I am rejecting this response because: The amount offered is not enough to address the issue as I have communicated with McGrath The issue was identified and reported on the day of delivery 10/ I did purchase the vehicle As Is only after questioning this condition having not had an independent inspection and being assured that any issue identified in the next day or so would be addressed I reported the issue minutes after taking the keys and providing paymentRegards the "tire swapping" mentioned, the vehicle with 39K miles had the original tires on it that clearly needed replacement I was offered the vehicle for $24,without new tires, or $25,with new tires So I paid $1,for the tires This was no concession from McGrath and the tires were unsafeMcGrath was willing to take car of satellite radio issue, until they learned, from the diagnosis at ** dealer, (my expense of $115), that the part would cost them around $1,at wholesale As a consumer the best list price I have found with much research is $ The part in question is a Satellite Radio Control Unit module ** part number #*** It is not the whole radio I do not agree with trying to distinguish between safety features and other features I bought the car, and McGrath sold the car with the expectation that the satellite radio feature worked It does not The ** dealer shared with me that it is standard procedure for them and any dealer to check every aspect of a used vehicle they are taking in, regardless of brand, and that they would have in that inspection tested to see that the satellite radio was functioning - tuning in the preview channel McGrath's inspection apparently missed this That is understandable but not my fault.I must question the expression of good will and good faithI do know McGrath did look into a used part, which if they found one, put it in and it worked, I'd be fine with But that only occurred with my persistence and putting it in was never even offered I made some phone calls to various people at McGrath seeking resolution leaving a message each time I was only able to talk to someone when I managed to catch *** Diampietro -the Customer Relations Manager - at her desk by having the receptionist ***sfer me to her Only on occasions, both by *** after we connected, did any of my messages result in a returned phone call I have found a ** dealer - MIke Raisor ** in Lafayette, IN that will replace the part for $- $for the part, the rest labor and taxI request a settlement of $1,and will eat the $and all the time and effort I have invested

I am rejecting this response because: clearly *** did not go over thoroughly my paperwork with his employee *** who has been handling this issue since November......I was told three times that my vehicle was fixed through his service department I bought it back this last time and *** tells me I have internal engine failure so it took me to bring the car back times for them to figure that out, now the cars check engine light wasn't blinking until they attempted to fix it the last time, they are the experts so why would it take you professionals three times to figure that out, second I was told by *** that we were waiting for oil change companies to send faxes to go along with my Paperwork to get an authorizationFor the car to be fixedNot one time did he mention that I would be charged for an engine break down, he specifically said I had internal engine failure and that he told the warranty company this and they asked for maintenance paperwork again not one time did he say I needed an engine breakdown that cost 1500, I called the warranty company and they said all they were waiting on was paperwork on the car, so I'm not sure why *** would tell me that after I put a dispute with the Revdex.com and I wouldn't be told that while they had my cat for over a week and a half while discovering engine failure, this is not a NEW CASE, I have been dealing with the same issue that lexus claim to have fixed at the end of November so as a consumer I should just take a bill based on this professional company dropping the ball three times.....how don't I know me driving the car after they said it was fixed didn't cause the problemI have had this car for over years and *** did major work which is also in my paperwork and not once was anything mentioned about the engine....Lexus just told me it was misfires and the sensors needed to be reset and that's what they claimed to be the problem from *** mouth....I don't have to waist because the professionals can't figure it outMaybe someone else needs to contact me because *** seemed bothered that I filed a complaint

To Whom It May Concern,*** *** has sent in a Revdex.com complaint about the following items:1) Oil change not being serviced with premium oil.2) Air filters not running at peak performance3) Tires being worn out right after purchase4) Lexus replaced car battery failing after
miles (2years) when original battery lasted over miles5) Lexus replaced front brakes also losing 60% of its wear after miles after being promised by dealer that brakes would last over miles minimum6) Rude, unprofessional, aloof, dishonest, inconsiderate staff at the dealer. This dealer cheats and scams it's clients into buying terrible parts but attempts to brie clients with frivolous complimentary coffee and car washesIn regards to the comments made:1) The only oil we carry is premium oil2) The only parts we carry are factory replacement parts3) When the vehicle is sold the pre-owned department replaced the tires at no charge to the guest4) Batteries are considered a wear item and can fail5) Unfortunately there is no guarantees for life on any wearable item such as brakes as they are susceptible to outside elements6) Our staff is an award winning staff that treats all guests with truth and honesty and I am sorry that this guest feels that way as we try to go above and beyond for every one of our guestsWe will not be issuing any reimbursement for services rendered at this time. Thank you for your responseIn regards to obtaining an authorization we need maintenance records which have not fully been provided to us by the customer. When there is a situation like this where the engine has to come apart the warranty company wants to see maintenance records which the guest *** *** has not provided to us. *** took it upon himself in trying to obtain these records from the places the guest told *** she had her vehicle serviced at. If we could have the guest provide us the remainder of information we can provide that information to the warranty company. Without getting these records the warranty company will more than likely decline to authorize repairs. If we were to obtain these records and an authorization to tear down the engine from the customer we would be able to get the warranty company to send an inspector and possibly obtain an authorization to repair vehicle. Other than that there is nothing further for us to do. *** is also more than welcome to call me directly to try and work out a solutionWe are in business to help our guests in any way we can but in some situations like this we need the guest to assist in getting us information. If *** is willing to obtain the remainder of maintenance records we need and authorize the time it will take to tear down the engine we can do the rest. I spoke with the customer yesterday, Dec. 28th and explained the way her warranty works in the repair that is needed with her vehicle.  The vehicle has n internal engine issue.In order for us to fully diagnose the problem the customer has to authorize tear down.  I explained that...

the costs associated with diagnosing something like this would be15 hrs labor at a rate of $148.62 per hr.  If the repair is covered by her extended warranty she would only be responsible for her deductible.  If the repair is not covered she wouldbe responsible for the tear down and we would let her know what it would take to fix from there.  She asked for my first and last name and said "goodbye".  If you have any otherquestions please let me know.Sincerely,[redacted]Service ManagerMcGrath Lexus of Westmont

The vehicle was inspected and was in excellent condition.  We check all major functions of a vehicle and make sure all safety items are working properly.  Satellite radio is neither of these, so it would not have been checked an a used, non certified, vehicle inspection.  We sold the...

vehicle as is, but we always do our best to make sure all concerns are addressed.  We addressed all of the customers concerns at the time of purchase.  Including some tire swapping.  Satellite radio was never brought up until after the sale, and negotiation.   We have since explored different scenerios in order to help the customer.  Because this is a non Lexus product, it is best to have a [redacted] dealer, or ** authorized repair shop look at the vehicle.  The radio works fine, but the satellite feature seems not to.  We were told several different prices on a new radio, but we were told it just needs some kind of receiver installed behind the radio to make it work.  We offered the customer $500 in order to find someone that knows how to repair the receiver or potentially replace it. We also offered to find a used radio, but none have been available at this point.  I believe someone in the ** repair community can remedy his concern for the $500 we offered.  We offered this settlement out of good faith and not as an obligation on an "as-is" used car purchase.
