American Way Paving

Review: America’s Way Paving, LLC gave us an estimate on installing a new driveway of $2,100. A few days later I get a call saying that they completed the job and that I should come over any pay them. I never told them to do the job, I was still in the processes of getting estimates. I was out of town so I sent my mother to go see that if indeed he did do the job and also to pay him. He then told my elderly mother that it will be any extra $350 if we wanted a steelier on the driveway. He said we did to put that so the driveway would last 4 years. My mother said he did do the job but she doesn’t know anything about construction and America’s Way Paving wanted to get paid immediately so I told my mother to give him a check because I wanted to act in good faith. We I returned to [redacted] I noticed the following :

• America’s Way Paving never obtain a permit to install a new driveway.

• They paved our garage door shut – so there is about 1-2 inches of blacktop covering / against the garage door so we cannot open the garage door.

• The new driveway America’s Way Paving installed was not leveled with the floor of out garage (there is a gap between the driveway they installed and the floor of the garage – so even if we remove the garage door we still can’t park our car in the garage anymore because there is a 1 – 2 inch fall to drive in the garage).

America’s Way Paving, LLC is not responsive. We have been calling them for 3 – 4 weeks and the calls get forwarded to an answering service. America’s Way Paving, LLC returned our call once when they thought we were calling to have them do another job for us. Once we explained the problems we were having with the driveway the installed / paved they told us they will see us on Monday at the house but they never showed up or called. Since then we called them numerous times and they have not returned our call. We are very upset and worry; we do not know what to do. We can’t get into our garage and if we break the garage doorDesired Settlement: We are requesting that America's Way Paving either replace the driveway or give us a refund. We paid for a new driveway not a patch job so we feel it is fair that we get what we paid for. A new driveway. We are also requesting that they give us a refund for the $300 demanded once they almost completed the job. They knew we were on a tight budget and were bidding out the job and they did not inform us upfront that if we wanted the steelier so the driveway we last 4 years it would be extra.

Also please note, I never hired them, I was still in the process of obtaining estimates and they just show up on my rental property when I was out of town and did the job. I acted in good faith when he called to inform me that they did the job and hope that they act in good faith too and give me a driveway that is useable and able to drive into the garage without any 1-2 inch failing gap.
