This practice is utilizing its paying patients under contract for physical adjustments to illegally demand that they participate in "mandatory" dinner programs and "recruit" a guest. This practice of "mandatory" implies that the "patient" is an employee and or a 1099 Independent contractor for the practice. NO patient is compensated as an employee nor are there any 1099 forms on file for compensation. The use of the word "mandatory" means that all patients being bullied into attending and being required to bring a guest "new patient" should be compensated.I asked this practice in writing on 3 seperate occassions that after not 1 but 2 incidents in which my credit card information was hacked while on file for automatic billing that I be allowed to stop the payments until it could be resolved. This was the only location that this card was in use. The response was that I would be immediately sent to collections. I received a notice to collect October 29, 2013 that stated my account was 120 days past due which was NOT true as the included statement printout showed payment for August and September of 2013. I expressed my concerns with this demand to attend "mandatory" after hours programs. I voiced my concern that I was treated by the number of visits and not by my physical condition. A follow up set of x-rays to show progress were never seen nor discussed. I was simply told it was time for me to go onto a maintenance program because he knew I was better. EVERY patient is presented with 3 options for treatment. EACH option requires a 1 year contract offering different payment options. not EVERY patient needs 1 year of treatment. But NO other options are presented to someone needing services. My account has been turned over to collections. This scenario was created by this practice and in my opinion are both Illegal and unethical.Product_Or_Service: ChiropracticAccount_Number: [redacted]Desired SettlementI am going to pay the amount of $1137.00 turned over to [redacted] in Collierville,TN for collections and would expect to have it refunded due to the concerns expressed. I have NOT been treated by Dr [redacted] since July 2013.Business Response Our practice does not "utilize" our paying patients nor "illegally demand" that they participate in our dinner program. When a patient is accepted as a client in our office, we want our patients to be educated regarding their condition and the purpose of our procedures so they will understand why they are experiencing their problems and why their conditions are improving. To do so, we require that the patient attend one of our educational dinner presentations. They are invited to bring a friend and/or family member with them to make the experience more enjoyable. Since we have invited them to attend, we purchase dinner for them and any of their guests that attend. If the patient is unable to attend the dinner, then the patient has the option of watching a video of the educational talk in office. We are simply trying to make it pleasant for everyone to get an education. In addition, I go to businesses, churches and private organizations and give my presentations - all at no cost or obligation to anyone attending. We ask our clients after the talk if they felt they learned something, to please give us the names of anyone they think would be interested in attending one of our talks and we will call them and invite them to attend a similar presentation. All treatment programs in our facility are recommended to patients based on their medical history, current problem and estimated time to correct their current situation. Programs can range from 2 months to a maximum of one year. This individual was placed on a 30 visit 3 month program. Program may be modified (shortened or lengthened) based on patient progress. This patient had 34 visits and an x-ray was taken near the end of the program so the doctor could compare it to his original x-ray to document his progress (which was documented in the patient's chart and explained to the patient when he returned on his next visit). He did not request to see the x-ray or ask any questions about it. No patient is under contract to pay a given amount and may discontinue treatment at any time. This information is explained to them when they sign up for treatment and sign their payment agreement. We try to make it affordable for everyone to receive care and always offer the patient 3 payment options. The total estimated cost of their treatment is explained and they have the option to Prepay, do 2 payments over 45 days, or make monthly payments which spreads payments out over several months (up to 12 months).Regarding the patient's credit card, payments and eventual collection process....He elected monthly payments. His payment declined in October last year and my CA called him to see what we could do to fix it. He did not inform us that his card had been hacked and did not contact us in any way asking us to not process a payment prior to us calling him. She called and left a message regarding his payment but left no details. When he called her back he was informed that according to our credit card processor his payment had declined with code = collect card and patient needs to notify card company. He blamed my CA for erroneous charges on his credit card. We keep no credit card information on file in our office. We are fully Hippa Compliant and have Trustwave vulnerability scans performed every month with attestation reports on file. The patient did tell my CA that the card in question was on file with another company and ours. My CA offered him to make direct payments through his bank, mail us a check or bring in cash without penalty. A letter to this effect was sent to the patient October 8th and is on file in his chart. After sending a letter of account and finally letter of Demand for Payment on October 29, the patient sent us a check for $350 which brought his account up-to date but not paid in full. No further payments were received. The patient demanded that my CA not call him or contact him and so, his account was turned to collection in January. Final Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)Numerous untrue statements. (1) "Mandatory" attendance to dinner programs was not used but calls were made to my cell phone to state that my attendance was required. When I did not attend it was brought to my attention during my next visit. At that time I expressed my concern with this "practice". (2) I explained to his CA that it was NOT my intent to to NOT pay. I refused to place my CC# on file after 2 security breeches of which the CA was informed and she escalated that into collection threats. (3) Multiple follow up X-Rays were taken and NEVER shown nor discussed as a part of the follow up treatment (attached certified letter) shows that I expressed this concern in writing along with additional concerns. (4) I recived (attached) a Letter of Demand" in October stating that my account was seriously (120 days) past due. It included the automatic billing payments for August and September. These actions are retaliatory to my demand that his practice discontinue their use of patients (me) as non compensated employees or 1099 Independent contractors not documented to recruit NEW patients as a part of my treatment program. This practice made the decesion to downgrade my treatment based solely on the number of paid visits at the time.
