[redacted] 's house is dirty and ....dust and dog hairs everywhere and dirt from outsideall baseboards that were spotless are dirty, vents dirty, tons of hair was under their couches when we removed themI reminded her that drug usage is ground for evictionNo one has bothered her during her occupancyI told her she will have to pay for the vinyl damage from her washer floodingShe said the vinyl bubbledIt is her responsibilityOn her sliding glass door she can lock by putting a piece of wood in the glass so no one can openWhen She told us about the door we fixed itIThere was no mold to be concerned about in the crawl spaceService Master informed me there is no need for special treatment because the plastic in the crawl space is on dirt that service is not necessaryShe is lying about the moldThere is no mold in the crawl space and Service Master will back me up on thisNo substantial damage was causedThere is a buyout fee for early move outIf she pays the lease buy out fee $she can move out early and I never told her she still has to be pay for the remainder of the leaseThat is another lieThere is a new owner now I do not manage that propertyI sold it.The new owner does not want to release her eitherAll she is doing trying to get out of a lease she signed for a whole year

First, I will say that the day period is not up until January 31, since the inspection of move out did not take place until December 31, @ 3:pm in which this was the last day of their lease, and only tenant was present for this (*** ***)There is certain items that need to be
fulfilled in order to receive a deposit back and the tenants were very well aware of this as they signed and initialed their lease agreement Some of the following is what is required to receive your deposit back:
The premises must be thoroughly cleaned in which is was not
The keys need to be returned, in which they were not
All terms of the lease have been met in the agreement, and they were not
A forwarding address given within weeks of move out, in which is was not
This home was left in a very poor condition and was not given to them the way they left itI do not know why the complaint is coming from the mother of one of the tenants (*** ***)I have attached some pic's of how the home was left and this is only a handful of the plus pic's that were taken
I also sent *** an email on Monday 1/04/@ 11:a.mand informed him of the following:
***, At this time the owner nor does Amy J*** foresee any deposit refund coming back to you or your roommatesThe way the home was left is not how you received the home when you moved inYour lease had a copy of what was expected when you moved out on pages 16-The home was left in poor condition, it was not cleaned to our standards, there was furniture piled up in the room off of the living room, there was garbage left on the floors, the appliances’ were filthy, food left inside the fridge, the light fixtures and windows had cobwebs on them, blinds were not cleaned, baseboards were dirty, and I could go on!!! You did not turn in the keys and NO forwarding address was given and there was also a pile of garbage left out on the curb…..All four of you along with your parents are totally responsible for the way the property was left There were pictures taken of the home on how it was left…If you have any question please let me know

I received a call from a prospective tenant who asked to see a propertyAfter few trips to the property she let me know that she would be interested in filling out an applicationAfter she filled out the application she sent me a note to inform me she did and that the application was for six
monthsI told her why the six months was not mentioned in any of the conversation she and I had only after she appliedI also informed her that I will have to ok it with the owner and that shorter leases would require higher rentsShe informed me that my employee told her it was doableNo details of the six months lease was discussed with the employeeMy employee is out of the country on vacation therefore he was not able to answer her callsAccordingly, I informed the prospective tenant that I will have to get owners consent first and see if she would agree.......after I received the owner's consent the prospective tenant told me she does not feel comfortable working with usI told her now you tell me after I convinced the owner to go along with the six months lease? No, I am sorry I am not returning her applications feeShe filled out the application on line and the system processes themI would have been able to return the application and the fee if it was handled manually but being it was done on line I cannot

I am rejecting this response because:What business can't give a refund because it was done online?  This is the first I have heard of. Prospective buyers, beware.

IThere was no mold to be concerned about in the crawl space. Service Master  informed me there is no need for special treatment because the plastic in the crawl space is on dirt that service is not necessary. She is lying about the mold. There is no mold in the crawl space and Service Master will back me up on this. No substantial damage was caused. There is a buyout fee for early move out. If she pays the lease buy out fee $3000.00 she can move out early and I never told her she still has to be pay for the remainder of the lease. That is another lie. There is a new owner now I do not manage that property. I sold it.The new owner does not want to release her either. All she is doing trying to get out of a lease she signed for a whole year.

[redacted] is a tenant that lives in one of my units at [redacted] in South Salt Lake. In my lease it specifies that tenants cannot do drugs on the premises. The next door neighbor calls me to let me know she has kids and she is smelling pot from the next door neighbor and if she should call...

the cops. I asked her to refrain until I call the next door neighbor and see what is going on. So I called [redacted] and explained to her what the next door neighbor is complaining about and that she said pot smell coming from her unit. [redacted] explains that the tenants beyond her back fence are tenants that smoke pot all the time and even though the smell seems to be coming from her direction it actually coming from the back neighbors west of their duplex. Accordingly, I called the lady who complained and explained the situation to her and asked her to go after the actual neighbors beyond the fence. I have never given permission to any agents to view her property without giving her notice and without getting her approval. I never put a lockbox on any property without the tenant or the owner's permission. This tenant is lying. we always answer our maintenance calls and take very good care of our tenants. [redacted] has called on a noise she has been hearing and when I took the contractor over the next day I ended up having to come back with another one the following day. The problem was taken care of that same day and Service Master was called and within three to 4 days the crawl space was dry and now she is living in a hotel at our expense until we replace her floor. There was no substantial damage and we even had movers move her belongings to the garage and she did not even lift a finger. She is not maintaining the place and I should be the one complaining about her. My owner instructions are that he does not want to deal with tenants this is why he hired a management company. He does not want tenants to call him.  She has no grounds to break her lease and we will not let her out of her lease. On the other hand, if she wants to break her lease by paying the buy out fee she definitely can move otherwise we expect her to stay at that property for the full term of the lease. She is making up excuses to get out of this lease and owner does not want her to get out of her lease that is all there is to it.

I am rejecting this response because:The accusation about the drug use is accurate but from my understanding you needed valid evidence or an inspection to prove drug use on the premises before threatening eviction. We're as in our case, there was no inspection she only texted me stating that we had 48 hours to comply or be evicted for using illegal drugs on the premises. As far as the lockbox on the door we did give her permission to use one, but it took several requests over the period of about a month for her to remove it. Her excuse for not taking it off was we changed the code on the lock box to make it unremovable. We were never even given the lockbox code to begin with. The schedules that she put together for the viewings of the house she would text me the night before telling me a viewing would be scheduled for the next morning, and I would ask her to reschedule for it wasn't a 24-hour notice. Her response was "it's close enough." I have several text messages validating her responses. We haven't done any damage to the house other than one notice of my washing machine breaking spilling water on the floor. Other than that, the house is in perfect condition as far as tenant care. The professional manner Amy Johnson uses as a property manager is irresponsible and rude. She has made living in a peaceful and quiet environment very difficult, when we as tenants have done nothing but comply with all of the requests she has made.
