As with all liquidated merchandise purchases there is risk involved and we make this risk abundantly clear to all customers PRIOR to allowing them to make a purchase from us. Our truckloads are sourced via contracts and agreements with retailers and the truckloads are unloaded LIVE on our
Facebook group page located here https://www.facebook.com/groups/842627572470643/. We receive several truckloads of merchandise every day and broadcast the trucks unloading on the internet for our customers to see exactly what the pallets look likeOur buyers purchase them right after they are unloaded which was the case for the pallet of display units. This pallet was received and unloaded from a truck less than minutes before it was visually inspected by and voluntarily purchased by the customer. We do not know exactly what is on the pallets and we in no way manipulate the pallets or the merchandise on them. We determine the price of the pallets based on what retailer it came from and the cost of freight to receive it. Once we were made aware of the pallet of display appliance units I contacted the warehouse manager (***) for a resolution. He notified me of our cost of the pallet and offered a credit of $50. This credit was offered even though this pallet was chosen at will by the buyer and the buyer understood and assumed the risk of buying liquidated merchandise with the understanding that "American Pallet Liquidators sells liquidated, off-price, distressed merchandise and makes no promises of profits to be madeAll merchandise is sold AS ISNo warranties applyNo returns, refunds, credits or exchangesBuyer agrees to refrain from advertising the name of the department store from which this merchandise originatedBuyer is responsible for all related taxes, licenses, and shipping charges, unless otherwise stated" which is posted in the warehouse, online and is also printed on every customer receipt. Shortly after the $credit was offered the customers husband arrived to redeem it. He asked the clerk at the desk to verify that the credit was available and proceeded to browse the pallets. While doing so he proceeded to tear into the shrink wrap and boxes on several pallets causing damage and making a bit of a commotion. A warehouse associate asked him not do tear into anything and made him aware of the posted rules hanging from several banners in the warehouse. He became angry and combative and the warehouse associate walked away to notify me of the situation. I came out to the floor to observe. I chose not to say anything as he seemed to have calmed down and was quietly browsing. Several minutes later he approached me aggressively, yelling that the warehouse associate had falsely accused him of tearing things. I asked him to calm down and explained to him that the associate was only trying to do his job and apologized if he was offensive. He continued to argue and eventually I just had to walk away. I was then notified by the front desk clerk that we had just received a disturbing Facebook message from the customers wife where she made numerous threats against us and advising us that she had contacted a layer. At that point I contacted our legal department where I was advised to ask him to leave because of his aggressive behavior towards us and due to the fact that they are seeking legal action against us. Up until this point we were fully prepared to rectify the customers dissatisfaction despite all policies and disclaimers in place. At this time, we have made every reasonable attempt to resolve the customer’s concerns. The following statement has been provided by our legal department: “Because of the customer’s aggressive actions towards our employees and the threats made we ask that the customers not return to any property or facility operated by American Pallet Liquidators and all future communications be done in writing to ** *** *** *** ** ***
