Complaint: [redacted] I am rejecting this response because: Like I said - we have no water IN OUR HOME as stated in the contractWe have no heat coming from furnace ----and you know all about the air conditioning Figure out a way to work this out with [redacted] or you get kicked off the job and I get in touch with consumer affairs next [redacted] offered to give you $day you came - I have paid over $that would make it $ which should be satisfactory according to the back of the building permit Regards, [redacted]

I would like to start with the attic complaint, we swapped out the furnace in the attic, there was nothing in there, other than existing duct work; therefore I am not understanding what we have trampled onAs we do with all of our customers, we schedule every appointment prior to going to any job site and work around the customer’s schedule, as we have done with ***Prior to installing the air condenser, [redacted] had never mentioned bolting it down, also air condensers are not made to be bolted down they do not have any mounting plates from the factoryPrior to installing the air conditioning, when [redacted] had called me and explained that he hadanother plumber come by for the cooling problem I had asked him why he didn't call us first, he then stated it was a friend of his who stopped by, I then setup an appointment to come by and look at the system [redacted] had problems with the ducts from the forced air system as I explained prior to starting, [redacted] stated he was going to fix the ducts himself, this took him a month to get repaired, we then set up another appointment for the AC, we changed a part in the cooling coilThe Customer only paid the first payment and always said every time we showed up they will give us a 2nd payment and never honored there agreement of payments, as it was the same for this last visitThe money paid did not cover the materials which we had installed in his homeAs per the contract between [redacted] and American Plumber we have completed everything in the contract [redacted] has not paid what he was supposed to as agreed upon in the contract holding back more than half of the contract moneys that are due for inspection purpose not abiding by the contract terms insisting that he is going to pay us every time we have gone thereWe have completed all of the work as per our contract and returned every time [redacted] had called us with any concerns

As stated in the earlier email all work pertaining to this job that was written on the contract was completed and all issues had been resolved as far as our work to the contractWe do not disrespect or damage our custmers property or materials, as *** Claims, and if there was any damage, why did he not mention it to me on any of the other visits when we where there doing work at his homeAs I stated to *** a ton condenser is more then enough for a small sq foot ranch houseAlso, if there are any issues, we would be more then happy to resolve them when the weather conditions are warm enough for us to check the system as it turns on*** needs to make his 2nd payment before any work may proceed, this is non-negotiable

I am rejecting this response because:I would like tostart with the fact that [redacted] called the day of the Air conditioner installand said his “guys are going to be there today.”  His workers should not have brushed ourconcern aside about securing the unit – We expressed it and they should haveacknowledged it – BUT looking back I can see it is all about time andmoney.  Everything was a big rush when itcame to the heat and air . [redacted] worker [redacted] always seemed to beinconvenienced and in a hurry.The duct work forthe chimney - which had just been approved by our home inspector had beendisconnected and dented – AP’s workers didn’t appear to be too gentle with theequipment they put in place – since they were the only contractors in the attic– there is not other way that could have occurred.  The duct work in the same are also looks likethey dragged the furnace over it.  As forthe cooling problem  - [redacted] was thefirst person we called when it wasn’t working correctly – after they fixed theleak that created puddles of water in our downstairs bedroom and basement – We saidThe Air conditioning is not cooling.  [redacted] said it’s the plenum and duct work –we fixed that (It obviously wasn’t the problem and a waste of our time and moremoney); which is how we noticed the fireplace duct problem that had occurred.  We told [redacted]  the airconditioner is not cooling.   We told[redacted] the second time and he sent his worker [redacted] with a tester and he told us “thereis enough coolant in the system.”  Yetwhen we turn the air on – the temperature went from 75 to 78.   Icalled someone who was recommended by my sister to get an outside opinion – he saidaccording to his calculations– (it isa mismatched unit – 3 tons in attic – 2.5 on the outside) – you need morecoolant.   The air coming from the ductswas not coming out cool enough to lower the temperature in the house.  Apparently [redacted] is not an air conditioningguy – he is only a “replacer” .  Hereplaced a system and did not care if it functions correctly – apparently hisjob is done at the “replacing” stage and does not care about it functioningproperly.  When [redacted] asked for payment(the day he was working on water outside) [redacted] reminded him the air conditioneris not cooling our home and we are not paying for it until it works properly.  They had a discussion about the airconditioning guy that checked his work – and the end result was that [redacted] had[redacted] come and replace some minor part on September 9th and I believehe added additional coolant.  Since itwas September the temperature outside was too cool to test the unit and it wasstolen about 3 weeks later.  As I said inthe first complaint – We paid to receive water, heat and air in our home. We donot have water, air or heat in our house – so I don’t know how [redacted] can befinished with the job.  And as I saidbefore – American Plumber is solely responsible for delaying our move into thishome.   As for payment – the buildingpermit says we don’t have to pay until everything passes inspection and so doesthe New Jersey Home Improvement Practices Act. The contract says water in the house – we have no water in our house –we have no heat coming from our furnace. When [redacted] came to put the tester onthe gasline to be inspected – he demanded money ($5000) and said he will notput the tester on until he gets the $5000. (My husband offered $2000. In goodfaith which wasn’t ehough for [redacted] )And that he would “pull our permits”  (he did not pay for them).  Why [redacted] would even consider not puttingthat tester on is totally ignorant – we could have had an inspection of the gasline and been done with that part of the contract.  He only delayed things more by storming offand refusing to put the tester on the gas line.  American Plumber will be kicked off this jobif they don’t find a way to resolve our disagreement.

We will not be responding to any other emails regarding [redacted] needs to make his payment as the contract states, we will not be roped into making trips to his home without payment that is due.
