Amerikohl Mining, Inc

Review: In August 2009 Amerikohl Mining, Inc was mining coal on the adjoining property to mine. I left out of town on August 17th and returned on August 20th and upon returning to my home Amerikohl had made a road on my property without my consent. In making this road they had removed a pile of siding, a pile of stored lumber, damaged a chain link fence, a tractor garden harrow and pushed over my childs dog graves and removed 5 oak trees from my property. The surveyor, [redacted], came to me and apologized to me and said he would do anything to make this right. A few days later [redacted] came to me and said they would be letting the water out of a pond on the adjoining property and the stream that runs past my garage would not be able to hold the water that would be running down and they needed to clean it out and I would be compensated for it. Amerikol came and cleaned out the stream then told me the water that was going to be let out would not be contained in the drains that I had under my parking lot so they wanted to dig a 78 foot ditch and place a pipe to contain the runoff and cap off my existing drains. He told me at this time I would be compensated for this as well. They did not cap off my drains and only brought down a 20 foot pipe and left the rest of the ditch open. Upon releasing the water from the pond the drain clogged and backed water into the basement of my garage leaving 4 foot of water and 6 inches of mud on the garage floor ruining everything that was there. At this point I contacted [redacted] once again and he came and looked at the damage and he said " We already apologized for the damage and that is all you are going to get." I contacted DEP per [redacted]'s words and the DEP states it was illegal to let the water out into the stream to begin with. Amerikohl was fined by the DEP and shut down for a few days at this point.Desired Settlement: I want to be compensated for property damages. For the trees that were removed without my consent, for the garden harrow, chain link fence, siding, lumber, damage to the garage walls and floor, the drains under the garage, limestone that was removed from digging the ditch thru my parking lot and the contents in the garage.
