The loss of the hearing aid was 2 contracts prior to the contract that this complaint is about. I also paid a fee for the loss on the hearing aid from that contract. The contract clearly states that the 60 day trial and subsequent purchase are in effect "only" for the hearing aids listed on that contract. The "original" hearing aids, from the contract from which this dispute is about, were returned. The"60 Day Trial" refers that the "privileges" are "only" in reference to the hearing aids that were delivered on a certain date which was 2/5/15. Not any hearing aids prior to that. I will also reiterate that when I spoke with the provider, he assured me that I would receive a full refund should I not be satisfied. Please refer to the original complaint below that contains the basis for this complaint.
In reference to HearPO Purchase Order AN00052931A, it is written within the contractual "60 Day Trial Period" clause; "During this period, patient can return or exchange the hearing aid(s)." Including; "the original patient payment will be refunded in the method in which HearPO received. The privileges described to you in this paragraph apply only to the original hearing aid(s) delivered to you on the date listed below."
The date for the hearing aid listed below on the contract is 2/5/15. The amount paid is $4,190. The hearing aids were returned to the Provider on April 2, 2015, 57 days from receipt of delivery and within the 60 day trial period. The Contract has not been satisfied. As of April 27 the Loaner has agreed to a partial refund in the amount of $3,300, which is in violation of the contract.
Prior to going forward with the purchase of the hearing aids, I had a conversation with the Provider via speakerphone, with two witnesses present. When asked at two separate times for assurance that should I find it necessary to return the hearing aids, that the 60 day risk free trial, with full refund back to the original purchase price, would be honored, the answer was yes. This conversation was then documented in writing on that day and signed by the two witnesses. I have that document on file.
I am seeking an additional refund of $890, to reach the full refund of $4,190 in accordance with the signed contract and in accordance with the Providers verbal agreement.

I had paid a fee to cover the lost hearing aid from the first contract. That contract ended. I was allowed to get a different pair of hearing aids, of equal value, through Supreme Hearing Aid the provider. A new contract was established. Those Hearing Aids did not work well and the provider said I would need an upgrade. The second pair of hearing aids were returned ending the second contract. The equivalent value of the second hearing aid plus an additional payment provided the third set of hearing aids and a new contract. Before making the additional payment I was assured by the provider that a refund of the full $4190 and 60 Day Trial would be in effect to which he answered yes on two occasions and was witness by two co-workers. I made the extra payment that began the third contract that states. "During this period, patient can return or exchange the hearing aid(s)." Including; "the original patient payment will be refunded in the method in which HearPO received. The privileges described to you in this paragraph apply only to the original hearing aid(s) delivered to you on the date listed below." It is very clear in the contract wording "only to the original hearing aid(s) delivered to you on the date listed below." The date the contract references is the date that I received the third pair of hearing aids, which I paid more for and began a new contract for those hearing aids. The left hearing aid failed and was sent in for repair and returned. The right hearing aid began to display the same symptoms that lead to the failure of the left hearing aid. I am seeking an additional refund of $890, to reach the full refund of $4,190 in accordance with the signed contract and in accordance with the Providers verbal agreement

To Whom It May Concern:
We have spoken to Mr. [redacted] on June 9th, 2015 and explained in detail of why he didn't receive a full refund on his hearing aids purchase. He was not satisfied with the outcome even though we walked him through the timeline and contracts that he signed.
Mr. [redacted] filed a Loss and Damage on 9.23.14 and in the contract that he signed, it states that, "A loss and damage filed activated within the trial period below renders the aids, ineligible for return, exchange or refund."

Amount Amplifon Kept: $ 860.00
Amplifon refunded Mr. [redacted] $3330 on 4/28/15, which was $1060 more than what he should have received as a refund.
We found that even though the patient failed to make the payments in full at the time of fitting on dates: 11/20/14 and 2/5/15, we did refund Mr. [redacted] more than what he should have received.
We advised Mr. [redacted] that the only way he would receive the remaining $860, is that he returns the original Left Starkey Xino Tinnitus hearing aid back to Supreme Hearing Aids.
