first I would like to say , at the end of every email I told Mr. [redacted] we could come up with some kind of exit strategy where neither one of us would be financially hurt since he had some kind of buyers remorse, he didn't go for it , I have...

That being said Mr. [redacted] entered into a contract worth approx. XXXXX.00 , I get half down .
But he said he didn't have the 6000 and asked me if 5000 would be enough to get started
I said ok . he could make it up on the 25% half completed payment and then there would be 25 % due upon delivery. It seems unlikely he is going to pay me another payment , at that time he will be in breech of contract . if you order anything from any company and then decide you don't want the special order you lose your deposit and rightfully so because said company has spent time and money on the order , then they sell what ever it is at a discount to recoup some of their money . if I order windows at Lowes and then don't pay for the other half I don't get the windows and I get a bad name with that company because I broke contract.
Now he looked at our web site for quite a few months and it says on the front page that we make our own trailers and what we make them out of . he saw our trailers there is no wood covering nothing up he saw everything , and I went over the fact that we build our own and that I have two certified welders on staff both of my sons . His exact words wrer I like what I see , and to start building because he wanted to be in it by winter. He wanted to see how the trailer was coming and wanted a picture for a blog he was writing ,so I sent him a pic of the unfinished trailer ,at that time it seemed his main concern was that I was made out of channel instead of tube and the placement of the cross members wrong I guarantee the trailer for 10 years I don't believe anyone in the business has that guarantee I cant guarantee tube for 10 years because it rust from the inside out. So I explained all of this to no avail he just kept asking for his deposit with no regard to the fact we would be financially hurt because of his willy nilly buying habits.., the placement of the cross members are in the same place most heavy duty equipment trailers are , Mr. [redacted] has no knowledge of building anything by his own admission and he's trying to tell me how to build these things, the frame is composed of 5 and 3 in channel as stated on the first page of our website and told him at least 2 times when he was here looking straight at it.
Mr [redacted] is the one who has broken not only the contract with me but has also broken communication first over the phone but then email . he started threatening me immediately over the phone and wouldn't listen to what I had to say , its true he wanted to know how much I had into just the trailer . but never offered to pay just for the trailer .
I didn't know how much I had into the trailer because it is a part of the whole contract and did not have that available at that time he was frantically talking the , I do have that info now and told him so in a email, he is doing everything he can do to demonize me and I have done nothing but build him what we agreed upon..
When he started to take issue he lied to me saying that he didn't want me to start building yet and that he thought I was going to buy the trailer some other place, two things he knew were lies he is a contract breaker and a liar . I have some tex messages and emails that prove this .
I went out and bought thousands of dollars of materials and paid labor at his direction HE SAID I LIKE WHAT I SEE AND TO BUILD IT!
This guy in California who does not build anything has other people build his trailers and then says they are factory direct who has only been in the tiny house since 2014 brain washed Mr. [redacted] and suggesting that Mr. [redacted] should buy his trailers I have emails on that too. Mr [redacted] is a week mined person who does not know anything about construction
His word is worth nothing
He right away started saying he was going to take me to court and was going to take to news people about me on our first conversation. He was so frantic in his conversation I could not get any where with him . he just contines to say I want my deposit back and has no consideration about the fact he ordered it and then after considerable amount of time and money has gone in to it oh just give me my deposit back.
With all this being said I do not like bad blood with anyone and I do not have any with anyone all my customers are happy with me because I bend over backwards to please them , customer service is everything to me , I have never been sued or any Revdex.com activity
I would like to talk to your arbitrator about maybe an exit strategy that would be fair to both parties I have no ill will toward Mr. [redacted] . however I hope Mr. [redacted] does not mistake my kindness for weakness . if he continues to waste my time with this I will counter sue for everything the law allows under breach of contract to recoup my time and money spent around his nebulous, foolish and vague accusations an lies
Oh and the only reason he has gone through the Revdex.com is because he has been using intimidation tactics since the first phone call this is one of them , its hard to intimidate someone who is upright in all his business practices and plus who has the law on his side
Its sad now when someone like him can make a few phone calls and attempt to give a business a bad name that is so well established and liked , Mr. [redacted] cares only about himself .
I have only done what we agreed upon if Mr. [redacted] does not like this I don't know what to say.
I read the complaint again to make sure I addressed everything , all I can say we have built many trailers of many kinds and sold them and none of them are rickety , we are proud of them and we have an excellent name in many circles of metal fabrication , his opinions are unfounded ,and not that of an expert by any means , the basic design on these trailers come from equipment trailers meant to haul much more weight than these houses
