Revdex.com:
I have
reviewed the response made by the business in reference to complaint ID [redacted], and have determined that
this does not resolve my complaint.  For your reference, details of the
offer I reviewed appear below.

This
was so unfortunate to read [redacted] LLC’s assortment of lies and
defamation.  My complaint was extremely brief and to the point in hopes of
lighting a fire underneath him to return our property.

Instead I read his lies and I have no countertop in hand.  I even called him leaving 2 messages (*phone record) about not receiving it and
had personally talked with his girlfriend/business partner (*phone record) about the
undelivered property by their son.  I told him in my message
that if he continued to choose to ignore me or withhold my property, writing a
complaint to the Revdex.com was my next step from here.  [redacted] Heim was alerted about us not having the property and was
also alerted about me posting a complaint here about the property not being delivered
back to me, yet posts these lies here 2 days later.

Unknowing the specifics as to why a business would begrudgingly
hold on to our property is beyond us, but reeks of immaturity and poor business
practice.  At the point I read his message rebuttal here and realize he
is refusing our property back, my husband and I proceed to send him an email
listing our records of our phone calls to him (the ones he claimed were
nonexistent *phone record) and a detailed explanation of what this will cost him in
pursuing small claims court.  We send this Saturday May
10th around 3:45pm.

Surprise! The butcherblock/countertop shows up in a fashionable
manner about 7 hours after our detail small claims court email, 10:30 at night
with some yellings directed at our house.   What more needs to be said…………

But, and this is now the unfortunate part.  After this unprofessional plight and
return of my property, upon inspection (pics attached) we see that the
countertop was overcut.  It was cut too short, and he glued the overcut piece back in
place.    It is a very noticeable botch job (see pic).  We are unknowing if this was part of the reluctance to return our
property but a noticeably glued-in piece which will be off center from the
front of the sink positioning, is unacceptable from a
professional.   A beautiful wood countertop was ruined with a botched job and
oversight.   I am really sorry this had to happen for the both of us.  Nobody intentionally cuts things wrong like this, and this by far
is not fun to have to ask. But the butcherblock needs to be replaced now,
and we are asking for the cost of the replacement and the money we paid to him
for working on this.

Here are some of the other details about this job:

We have asked the most basic of what any homeowner would ask of
any contractor.
1.    Show up to your scheduled
workdays with us.
2.    Get the project done in a timely fashion.
3.    Call us back in a timely manner!  In fact just call us back at all is what this request had to
contort to with him.

He had 2 months time (Dec/Jan up to his extenuating surgery
circumstances in Feb.) to accomplish at least a few parts to this multi-job
project here. Did he finish any of these parts? No.
Was it due to not being able to get a hold of us?  No, (attached phone records) we work from home, we
always call back within 12-24 hours to messages, and he had every opportunity
to get this job done if he wanted to, but his life was very busy, as we found
out from his excuses.

 December Appointments #:
1.  Rescheduled because your current job was taking longer than you
anticipated
2. 2nd canceled appointment and rescheduled to then show up and tell us
you couldn’t work, but then proceeded to ask for half of the money project
cause you had to pay his workers for the current job he was working on.
3. No show no call (btw, I stripped my bathroom twice and prepped
for these times he canceled/ he neglected to ever start this grout work)
4. Showing up 3 or more hours late to then tell us he couldn’t
work because of a time sensitive tax issue going on in your life, but he did
take the time to take measurements for cutting the countertop and took that
with him to cut at his shop at home.
5.  Coordinating with us over the flooring before our out of town
departure to work during those days we were gone.  We
called twice before we left for a family visit over [redacted]tmas, on the 17th and 18th (*phone record) desperately trying before we left to get
an agreement figured out as to the details (the conversation leading up to the phone calls was via text, which I
still have the saved texts as record) because it was to be completed while we
were gone, due to it being in a heavy traffic area. Neglectful return calls on his part but then find out [redacted] was sick at the time,
which was fine, we understood. But then lies here on the Revdex.com that he was the
one trying to contact us.

He installed bamberg jacks in the basement, but left this job
undone, leaving 2 posts uninstalled.  He leaves on the job
while we are not around, but never follows through with communication on why he
left the job undone or when he plans on coming back, nothing.  Who contracts work, completes ¾ of a particular job, to then blows
the customer off?

April re-contact:
April 9th
Emailed [redacted] asking him to update us on finishing up his projects.  NO RESPONSE (*email record)
April 11th
I call and personally connect on the phone with him, He mentions he
didn’t email us back because he has a doctors appointment he is still waiting
to go to a week out yet.  ([redacted],
this is where you email your customer alerting them you don’t have an answer
but will email on a future defined date, you don’t blatantly ignore).  I ask if it is possible to get the
butcherblock returned so I can start the varnishing on it.  He doesn’t give me clear answer and he
promises me that he’ll email us April 13th after his doctor’s
appointment (*phone record)
April 13th
No email from [redacted]
April 24th
We call after his neglect in communication yet again, I address his
recurring lack of communication, and ask if this is a job he needs to let go,
he agrees that yes it is.  He
promises that butcherblock will be returned by his son the next day (*phone record)
April 25th No butcherblock was ever delivered

It’s unfortunate when someone makes excuses (and believe me, we
understand they are 100% legitimate), but after putting us off with his poor
execution on these projects, inaccessibility, and personal life dishevelment, it leaves us glazing our eyes
over when we listened to yet another excuse of his.

Regards,
[redacted]
(**) Phone records attached

I began the score of work right before [redacted]tmas. They left to visit family after and were all deciding on what flooring they wanted in a back Hall. I called and left a message on dec 28th asking for them to contact me as soon as they returned so I could discuss the flooring project and be able to...

plan my schedule. two weeks went past and I hadn't heard back, so I called and left another message. In march  I had to have a hurnia and left yet another message stating that I would have to either get in and get the work completed prior to the surgery or wait until after I was healed.  They finally called back after I had the surgery and wanted me there that week.  When I told themiThey had givem I had weight restrictions and it would be at least six weeks, they demanded their money back and the counter top.  They gave me $300 down. The job was to jack up the basement, replace 9 posts in the basement, and reinforce a spring beam. Also to install a new country top in their upper bathroom which consisted of cutting, fleeing a portion of the cut out section on to the width and then sanding along with cutting out the sink hole. I prepared the bamboo counter top for install. And installed all but two Bamberg Jacks and jacked and reimbursed the load bearing basement beam. My son brought the counter top back to them for me and I sent them a revised final bill for the hours working on the counter top and for doing the work in the basement. The bill should have been $850. Isettled for the the hundred that was given as a down payment. Some people you just can't please and seem to want everything for nothing. Since 2001 when I opened my business, this is by far the most ridiculous. Generally I will do what I can to make things fair, in this case what more can I do? Make their house payment for them?

Second time I have used Ames and will time and time again! Professional service and unbeatable pricing. I cant thank you enough for your courteous and fast service. I can tell you are truly a man who cares about what he does and it shows in your work! Thank you! Sandy
