Dear Ms [redacted],Thank you for your e-mail. I. I hired Mr. Valore as a GC to clean the trees, remove the fence and change the driveway grading. He has not rendered any of these services that I requested from him as he claims. None of the trees were removed and the lot grading is not changed and the fence is not removed. II. He billed me for 106.5 hours at a $175 an hour on January 22, 2015 of expended time (his own exhibit 5) since the execution of our agreement on 8/25/2014. He later offered to compromise this time and cost if I put more money with him (his own exhibit 7). I request a detailed accounting of said time which he has not provided up to this point (date and nature of service of the 106.5 hours spent).III. The surveys and other services (his own exhibit 4) that he claims credit for, I already paid for separately to other parties (attached files $3500 for survey and $1500 architect fee for city application) for other non related issues to the services requested from him as noted above.IV. His offer to refund of $1982 (his own exhibit 8) to settle this dispute is not sufficient and I request full refund of the $25000 as he did not complete the work he has been asked to do.Thank you for your help.Sincerely,[redacted]

BUILDERS, INC, presents the following PositionStatement in response to the consumer Complaint filed by [redacted].I. INTRODUCTIONThis disputes involves a Consultant Agreement dated 8/25/14 entered for the purpose ofplanning for development of property located at [redacted]. (#1)[redacted] had acquired the property on 9/30/14 for $1,075,000.00. (#2) [redacted] hired Valore toconsult on construction issues including engineering, architectural, site preparation and buildingpermit issues for prospective new home construction.Valore worked extensively with experts to develop and present new home development andsite plans to the City of Rocky River in order to petition the City for a variance and property split.(#3) [redacted] planned to build his new home on Lake Erie and requested the necessary variances tosplit the lot and to create a separate buildable lot on Lake Road. Although the petition was denied inNovember, 2014, [redacted] continued to work with Valore on development and building plans for theprospective new home.II. DEVELOPMENT SERVICES DELIVERED BY CONTRACTORValore worked with contractors and expert service providers to secure bids on planning andsite improvements. (#4) Valore explained to [redacted] and documented that he incurred over 106hours of consulting work at $175.00 per hour pursuant to the Agreement. (#5) Valore’s effort arep2reflected by the extensive planning and development work, as shown by several plans prepared andpresented to the Board of Zoning Appeals. (#6)Ill. CONTRACTOR COMMUNICATION WITH CONSUMERValore was responsive to [redacted]’s inquiries and supplied written accountings for the servicesthat were delivered. (#5) At one point, Valore proposed to waive the consulting fees if [redacted]determined to proceed with new building construction. (#7) Upon completion of the Agreement,Valore refunded $1,982.00 to [redacted] after payment of costs and fees. (#8) Valore replied to aninquiry from legal counsel on behalf of [redacted]. (#9)IV. CONCLUSIONValore denies the allegations of the Complaint by [redacted] and submits that consulting anddevelopment services were rendered and fully accounted for in writing. Valore is proud of thereputation that his company has earned over the years in the custom home construction anddevelopment business. Each customer, including [redacted], is valued and respected. Quality servicesfor premiere residential construction is, however, costly.
