterior colors, I have attached [redacted]'s décor sheet.  The colors chosen are Rainstorm for the siding and Sandbar for the trim.   It is my understanding, Sandbar is along the lines of a beige not gray.  Please note: all the documents I have submitted have been signed by [redacted].  Again, we regret [redacted]'s displeasure but the home was ordered and built to the specifications stipulated in her executed documents.

Mr. [redacted] purchased his home in July 2010 from an
independent dealer, [redacted] Homes, who is not affiliated with Oak Creek
Homes.  The home was manufactured in
October 2008 then the home was shipped directly to [redacted] retail center.  [redacted] used the home as a lot...

model for
approximately 21 months prior the sale of the home to Mr. [redacted].   [redacted] was responsible for installing the
home on their retail lot as well as Mr. [redacted] home site.   I have corresponded many times with Mr.
[redacted] to explain that staples on the roof are used to secure the plastic that
covers the roof for shipping purposes only. 
 I do not know if [redacted]
installer re-stapled plastic over the roof when he moved it to the [redacted] home
site as Oak Creek was not a party to transport and installation of the home for
[redacted].   The retailer and/or installer should remove
all staples then seal the holes.  This is
not a function of the manufacturer. 
Staples are not a part of the shingle installation. 
Oak Creek provides a Manufacturer’s 1-year Limited Warranty.  During the first year, Oak Creek responded to
four service requests.  According to our
service records, the last requested work was completed on October 8, 2010.   It appears the work was satisfactory as we
have not heard from Mr. [redacted] and, to my knowledge; we have not received
another request until now. 
Years 2 -7 are covered by a limited warranty which is
administered by a third party, [redacted].  There
are exclusions with this warranty which are detailed in the warranty document
sent directly to Mr. [redacted] from [redacted].    Shingles are not covered by the extended
warranty due in part, to their exposure to severe weather and the need for
homeowner maintenance.  As I explained to
Mr. [redacted], the Homeowner’s Guide instructs the homeowner to annually inspect
the roof.  If Mr. [redacted] had inspected the
roof within the first year or even the first two years and found problems then
Oak Creek would have responded.  Since
this was not done and the home is now over three years past the warranty
expiration date, Oak Creek has declined Mr. [redacted] request.

I feel that this company used deceptive trade practices in regards to this sale. Granted I did not order all these other things but I was not aware that the home came unfinished. I specifically told the salesman that I wanted that particular home after I viewed the models. The model home was finished. My objection to the financing is not with the finance company but again what I was told by the salesman [redacted]. He specifically stated that I could use 60 percent of the value of my lot as down payment in lieu of cash. It was not until I was ready to close that he told me I needed cash otherwise it would be several months until I had my home. At that point I had no choice. This company is great at omitting details. I am again terribly disappointed in the final product and the extreme disregard they have for their customers.

                 I NEED TO COLLECT THE MONEY PAID TO THESE PEOPLE FOR CHECKS THAT ARE NO GOOD !!!    I CAN FAX COPIES OF THE CHECKS SO THEY CAN BE PROCESSED BY THE AUTHORITIES AND CHARGE THE PEOPLE WITH A CRIME AND OR CRIMES.                 I HAVE COPIES OF THE CHECKS AND COPIES OF THEIR DRIVERS LICENSES TO PROVE WHO THESE PEOPLE ARE AS I VERIFIED WHO THEY WERE WITH THEIR PICTURE I.D.'S.. THEY CAN NOT DENY THAT THEY WERE IN FACT THE PERSONS WHO I CASHED THE CHECKS FOR .. I WAS TOLD BY THEM THAT THEY WORKED FOR THIS COMPANY...  THEY KNEW EXACTLY WHAT THEY WERE DOING AND THAT THEY FORGED THESE CHECKS INTENTIONALLY... I WOULD LIKE YOUR FAX NUMBER AND I WILL SEND YOU THE COPIES I HAVE RIGHT AWAY SO THAT WE CAN CATCH THESE PEOPLE AND HAVE THEM PROSECUTED AS TO TRY AND RECOVER THE MONEY THEY TOOK.   THANK YOU , SINCERELY..
