15th 2015. LeafFilter North discussed all concerns *** had with her LeafFilter gutter protection system and the issues with her roof. LeafFilter North added a new downspout in the area of concern on the back gutter of the home where *** claims she has water drainage issues. LeafFilter North also repaired all locations of her roof where *** alleged LeafFilter North’s service technician, on a prior call put marks on her roof from his ladder standoff. LeafFilter North received a signed completed service ticket from the *** stating that all issues had been addressed to her satisfaction. I have attached the service ticket signed by *** *** stating the scope of work and her satisfaction with the work that was performed. I will also be faxing in our response for your records. On May 26th, I reached out to this ComplainantIn his last rebuttal, he made mention of going half on a repair with TaberI emailed him to determine what exactly that he was looking forHe explained that he would be willing to go half on a drain install between two propertiesI discussed this
option with Taber, and we agreed (out of Goodwill) to split the cost of the drain, after we agreed on a bid, and a scope of workI had a bid done, and he also had a few bids to do the installOur bid was $2,050.00, and his bid was around $1,I explained that we could go with either bidHe then informed me that he could not afford this at this timeMy last correspondence with him was to inform him that our house has sold, and that Taber wants this resolved prior to the new homeowners move in date at the end of this month*** replied back to me, that he would see if his guy could take payments from him, and wanted to ask if we would accept paying a bigger portion of the bill, because he saved us money on a fenceTaber will not agree to thatWe have made this offer out of a gesture of goodwillWe need to either get this resolved, by the end of this month, or close this issue all togetherWe are not going to inconvenience new homeowners with this issue of their yard being dug up, and drains installedIf agreement and install are not going to be done before the new homeowners move in, then our offer of goodwill will terminate at that timeThank You! *** ***

areas of concern to him. One area of

resolved by performing some additional work last week. The other area of concern was addressed by
inspecting the concern and reporting to the customer that our representative
believed the issue to be a roofing issue independent of the installation of the

I am rejecting this response because: The house owned by Taber has caused the issueI originally agreed to help with the costs based on a prior bid I had received but when the requirements were changed by Taber, the price of the bid I received doubled which put the fix outside of my budgetI will line my fence with sandbags to keep the runoff from his property from flooding my yardAgain, Taber homes caused the issue and again Taber homes is dodging the issueOf course, they failed to recognize the fact that I paid for a fence that faces of the properties they have built, approx ft of fenceI never asked for remuneration for this cost, just asked for a little more help correcting the issue they caused!

Complaint: *** I’m rejecting this response because: It’s Taber's responsibility to fix. I can’t have yard flood every time it rainsI complain and am told it was heavy rainThis is OklahomaIt most always isI contacted him 4/18/requesting french drainWater was standing against foundation. Neighbor to north had same problem when my home was builtTaber put in French drain and problem solvedMany in the neighborhood have themI’ve heard only good thingsI had to build dirt up against my foundation myself to keep water off. I e-mailed 8/29/and got no response for daysHe said it’d be evaluated after rainI wrote back 9/6/It had been over a week and yard was still soggyI got no responseI contacted *** 9/12/saying we needed to meetWe met on 9/19/Gate was always there and never had problems with standing water beforeI cut it off which didn’t helpThey scraped off some of yard in front and only made huge puddle in front yard after rainsI gave both things time to see if they would work and they didn’t. I met with *** and his contractor on 04/13/and fall was measured and was barely on lineThey agreed it needed to be fixed. I wrote 5/23/to remind that this needed to be doneThey came and put sand and sod down on 06/12/17, not in MayI let sod have time to grow in and see if it would help the issue and let it rain multiple times before contacting *** againI tried to give it a chance. I DID reply to him on 10/5/and never received a reply back. Again, this has NOTHING to do with my home warrantyIt’s all due to that home being built. I guess Taber’s not willing to accept that we didn’t have a problem before he built the home to the south of us up higher than our homeI hope “normal” rainfall returns to Oklahoma some day soon. Also, Revdex.com specifically says not to give any identifying information in complaints/responses and Taber gave addresses without permission which is completely unacceptable

We have corresponded with the customer and come to an agreement on the service to be completed on 11/15/17. If the customer should need to contact our corporate management further (who is handling her case), she can reach us at ###-###-#### to be directed to the appropriate parties.

We have scheduled service with the customer. We initially had it scheduled for yesterday, but due to weather, this has been rescheduled for Monday 7/17.

We initially had service scheduled for an adjustment, however, upon further discussion with the customer it has been decided more diagnostic is required. We will be setting up another follow up service with the customer shortly.

No one had contacted me for over a week? I did talk to someone and they are suppose to come straighten all this out on November 18th, 2017. I am trying to clarify that the repairs are not to be of any expense to me. They are suppose to come make all this right. I would have commented the last time I sent you a note but there was no where for me to make this comment; only that the problem had not been resolved. Sorry for the confusion.  Respectfully, N. [To assist us in bringing this matter to a close, we would like to know your view on the matter.]  I cannot accept their offer for several reasons.   1)  They knew about the shingle overhang issue BEFORE instillation which I was not informed of BEFORE they ripped down my functioning gutters.  By doing so, they took the decision making process out of my hands.2)  "they can't justify my request as it has no bearing on any warranty either expressed or implied".  Incorrect, the FTC as explicit rules on implied warranties for example, a lamp is supposed to produce light, a refrigerator is supposed to cool, and in my case, a gutter is supposed to COLLECT water from the roof.3) The Revdex.com does not trump consumer laws.4)  Three individuals from LeafFilter have given me four different solutions and at this point, understandably so, I don't trust them.Again, this system should never have been installed on my house without telling me FIRST that it would not work unless I did this, this, or this.

complaint filed by the customer and reached out to the Customer to seek resolution to her concerns. During our conversation with the customer we feel that We have identified the concern and offered the consumer a fair and ethical solution. The customer has reported that after the installation of our gutter and gutter protection products, she has had trouble with water getting behind the gutters. We have inspected her installation and feel that this is a result of a roof shingle overhang that is short of current building standards. As in her complaint she agrees with the diagnosis but feels that should have been identified at the point of purchase. While we don't fully agree with her assessment, we did offer to install a gutter apron at no additional cost to her to Solve the issue. Unfortunately, we could not gain her permission to execute our proposed solution. Rather she is requesting a full refund of her purchase price. We certainly cannot justify her request as it has no bearing on any warranty either expressed or implied.Because we have fulfilled our contracted agreement, provided a responsible Service response and offered a no cost solution to the customer's issue, we feel that we have appropriately responded to the customer's reported concern and request the complaint be closed satisfactorily.
