The consumer, Mr. [redacted], bought a Certified Pre-Owned Infiniti from Bradshaw Infiniti in August of 2017. That particular unit was listed on the website as having a Premium package and the features of the Premium package were listed on the vehicle description page. The vehicle features/descriptions...

are sourced from the Infiniti national office and the dealership has no way to edit the “Vehicle Features” bulleted list on the website page. One of the features listed on the Premium package was “Infiniti InTouch Services including 6 months of safety, security, and convenience services”. This particular feature is included for 6 months on new Infiniti vehicles only, but is available to purchase on a yearly subscription basis for Certified Pre-Owned units. At the bottom of the vehicle description page on the Bradshaw Infiniti website is the following disclaimer:“All prices, specifications and availability subject to change without notice. Contact dealer for most current information” and “The features and options listed are for the new 2016 INFINITI Q50 and may not apply to this specific vehicle.” The customer cited the vehicle description page as a form of “advertisement” and brought the issue up to our Executive Manager, Robert S[redacted]. Mr. S[redacted] went over the website page and vehicle description page with Mr. [redacted], including the disclaimer. Our solution to this issue is the following: we ask that Mr. [redacted] enroll in the yearly subscription plan through Infiniti to activate the Infiniti InTouch Service. Once he has a confirmation of his enrollment and payment for the yearly subscription service, we ask that he email his confirmation/receipt to our Executive Manager and we will reimburse Mr. [redacted] for 6 months of service.

Thank you for inquiring about your service experience at Bradshaw Infiniti.  Your inquiry information is correct.  As you know, the manufacturer warranty of your vehicle did replace your manual transmission.  As a requirement to have the warranty authorized, the manufacturer required...

us to inspect your wear items which included your clutch.  You authorized us to inspect at your expense your clutch and internal wear items.  Which upon inspection were worn out, you visually inspected the items yourself and agreed they needed to be replaced.  Regardless of any further transmission issues, this was a wear item and you the consumer agreed to have them replaced at your expense.Once the repairs were done to your clutch assembly, the transmission was re-diagnosed and was replaced by the manufacturer.  It is unfortunate that the transmission needed to be removed and installed twice, but unfortunately this was necessary to properly diagnose the repair.Regardless of the warranty repair, you the consumer would have been responsible for replacing the wear items.Bill D[redacted]General ManagerBradshaw Infiniti

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  I do not accept the response as satisfactory because the business insists that I am not owed any type of cash refund. Any reasonable person that is told what transpired between myself and the dealership agrees that I am owed a refund. Yes, wear item parts are not covered (by the manufacturer warranty) and yes I agreed to pay for the clutch assembly in my vehicle: upon the professional opinion of Bradshaw Infiniti who assured me that it would fix my transmission problems. I was leery that a new clutch would fix one gear from grinding (when all the others worked fine) but I had the work done because I was under the impression that I was dealing with a professional, fair, and ethical establishment. I was under the impression that I would be treated fairly if I paid for something that did not fix my issue... especially after explicitly asking Michael B[redacted] (the service writer) "what if this does not fix my problem?" and his exact response was: "well then we'd have a lot of explaining to do".  Clearly I was wrong and have learned some lessons about not trusting service writers, service managers, or anyone at dealerships in general.

Review: In March 2014, I asked him to repair a faulty gutter on my house. I also asked him to put in a gutter on the front of my house. I have a split-level home. My wife came home from work and paid him the agreed $350. I came home and he had not put a gutter but a diverter on my roof. I was upset, but my wife had already paid him so I just let it be. I wasn't completely satisfied that he had put the diverter instead of a gutter, but the agreed contract didn't outline that specifically so I let it be. However, the gutter he repaired wasn't properly repaired and six months later, I paid another contractor $470 to replace the gutter he "repaired" and put in gutters like I desired originally on the front. I also put it on the back as well. I didn't ask American Men to put it on the back. But the real issue is that the diverter American Men was installed in a shoddy fashion. The contractor installing the gutters noticed severe sag and damage on the roof and attributed it to water getting through the roof onto the wood underneath from the diverter. Further, the damaged roof was leaking water through a seam down our porch and was rotting the wood on our porch. So I paid him $350. His shoddy work has cost me $400 to replace his work on the gutters, $350 to replace the roof damage caused by the diverter, and approximately $2000 to replace the rotten wood on my porch. Desired Settlement: I would expect a full refund.

I got three bids on the roof and the best price got the job. I can't complain about anything. They were professional, skilled and on time. Perfect job! I'll use them again.
