AmeriNat has further reviewed the terms of the Loan Modification and determined that the late fees should have been waived per the terms of the modificationAmeriNat has sent the borrower the attached letter and enclosed a check for the late fees that were paid at the time the loan paid off

AmeriNat paid the amount of property taxes billed by the countyWhen the borrower called on 12/20/regarding the Annual Escrow Analysis Disclosure statement he received He stated the taxes paid were too high as the county had not issued a Homestead credit on his primary residence but did on his investment property in error We was directed to contact the county to have this correctedAs a result of the county error, the county issued a refund for several unrelated properties to our tax service provider and it was received by them on 1/11/ Before funds could be released by the tax service provider, a reconciliation was neededThis resulted in an out of balance and the tax service provider is still working with the county for resolution As a standard, accounts are not adjusted until the refund is receivedHowever, on 1/26/after speaking with the borrower, borrower's monthly payment was recalculated based on the lower amount of taxes that are projected to be paid in This was communicated to the borrower on 1/26/during a phone call and via emailOn 1/26/17, our phone system was down for a few hours due to a problem with the service provider's phone lines in the area This was communicated to the borrower on the phone call we had on 1/26/

Upon reviewing AmeriNational's response I only agree with the waiver of late feesI do not agree with them on the reporting to credit bureausFor one, no-one has contacted in a timely fashion to inform me my mortgage was past due or "short paid"It's been over a year they've been handling my account and I was first contacted by them on 5/27/Upon receiving my first call on 5/27/15, I immediately attempted to rectify the issue, however, AmeriNational did not have and accurate account of received payments, nor an accurate account of the amount due at the time I was contacted on 5/27/(my conversation with Hector)My emails have gone ignored other than the fact they updated my address and started sending me harassing letters, threatening to further report late payments to credits bureaus, although my file was under review for their mishandling of my account since the first day they took over my mortgage in June AmeriNational made no attempt to research the May missing payment that was remitted to Neighborhood Housing Services (NHS) as they were still managing my mortgage in May I had to provide AmeriNational a copy of the cleared check, which again was reported as a late payment to credit bureausIn September 2014, AmeriNational mailed an impound/maintenance refund check to me, at that time shouldn't they have seen my account was not current and contact me then to rectify the issue? Furthermore, checks are issued by my banking institution as I utilized online bill pay, these checks clearly show my current mailing address, further demonstrating AmeriNational had my address on file since they began managing my mortgageA copy of the cleared check is attached
AmeriNational made no attempts to respond to my emails dated 5/27, 6/and 6/30, I made every attempt to rectify this discrepancy with no cooperation from AmeriNationalAttached are copies of the emailsThe only communication I've received thus far is debt collection letters and phone callsNo-one seemed to care about the urgency to research and correct my accountAttached is payment history, clearly demonstrating I have been a responsible homeowner paying my mortgage on time since AmeriNational began managing my mortgage
On 6/26/I received a letter from Cristian *** at which time a representative by the name of Connie assisted meI advised Connie I received a letter from Cristian stating they have days from the date on the letter to respond to my disputeI advised Connie they should technically be going by the date of 5/27/since that was the initial date I filed my dispute via email and a response is due on 6/29/Connie stated Cristian was gone for the day and she would have Cristian contact meConnie further stated she emailed Cristian to expedite the dispute and have it completed by 6/29/I contacted Cristian again on Monday, 6/29/(because I couldn't rely on Connie since she may be the same Connie *** that has ignored my emails), requesting a return callI also followed up with an email on 6/30/since Cristian did not return my call, emailed attachedI received Cristian's Error Resolution And Or Dispute Response Letter when I returned from vacation on 7/6/Again, I feel Cristian rushed to complete the review of the file to meet the day deadline and again, inaccurate information is reportedThe outdated contact information Cristian refers to is an error between AmeriNational and NHS, not meThe June payment was submitted and cleared my account on 5/28/(refer to attached payment history), which would have definitely made it to their office by 6/29/15, which is the date of the Error Resolution And Or Dispute Response LetterCristian finally returned my call on 7/6/15, only to inform me my mortgage has been recalculated to $501.55, when I was just told on three separate phone conversations by two representatives and one supervisor (Hector (5/27/15), Jamie (6/9/15) and Robert (6/22/15) my new mortgage payment, effective 2/1/is $During my phone conversation with Robert on 6/22/15, Robert stated my account was current with my next payment due in July in the amount of $I asked Cristian to provide me an itemized statement informing me how they arrived to this amount ($501.55) and provide me my current balance since I'm still being advised of a miscalculated monthly mortgage rate, while my credit rating is still being impacted by their incompetencyI advised Cristain I made my July payment in the amount of $and should be arriving any day now since I utilized Online Bill PayAgain, this payment is "short paid" because I was advised otherwise that the mortgage amount is $effective 2/1/I asked Cristian am I required to pay the difference from February through the July to bring my account current or does the $payment Jamie requested I make on 6/9/cover it? I contacted Cristian a few minutes after our phone conversation on 7/6/and requested a call back from his supervisor, Robert (today is 7/8/and I have yet to hear from Robert)On 7/7/I made a payment in the amount of $for a total of $for July, which I hope this reflects my account being current
Is it even legal that AmeriNational is impacting my credit rating when they have not:
-properly notified me of the mortgage discrepancy starting with the May payment;
-provided me the correct monthly mortgage amount to date;
-made no attempt to contact Habitat for Humanity or NHS to verify my mailing address;
-made no attempt to match payments/issued checks against the residential address and mailing address
Before the mishandling of my account I had excellent creditThis is so frustrating that AmeriNational has ruined my credit due to their negligence, even the letter dated 6/29/states they reported on 6/10/"account reported days or more past the due date", all the while this is under review and all I'm constantly told by AmeriNational representatives is they'll continue to report to credit bureaus as long as my account shows past due although I've explained to them the error of the May payment and lack of notificationAt this point I would like AmeriNational to prove they've contacted me prior to 5/27/I expect this proof to be by recorded messages representatives left on my voice mail requesting a return call because anyone can fabricate a call log and notes in the systemAgain, I am requesting my credit rating be restored due to AmeriNational's incompetency and negligence in handling my account accurately and on the basis of insufficient notification of missing mortgage payments during the transfer of my mortgage account from NHS to AmeriNational, beginning with May

shows what the borrower agreed to in terms of the amounts owed following the Trial Modification payment planAs described in the letter to the borrower, it is the borrowers responsibility to pay those outstanding amounts per the modification agreementShould the borrower have any additional questions, they may reach out to customer service which is available Monday - Friday from 8:am to 8:pm EST

With our previous response, we provided a line item detail via a payoff statement showing the amounts due. The language in the modification agreement (also provided in our previous response) clearly show there were advances to tax and insurance that were unpaid at the time of the modification. Outstanding balances as described in the modification were transferred to AmeriNat from the prior servicer. These amounts are not fraudulent. We have provided a copy of the signed modification as well as a payoff statement delineating the amounts that are due to complete the borrowers payoff. We have no further documentation to provide.

The borrower pays $65.64 more than the payment amount due by ACH each month. the borrower received a temporary coupon book in September of 2014 and a regular coupon book in January of 2015 that stated the payment amount due. The amount was also discussed when she made her payment by phone on 2/23/2015 to cover the ACH payment that did not go through. As detailed in the attached letter that was mailed to her, her loan type does not split the payment based on an amortization schedule but rather the number of days between payments. This is to the borrower's advantage as interest is only charged on the actual principal balance for the number of days outstanding rather than by schedule.
Consumer's Desired Resolution:
As the payments have been applied with extra funds going to principal as appropriate it is not applicable to reverse and reapply any payments. She was actually undercharged interest for the payment that replaced the one that was reversed because of uncollected funds. When the payment was reversed the "interest paid to date" was not adjusted for the reversal and she only paid for 4 days of interest rather than 35 days. We will leave that posting as it stands since it is to her benefit.

The first time that this company called, they called my husband, instead of me. He doesn't take care of the finances, so he assumed that the call was a telemarketer. AmeriNational was given my phone number, not his. They should have called me instead of him.
AmeriNational told me on the phone that they charged me so much interest in the first payment because I didn't pay until 49 days later. That is because they told me to pay so late! That is NOT my fault. I would have happily paid sooner, if given the option. They purposely waited the 49 days so that they could collect all that interest. AmeriNational NEVER gave me the option to pay sooner. In fact, I had no idea who to send payment to until way past a month+! Wanda [redacted] claimed that she would tell me in a letter whom to complain to about this oversight, but I do not see a name and phone number in the letter that she sent, as promised. Because of this, I want the full first payment of $350 applied to the principle then. Or, at least, $284.36 to the principle and $65.64 to the interest, as it should have been in the first place.

They are just passing the buck, blaming a previous company. I didn't receive any coupons to submit payment earlier. I will have to contact the previous company, since they won't. They didn't offer to help in anyway.

AmeriNat has further reviewed the terms of the Loan Modification and determined that the late fees should have been waived per the terms of the modification. AmeriNat has sent the borrower the attached letter and enclosed a check for the late fees that were paid at the time the loan paid off.
