Thank you for your letter that we received on Friday December 4, with regard to the termite service agreement at Consumer's premisesWe appreciate very much any assistance that you can give in order to successfully bring this matter to a
satisfactory resolution for Consumer
Consumer contends that we did not provide inspection of his home in That is true, but it isn't because we didn't attempt to schedule an appointment in order to provide the inspectionConsumer contends that we have normally done his inspection in April or May, and it is true that we have often done his inspection in April or May, but if consumer will check his records more closely he will find that we have also performed the inspection in July, August, and September in some yearsOur service technician spoke directly with Consumer in an attempt to schedule an inspection on October 7, at 2:p.mwhen the temperature was degreesConsumer refused to schedule an appointment for the inspection and told our employee that it was too late in the year and that we could call him the following MayOur policy allows customers to choose not to have an inspection in any given year, but in order to maintain the agreement, they must pay the annual maintenance feeWe sent a letter to Consumer to request payment in order to maintain the service agreement as stated in his contractConsumer states that he has no written agreement with our company, but I'm certain if he checks his files more closely he will find a number of signed termite service agreements with our companyWe are enclosing the most recent contracts with consumer dated September 22, 2011; June 16, 2008; and May 29, Please note that each of these agreements are signed by ConsumerThe agreement states that American Pest Control, Incagrees to render a termite inspection with a one year service agreement subject to the provisions listed under "Service Agreement"It also states that American Pest Control, Incagrees to inspect this consumer's house and attached garage once each calendar year, which, as stated previously, we did attempt to doThe consumer-signed and agreprovisions also state that American Pest Control, Incwill renew this service agreement on a year to year basis once all payments have been made as agreed upon(See #3.)
It is our belief that Consumer misunderstands exactly what American Pest Control, Inc.'s termite service agreement isHe seems to believe that the fee is specifically for the termite inspectionHowever, there is actually no charge for the termite inspection itselfThe charge is to maintain the service agreement that states, "American Pest Control, Incwill treat any live termite infestation, should any occur, be found and be reported to American Pest Control, Incin the designated structure(s) without additional charge" provided all the other terms of the agreement are met
We also disagree with Consumer that termite inspections only have value in the springTermites are actually active year round and we are still performing both termite inspections and termite treatments today in December
We would be more than pleased to retain Consumer as our customer provided that he allow us entry to his premises to perform the termite inspection and that he pay the contractual fee to maintain the service agreement prior to December 31,
I am enclosing three recent written agreements between the parties as well as the written correspondence between the parties including the service ticket for the inspection with notations of customer comments on October including that "he would get another termite company"
Again, thank you very much for your assistance in bringing this matter to satisfactory resolution for both parties

I have never received a copy of their contractI did business with them for over yearsDuring the first to years, the inspector signed a document indicating he had completed the inspection each yearThat document was left with me and is the only document I was allowed to keepUntil the past year, the inspector would call early in the spring and make an appointment to inspect my home in May or JuneOn one occasion I had to delay the inspection due to two deathsI was an executor for an out of state estate that took lots of my timeIn my neighborhood termites seem to be discovered in May or JuneOctober is way too late to be effectiveAmerican changed the timing I told them I wanted 30+ years ago that they honored that request until recentlyThen they stand behind a contract that I don't have to do whatever is convenient for themI have since talked with a competitor who will come when I want them at a lower price than American's
