To Whom It May Concern: We are writing to you in reponse to the complaint that was filed in regards to [redacted] Amistad properties follows company policy with all applicantsWe specifically let each applicant know that each application will be reviewed, verified, and that the application fee is non refundable Applicant filed an application for which it was denied due to information not being accurateApplicant and Landlord's statements did not matchAlso, Tenant Tracker showed no residential history and showed outstanding collectionsIt was Amistad Properties decision to deny application Applicant, [redacted] , gave an oral statement describing the conditions she was living in and stated that she had been living at her mother-in-laws property for years and which she had only paid rent for about the first year she lived in it because property was paid offWhen verifing information with landlord (mother-in-law), landlord stated that applicant had been living in property for years and that they had been paying rent of $every month and were always in timeSo based on the information given to Amistad Properties application was denied If you have any further questions feel free to contact our office Thank you, Amistad Properties

To [redacted] , Unfortunately, we can not come to an agreement for which we apologizeIt would be unfair and unethical on our behalf to put priorites or preferences with any of our applicantsWe do apologize for the way you feelYou are more than welcome to come to our office to pick up a copy of the application you filled out In regards to the number of applicants who come in to our office, we have no controlAmistad Properties does have a first come first serve policy in effectThe applicant who first comes with an approved application, first month's rent, and deposti is the person who gets the apartment/houseAgain, we apologize for the inconvenience and any misunderstanding we may have caused you Sincerely, Amistad Properties

In response to the complaint filed by *** ***:
Amistad Properties has owned this property (*** ** ***) for over years and has had previous tenants who have never complained about mold issues with any parts of the propertyNo mold cleaning or repairs have
been made to this property
The Tenant was allowed to inspect the property and a mocondition form was provided to tenant, which they had business days to complete and return to LandlordOn that mocondition form they could note any problems detected during the move inTenant failed to turn in mocondition form, therefore accepting property in conditionSection of the lease elaborates in detail about the mocondition form
Tenant also claims they called the company to complainAmistad Properties Policy in reference to complaints and work orders are as follows: In section 26.A of the lease it states clearly that all requests for repairs must be in writing and delivered to Landlord at the Amistad Properties officeWe asked tenant to please come in and fill out a work order to which the tenant declined and demanded we take care of the situation immediatelyThe tenant became belligerent and threatening and accused us of not inspecting the property before tenant moved inWe tried repeatedly to calm tenant down and tenant became even more upset, finally tenant hanged up the phone and a few minutes later called again and started being belligerent again, at this point Landlord told tenant he would not talk to tenant any more and that tenant needed to calm down and come in the office and fill out proper work orderThe tenant threatened to call the housing authority and an attorney to file suitLandlord told tenant we would take care of whatever needed to be taken care of and tenant advised him Amistad Properties was not to go in the house without his permissionAt this point Landlord terminated conversation
Landlord then advised his business partner of the situation and asked him to call the tenant and see if he could take care of the situationHis business partner called tenant and had no luck in resolving the issueLandlord and his business partner felt tenant was being uncooperative and with all the screaming on behalf of tenant, they felt tenant might come in to the office with the same attitude and cause a scene and maybe threaten the employees so they felt the need to advise the police of situation in case this occurred and it escalated into something worseA police report was filed and can be provide if needed
The tenant called later one more time but was now calm and requested we let him out of the lease and refund his deposit to which Amistad Properties agreedTenant was informed that the deposit would be refunded back to them in accordance to Section and Section of the lease

My address is listed on the app I filed out and so is my phone number, I live over ONE hour awayI already had to come once and waste my gasWhat's the problem with sending it in the mail? I want a report of what was said between your company and my "landlord"Is everyone just to busy or don't have the money to buy a stamp? What happens to all that money you charge to fill out a few sheets of paper?

I am rejecting this response because:
The many lies in their responseOne they only terminated the phone calls when my husband stated he was now recording themTwo, upon move in inspection the bathroom in question was being worked on, having the shower head replaced I wasn't aware I needed to check the floors for mold damage, never have rented from anyone that would rent a place that is mold investedI have pictures of the mold in the pantry which from first glance you wouldn't see because of shelving placementI also have video of the mold in the bathroomThird, as to the police being involved; my husband and I were never contacted by themThis is the first we are even hearing about itFinally, filling out a request form with themWhen we called, *** came to my house to look at the mold himself that is when he offered to bleach it, and stated they wouldn't provide temporary housing while they bleached itAt that time I was sick, he could see that I was ill from itAfter that visit my husband became extremely upset and stated they could not return to the property unless he was home from workAt that time we started staying at hotels to improve my healthNever have I dealt with such unprofessional reality company, it really is a sad thing when a company is willing to lie to cover their own mistakes.

My issues with amistad properties have been resolved. Thank you for your outreach.

Amistad Properties apologizes for the inconvenience you may have encountered during this process.
As you can see you acknowledged that we were not to enter the property unless spouse was home. 
Unfortunately, we did not come to an agreement.  Based on our Residential Lease Agreement
Section 19.D we took proper action to take care of the problem.  Amistad Properties has already
allocated the deposit and has mailed it out as part of our normal procedure.

     Applicant, [redacted], gave an oral statement describing the conditions she was living in and stated that she had been living at her mother-in-laws property for 5 years and which she had only paid rent for about the first year she lived in it because property was paid off. When verifing information with landlord (mother-in-law), landlord stated that applicant had been living in property for 6 years and that they had been paying rent of $250 every month and were always in time. So based on the information given to Amistad Properties application was denied.

I am rejecting this response because:
For one, I never said or asked for a refund. All I ask for is to tell the truth, I would like a copy of the rental  app that I put in. What they say that I said is in fact not true, but now we can't prove what I said, right? My mother in law said that she called this company back and they told her that it had nothing to do with what she say. Why would there be a rental history? We have lived here most of the time since she bought the houses. Yes we have lived in other places, but have been here off and on for about 10 years or more. This company is not being truthful about what I told them. Just like the fact that when I called I was told that there were 3 people that had already put in rental apps for the same place. I then drove up there the next day and then was told that there were 4 people ahead of me. When I called I was told that an email app would be sent to me, but I never got it. That's why my family and I drove over two hours. I think it is crazy that these places can ask for people to pay money just to fill out an rental app and "fight" to have a place to live! Just tell the truth that's what I want!
