payments and make sure they are paid on time. With that being said we did not make the agreement with Mr. [redacted] we are just hired to collect his payment and if late charge the fee that he agreed to in his contract. I have attached a copy of the agreement for deed and promissory note for Mr. [redacted] which clearly states that his payment is due on the 15th of the month and if it is not received by the 10th calendar day (the 24th) then he will be charged a late fee of 75 dollars. Please look at page 5 & 6 of the attached contract. This contract does not say when the payment was mailed it states that when we receive the payment. Mr. [redacted]'s payment is due on the 15th and we give the 10 day grace period so payments can be mailed and not counted late if mailed on the 15th. As Mr. [redacted] stated in his complaint he mailed his payment from GA on the 22nd which was a Friday. We did not receive this payment until the 26th. If this payment was mailed on the 15th it would have been received before the 10th calendar day and he would not have been charged a late fee.
