personal issues, this all may have avoided if she answered or responded to any of the many messages left over several days.
She had my cell & [redacted]’s cell printed on our business card as well.
We will be happy to return only $100, as we do not want to keep her money.
She needs to bring in her deposit recpt, and we will issue a check immediately.

Review: On 8/**/14, I went to Amity Bay Auto Sales and Sal showed me a car and I left a $100.00 deposit on a BMW X5 with 115,460 miles. I was obtaining dealer-financing through a third party. I told him upon the deposit I am on soc. sec. income only and could not afford a payment larger that $160.00 per month. I told him my credit was not great, due to my husband's death and the inability to catch up with joint bills, that he was paying. [redacted] said he understood and would do the best he could. He was on vacation for over a week so I did not have his cell, and could not call him. The following week, he returned and told me the payment was about $280 and I said, YOU DIDNT HEAR ME WHEN I SAID 160. NOT HIGHER.. I told him I could not do that type of payment. He said he would see if he could do better. I said there is no way I can go over the $160 I had said.

On Sept. **, 2014, I wrote him a letter, after seeing he left a few messages on my home phone. I spoke to him once, and he was so mad that he was yelling at me. He was YELLLING at me over the letter. I hung up. I am being treated for depression and anxiety and have had bad experiences with men abusing me. He was yellling, so I hung up, shaking from the call.

I said in the letter "According to the agreement I signed, it states "If Dealer assisted financing is in any way part of this contract, then it can be cancelled until the Truth in Lending disclosures has been given to the customer. It is 10/**/14, and I haven't gotten them, just to make a point. I told him since I did not accept the loan, he is required to return my deposit. In the contract, he didn't put a date in when the contract was to be finalized because he knew he had no clue as to when I would be approved. He cashed my check, and by that time, I was low on funds, living on social security, which the check caused me to incur a bank fee of $35.00 I asked him to send my $100 plus the $35 back within 7 days. Its actually 5 weeks, and he has no intention of returning my money. I want to resolve this, because he was showing the vehicle, as it was moved several times on his lot. Nevertheless, he knew from 8/**/14 when I signed the deposit contract that there would be no deal unless the payment was affordable, and I told him when he spoke to me, $280 is unaffordable, and he said he could refinince me within a year.. I told him I would end up losing the vehicles before the year, as there IS NOT MONEY AVAILABLE TO MAKE THAT TYPE OF PAYMENT. He was trying to get a second fee to providing a refinance down the line. The interest rate had to be over 30% on a loan of 11,080.89.Desired Settlement: I want my refund of $100 plus the cost of the bank charge $35, since he deposited the check after he knew I couldn't take the financing. Total $135.00
