Improper placement of product resulting in nonuse and safety issue.Concrete installed and put diving board in wrong position. Desired SettlementJob to be done right and safe.Business' Initial Response my company American pool decks installed a deck for the said client. while installing his pool deck I specifically asked him for his measurements for his diving board jig that is installed into the concrete. he told me the measurements were 32" from the waters edge I did ask him on three different occasions if this was a correct measurement one time his wife was there another was in front of some of my employee's who also heard him say 32" from the waters edge I dident question this again due to the fact that the pool company that installed his pool has often has different measurements than most other pool installers. American pool decks has been in business for 20 years and has installed over 500 diving boards with no issues I simply did what he told me to do! I was willing to fix this problem but he refused the offer and proceeded to threaten me with legal actions this client received the quality of work in wich he hired me for and nothing less. I hope this matter can be settled in an honest and fair manner thank you Consumer's Final Response (The consumer indicated he/she DID NOT accept the response from the business.)The statements are inaccurate. Due to experience with that pool installer the [redacted] knew that they sometimes positioned the diving board differently than other pool companies. The [redacted] proceeded to ask the customer how far from the edge of the pool the diving board would be mounted. This is where the [redacted] would place the mounting jig in the concrete when pouring it. The customer went back to ask the pool installer and replied that it was 32" from waters edge. This is where the miscommunication occurred. The measurement provided by the customer of 32" was the distance from the tip of the diving board to the waters edge, NOT the distance from the mounting jig to the waters edge. This was not the measurement the [redacted] asked for. The customer did not specify that the measurement was from the tip of the diving board NOT from the mounting jig. The measurement from the tip of the diving board to the edge of the pool does not help the [redacted] in installing the mounting jig because different diving boards vary in length and setup. This same question was asked at three different occasions because although 32" is a possible position, normally it is positioned 24"-26" from the waters edge. The customer told the [redacted] the measurement was 32" all three occasions. Once on the contract signing day, once when performing prep work, and then again on the day it was being poured. The [redacted] then used the 32" given and installed the mounting jig that distance away from the pool. Two weeks later after the concrete was fully hardened the customer placed the diving board on the jig and noticed that the positioning was off. The customer then called the [redacted] stating that there was an issue with the diving board. The customer insisted that the diving board was installed incorrectly because it was too far from the waters edge and the [redacted] was at fault. He repeatedly stated this even though the board was installed at the distance the customer specified, 32". Knowing that the diving board mounting jig was installed as specified 32" from the waters edge and he was not at fault, the [redacted] still offered to cut the existing mounting jig bolts and core drill and install new anchor bolts at NO COST. Core drilling anchor bolts into an existing deck is a common industry practice and is equally safe as the mounting jig technique. The cut studs from the improperly positioned mounting jig would not be visible at all once the diving board base was installed. The customer would not accept this offer directly stating "I will not have you butcher my deck". The customer was reasonably upset after spending money to install a custom pool deck and having something go wrong. However a fix to the problem was offered at NO COST and the customer still did not accept. The [redacted] was more than fair to the customer during the entire build process. The job was quoted at a very reasonable price and it even included a free walkway at an estimated value of $500. The job was performed in a professional and timely manner and was completed ahead of schedule. The [redacted] does not believe he was at fault in this situation. The [redacted] has installed over 500 diving boards and been in business for 20 years. Knowing the [redacted] built the deck to customer specifications he still offered a FREE fix to the problem, knowing that a small cost to obtain the new bolts and the inconvenience of performing the fix was worth making the customer happy. The customer chose to reject this offer, but the [redacted] is still willing to fix the diving board for a fee.
