We placed a purchase order with American Special Metals for some Nickel bar for an export job for a shutdown in a plant in South AmericaWe are primarily an Export Company with years experience in the export market After placing an order, we were informed that they needed an End Use Letter for the export data which is standard procedure for us, although they did not request it at the time of the orderWe supplied the required data and then were told that they would have to apply for an export license for the material and that there were announced sanctions against the country (Venezuela)Both statements were untrueWe contacted the C0ommerce Department and the FBI as well as checking all of the government Export lists at Export.gov as required by lawEverything was clear and there was no need for an export licenseThis company does not have anyone who knows anything about Export Compliance requirements or if they do, refused to allow us to speak to them to clarify the requirementThey do not have an Export Compliance Manual nor an understanding of documentation required for exportWe doAs a result of their refusal to get us in contact with their export compliance manager and even though Our Company would be the Exporter of Record and responsible for the AES filing (our liability not theirs) we could not get them to release the material for shipmentWe had our order cancelled by our customer because we could not comply with the delivery needs so we cancelled the order with American Special Metals The problem was not that they required export documentation, it was that they did not know what they were doing and would not get a manger involved to discuss the problems and help get them resolved in a timely mannerThey would not let our management talk to anyone in their management or even give us their names, It was a very unprofessional handling of the situation

After placing an order, we were informed that they needed an End Use Letter for the export data which is standard procedure for us, although they did not request it at the time of the order. We supplied the required data and then were told that they would have to apply for an export license for the material and that there were announced sanctions against the country (Venezuela). Both statements were untrue. We contacted the C0ommerce Department and the FBI as well as checking all of the government Export lists at Export.gov as required by law.
