This is a follow up to let you know we spoke with the ownerand we have returned the $90 for the carpet cleaning/repair.Sorry for the misunderstanding.[redacted]
Review: Myself (tenant) terminated lease for official military orders under the Servicemembers Relief Act on 31 Aug 15 after just under 12 months of occupancy. AMI Property management deducted $90 from security deposit for Carpet Cleaning charges in addition to $140 for general cleaning costs. Mr. [redacted] replied that the apartment was left in a state of uncleanliness that didn't match move-in. Upon requesting more details, tenant provided a HD video to Mr. Steve [redacted] of AMI showing that the apartment had been cleaned prior to move-out, including the carpet and floors. Mr. [redacted] replied that the carpet cleaning charge was standard because tenant occupied the unit for under 18 months. According to Civil Code 1950.5(e), general wear and tear is acceptable for carpet and drapes. The video provided to Mr. [redacted] showed carpet was left in satisfactory condition with the exception of pre-existing stains noted on the move-in inspection sheet. Upon requesting deeper explanation, Mr. [redacted] told tenant in e-mail that he should "talk to someone about tenant relations" and "normal wear and tear only applies when replacing carpet" which is incorrect. Normal wear and tear applies to how landlord's deduct from security deposits for cleaning or repair. Nowhere in tenant's lease or any move-in or move-out correspondence does it state that a mandatory carpet cleaning charge will apply for less than 18 month occupancy. California Civil Code mandates that management companies/landlords must deduct reasonable expenses taking into consideration normal wear and tear. Nowhere in writing does it state that $90 would be charged for staying at [redacted] Street #* for less than 18 months.Desired Settlement: The full refund of carpet cleaning charges totaling $90.
