ASEC has a clause in the contract informing homeowners that they should hire an electrician and draw permitsThe homeowner asked us if we could do it since it was a simple hook up and the fan only draws WattsThe information in this complaint is fabricatedThe homeowner bought his house
knowing that his entire electrical system is faulty and needs to be replacedHe told us the house has "fuses" and they keep blowing outHe initially called us because his microwave would not workIt is on a separate circuitIt blew a fuse and he noticed our fan was still workingNow he is trying to extort thousands of dollars from us to fix his electrical problemsWe believe we were set upAs for workers grabbing live wires? Who would do that? Our employee says he never said such a thing or would never do such a thingWe have testers for checking electricalWe offered to pay for an electrician to wire the fan (cost $100) and when I tried to talk to him he refusedHe thinks he can get a lawyer and sue us for thousands of dollarsSome how he needs to be damagedHis only problem is that his AC blows fusesIf a fan that draws the same power as a light bulb caused this, he has overloaded the circuit and will probably start a fireWe are a family company and do not make huge profitsThere is no money for him to get from usWe barely make ends meet as it isWe installed the best system money can buy for himWhy he is trying to hurt us we do not have a clue

The complaint covers my entire contract which is a standardized contract to cover numerous scenarios ASEC will respond to each item as numbered in the complaint:Ihave taught the radon mitigatipon classes for the EPA for many yearsMy employees are the best trained mitigators in the State required to learn more than what is required for CertificationThe system installed in this home was extremely difficult and was completed professionallyI do not know what work is "not completed"The system was operating when we leftThe "space" was a 1000+ square foot crawl spaceASEC does extra work and adds piping all the way around the crawl space for even draw and moisture reductionNo other mitigator in Colorado does thisThe work our employees do is exemplaryThe work was completed in one dayThe complaint does not list actual work not completedThere are no components missingSome customers elect not to install monometers if it is located in the crawl space and not easily visibleNo where in our contract does it say we will do electricalWe are not certified electricians and cannot draw permitsASEC offered to come back and do whatever the customer thought necessary and was told to never come on his property againASEC offered to hire a Certified electrician to inspect the wiring or replace it per customer request (fan operation only) and was refusedThe customer only wants $and an electrician only charges $How is this justified? The customer requested insurance after we were notified of his complaintIf a customer asks for a Certificate of Insurance before work is startedit must come from the insurance providerAsking for it after threatening a lawsuit is the wrong time to ask for this. After the system is operating, a test must be done to verify the radon is goneHis refusal to do so only shows he does not want to prove how good of a job we actually did by getting a final result. I would like to see this inspection report, the permit, and the reasons for failureThis customer has fabricated many of his responses and I believe this is anotherElectrical permits are requiredOnly a Certified electrician or the home owner can draw a permitHe was told to do so and elected not toThe contract explicitly states he should get an electrical permitThe City of *** does not inspect radon systems nor do they have anyone trained to do so. The emergency shut off is an external switch cover with a fork inside that flips the actual internal switchOur employee had the cover off several times testing the electrical because there was not enough voltage to run a Watt fanHe connected the fan to a light in the crawl space and it finally workedThe home has a fuse box, not upgrades breaker boxThe home owner has lived in this house for ten years and never fixed itHe has overloaded every circuit in the houseHe is trying to extort from us enough money to fix his electrical problemsThere is nothing wrong with the switchThe cover plate needs to be reset. The system is in a tight crawl spaceWho is going down there to read a label? A back draft test is a cold smoke test done to see if the convectional pull of vent pipes is compromised by the radon systemThe test was done and passedWe are probably only one of five total mitigators in Colorado who do this. The monometer must be placed in the crawl space on the vertical pipe going outsideBecause he would have to crawl through the crawl space to read it, he elected to not install oneNow he blames us for it. We have offered to reset the switch, install his monometer (would have done so the day of install), and hire a Certified electrician to rewire the fan to whatever circuit he desires (without fixing other electrical issues in his house) and he refusedAll he wants is money and over nine times what it would have cost him to hire an electrician in the first placeWe are a ma & pa operationThere are no huge profits for mitigators like us who use quality materials and follow the standards set by the EPAIt may seem like $is a lot of money, but labor and materials for a job like this usually will only net 10%The settlement request will damage our companyWe particularly did not like the "use a reputable contractor" slam when ASEC ranks in the top five mitigators in the StateWe have years of experience and replace systems other mitigators have installed improperly every monthIn fact we replaced one last week, one this week, and have scheduled another next weekIf he had hired one of these people, he would really have something to scream about. Please add this to the response that was only partially entered due to size constraints

I am rejecting this response because: I will not allow myself to be drawn into the delusion of lies and deceit that Mr. [redacted] continues to spew. I have been accused of lying, extortion, fraud, sabotage, slander, conspiracy and anything else he can think of to avoid addressing the truth. I find it hard to believe that a grown man and business owner would resort to this kind of behavior as a first course of action rather than offering to even lay eyes on the work in question and formulate a reasonable solution.Mr. [redacted] spends an embarrassing amount of time fabricating alleged conversations wherein he claims the authority to be negligent; knowing full-well that neither party can prove nor disprove the content. However, in doing so, he doesn't seem to remember from one lie to the next and is regularly contradicting his prior statements.The facts of this case are simple: I have a contract signed by both parties that states clearly the work required for the completion of the project. Half of this work is done, and done well, and for that I owe Mr. [redacted] my thanks. The other half is either incomplete or falls below the threshold required by City of [redacted] Code Enforcement. The physical evidence of this is under my house.As I said before, I am more than willing to negotiate a reasonable settlement which will allow me to hire reputable contractors to finish the work. Since half of the work remains outstanding I believe that $975 (half of the original $1,950) is a reasonable place to begin. I will openly consider any reasonable counter-offer from Mr. [redacted].I sincerely hope that we can leave the childish fibbing in the past and move on with this process like reasonable adults.
