The complainant was on Medicaid with a drug plan only The agent reviewed his options and made a recommendation of a Dual health care plan that coordinated with Medicaid The new plan unfortunately did not cover a medication When the agent found out by the complainant that the drug was not covered under the Dual plan, she immediately put him back on his original drug plan and dis-enrolled him from the advantage plan This error was reviewed with the agent so that this does not happen again We pride ourselves on the way we conduct business Our goal is always to do what is right for the client! We sincerely apologize for the confusion and hope this explanation helps We are sensitive to the unique regulations in various states Utah’s Department of Commerce exempts those with a range of professional licenses from the Do-no-call list It does the same for Customer Service Representatives (CSR’s) who receive appropriate supervision from those licensees Our representatives are instructed to place anyone who asks on our internal Do-not-call list We have found explaining the regulations over the phone to cause more arguments and confusion that we’d have thought The representative you spoke with was incorrect both in their answer to your question and in following our policies We held a re-training meeting this morning with our CSR’s and will do the same with our licensed contractors this Friday We would be happy to know the name of the individual you spoke to so we may at least address the correction one on one with them Outside of Utah and Idaho we are not connected to the violations you propose of other offices American Senior Benefits operates only very loosely like a franchise Offices or regions are privately owned and can differ greatly in business practices The region to which you have addressed your concerns currently operates offices only out of Utah and Idaho Although we enjoy a particularly high rating with the Revdex.com and have found them to be remarkably fair even to non-paying businesses, we have not gotten around to paying them in order to register with them to use the Revdex.com name and rating in any of our advertising or representation Again, we apologize for the call’s inconvenience to you You have been placed our Do-not-call list Please note that we do our best to control an internal Do-not-call list, but we do work with independent contracted professionals Mistakes can happen We don’t mind being notified of mistakes or corrections You can send us notice if this ever happens again at ***@LegacyIFS.com Finally, note that we do not take your concerns lightly We will continue to improve the consistency, accuracy, and completeness or our systems Thank you for your help

I am withholding acceptance of this response for the time being because:  I want to see the text and authorship of the waivers given by the State of Utah to the FCC regulations, and the text in the FCC regulations that permits States to subvert their original intent.

Response:
[redacted] purchased said vehicle from Rpm with a power train only warranty on the vehicle. Rpm had the vehicle serviced by our shop prior to selling it to [redacted]. Unfortunately, he had some issues after he purchased the vehicle. We are standing behind the vehicle and repairing it...

as we said we would. It is unfortunate that the parts that were ordered were defective but, we are continuing to repair the vehicle as we said we would. We will also provide [redacted] with a full tank of gas as he is requesting. Rpm pays our mechanics for their work and certainly do not take pleasure when a vehicle is not fixed properly due to defective parts or what not. All of the work performed by our mechanics is not covered by [redacted]'s warranty with the car but, we are fixing his concerns in an effort to keep him a happy customer.
