Review: In October/November 2012, I contracted with [redacted] and [redacted] to trim trees and plant 6 white pine trees on my property. [redacted] arranged the purchase of six 6' white pine trees though his nursery contact. I gave the nursery my credit card number and was charged $604.55, but did not receive a receipt, it was all done on the phone. I also paid $795 for the planting of the trees. The trees had a one-year warranty. By June/July of 2013 three of the six trees were dying. Knowing I had until November to replace them within the warranty period, in August 2013 I left several messages for [redacted] and he finally returned my call in October 2013 stating that the trees had to be totally dead for the nursery to issue a refund on the warranty. By this time the trees were obviously not going to survive. I asked [redacted] to take action because the one-year warranty was close to expiring. He promised he would take care of it. After several weeks on non response, I sent a picture of the now dead trees. Months went by with no resolution from [redacted].In April of 2014 I contacted both [redacted] and [redacted] again, to no avail. By this time I had three dead/brown pine trees on my property. Between May 2-May 15 I sent numerous text messages to [redacted] and [redacted] and finally, [redacted] responded. He showed up one day and cut down the three dead trees and took them to the nursery to discuss the situation and hopefully get the trees replaced despite the warranty. [redacted] called me a few days later and told me the nursery would not honor the warranty because it was expired, but that he wanted solve the problem because he knew he was at fault and "wanted to make it right." He asked if I would accept three 5' pines instead of 6' pines since he was going to have to pay for the trees out of pocket. I agreed and he said he would plant them the following weekend. That was May 20 of this year. It is now August and I have been trying to resolve this for a year. I have three tree stumps on my property and no replacements.Desired Settlement: I paid a total of $1,399.55 for both the trees and the service to plant them. I now will have to pay for stump removal, new trees, and planting.If [redacted] wants to replace the trees as he committed to doing, including getting new trees, removing the stumps and planting the new trees, I will accept that as resolution. If not, I require $900 in reimbursement to remove the stumps, buy new trees, and plant them. I want this resolved ASAP as my house is on the market and the stumps are an eyesore.
