It is the policy of this credit union to comply with the .Fair Debt Practice Collections Act (FDPCA) regarding all communication  efforts received by this member. All calls were made between 8 a.m. to 9 p.m. as stipulated in the FDPCA and letters were system generated in accordance with our Collection policy. Since this member did not respond to telephone messages, she was called on a daily basis as allowed by the FDPCA. Based on our research this collector did not violate any parts of or attempt to collect outside of the parameters  established  by the FDPCA.
We have thoroughly reviewed this member's account history confirming that the first $500.00 loan was paid off with only one (32) day late occurrence. The second loan has been consistently late as the result of limited .income and the remaining balance is
$309.77.
Although we have obtained a "Judgtnent by Admission" we are willing to work with the complainant to get this debt paid off in a manner that relates to the ability to pay

Review: I originally took out two loans with Americian Spirit credit union in the amount of $500 each in 2013. The one loan for $500 was paid in full, howeever this one for $500 is outstanding. In which $50.00 was held in a savings account until the loan was complete. Which gave me a total of $450.00 given to me. .Originally when this loan was taken. I was working and had sufficient income. Two loans were placed and one loan has been paid in full. However this loan is still outstanding in the amount of $309.77. My income has changed tremously and I contacted Mr. [redacted] (the supervisor) and informed him of that. I was in no means able to continue to make payments of $60.00 a month. I informed him that constantly. I still tried to maintain them even though the income was not sufficient by borrowing the money. Yes, they were sometimes late and I informed him of that each month that they would be late and I would try to borrow the money to make the payment. Any agreement that I called to his office was kept. My unemployment benefits ceased in December 2013 and I was terminated from my job. He was aware of this. I have even spoke to Legal Service and in the process of filing bankruptcy on all my bills.

Mr. [redacted] since then has been calling me harrassing me, threatening me that I better make payments on my account or he will schedule me for New Castle Court or attach my wages. He has called me as early as 8:30 a.m. during the week and even on Satursdays at that time also. He has left nasty messages. He has wrote me threatening letters and yelling on the phone when he calls. I do not like his tone when the calls are made. Mr. [redacted] is a very nasty, irrogagant person and does not know how to treat customers, whether they are in delinquent or not. He has not tried to work with me on this occassion and the threats has to stop. I am trying to do the best I can. I am going through a financial hardship right now and he knew that.

Looking back at my payment history with his office I still made attempts to try to pay this bill. If I don't have it there is nothing I can do. I am not employed and the only means of income is my pension benefits which take it all for rent. I also have to go to social service and other agencies to complete payment of my other bills.

I understand this is a bill that is owed and I wish that Mr. [redacted] was able to work out some agreement with me at a lower monthly payment, but he refuse to hear anything that needs to be said or done. This type of action by Mr. [redacted] is unrightfully wrong. And he needs to find other employment because he does not know how to treat his customers. He is very nasty and a evil person overall. I have spoke to other people in his office and they always refer me to him because he is the supervisor. The other members in the office was not like that, it was just him. Having authority does not give you the right to be so mean. I am very unhappy that it has to come to this but he has to be stopped.Desired Settlement: I understand the monies are owed. I wish his office could work out an lower monthly amount that I could come up with. Since I am not working and $60.00 I can not afford right now. His collection tactics are unbearable sending a letter is sificiant, but not the harrassing calls also. Now [redacted] has filed the account with the New Castle [redacted], located in Wilmington, Delaware.

Review: On 12/17/13, I made a purchase in the amount of $7.40 with my American Spirit debit card by mistake. Around 1 a.m. on 12/18/13, I withdrew $30 from another bank account and studied it into my American Spirit account. However, I was swill charged a $5 overdraft fee. On 12/21/13, I spoke with Ken Cahoon; vice president of Branch Operations; about what occurred and he advised me that the fee could not be refunded because it wasn't an error on American Spirit's behalf. The fee was still charged because there was a 48 hr hold on the money I deposited via the atm instead of a teller. I explained to Ken that I was not aware of a hold and the branch was not open by the time I got off of work. He did not show any empathy and came off a bit sarcastic. He even laughed at one point. I felt insulted after our conversation because I felt keen was not taking me seriously. He kept saying that he must go by policy. All I asked for was a courtesy because I don't know there was a 48 hour hold if deposit was done by atm. I still am lost how I was charged when I review my account. I have provided a snapshot of account.Desired Settlement: I would like to be refunded the $5 overdraft fee because I was trying to avoid being charged in the first place. If I would have known all of the proper steps to take, then I wouldn't be in the situation that I am in now. Going forward, I know what to do in case something like this happens again. I feel that I deserve an apology as well for being treated as if Ken did not care. That's not a way to treat consumers.
