Dear Mr [redacted],
I am unaware of any calls from you or your wife to correct any unfinished work, or to cleanup nails and/or boards left behind.
I will give you the benefit of the doubt that a proper cleanup was not done. However we keep extensive records so I will give you all the details we have.
Yuri Espinoza left message for [redacted] on 04/01/2014 for the non payment of the work completed back on 04/09/2013, we left several messages over the following week, myself included, and [redacted] called back 4:59pm on 04/08/2014.
During the week of no call back I (Alex Jonasson, one of the owners of Anacapa) went over to 412 Lemon Grove to take a look at the work and hoping to speak with [redacted] directly, I met with the nanny and she allowed me to walk the property to inspect, this was on 4/3/14 @10am. Your nanny with can verify. I left [redacted] another voicemail after I left asking for callback to collect funds.
When [redacted] called back to the office on 4/8/14 she stated that the work was not completed, and that she had to hire another company to finish the work we left unfinished. This is the first time we heard about you being unhappy with the work we performed or that anything was left unfinished.
We were told that Larrabee Paining had to finish our work by [redacted]. We called Larrabee Painting on 04/10/2014 and spoke to a gentleman and he asked us to text the request since the owner was busy at the time. We received their invoice and it clearly states that they filled in termite damage with bondo after  a power wash (which would have exposed previously hidden damage) with the amount of $0.00 charged.
We called Larrabee Painting once again and ask them if the did any of the work. Yuri spoke to Aunie (owner) and she asked her if she completed any of the work for us and she said NO, and that she had spoke to [redacted] Kerber and told her she did not do any of our work. Once that was confirmed Yuri contacted [redacted] Kerber and left another message. She called back on 05/02/2014 and Yuri advised her she had spoken to the painting company and they stated they didn't do any of the work and that you are responsible for the complete balance of the job. 
Yuri's words: During the call with [redacted] on 05/02/2014 she gave her husband the phone who identified himself as Dan (you) and stated he was so unhappy with the job we had done to his property, That we had left nails, old boards, and trash all over his property and he his kids could have been harmed from our carelessness. I apologized to him and he said  "you're not sorry, if you are sorry you will give us a discount" I told him that I couldn't make that decision that I would speak to the owners to ask if there was any discount. I asked Josh and he stated no there will be no discount and that they are responsible for amount in full. I called Mr. Dan Snyder back and I told him that I'm sorry but there will be no discount and they will be responsible for the full amount. His reply to that was "I'm going to be your worst nighmare on Yelp and the Revdex.com" and he said to get and invoice to him so he can pay it.

Now if you look at this from my perspective maybe you will see it in a different light? There was no communication from [redacted] or yourself for a year, and I believe you did not get involved until a week ago. 
I can't justify a $600.00 discount for lack of cleanup, but in good spirit and believing that we did miss some cleanup I will offer to take 10% off the job, or a little over $300.00 in other words. Your statement to Yuri is what I referred to as threat of cyber bullying.
 
I apologize for all this trouble, and ask that you will consider my discount offer and apology for lack of cleanup to settle this.

I am rejecting this response because:
First, honesty is not cyber bullying nor is it slander.
 
Is it true or not true that a 6 hour day was done then 2+ months went by despite many calls before another day was done to supposedly complete the work?  Is it not true that the house walls were left open?  Were boards not left out and trash left on my patio?  I had to pick up boards with nails sticking out of them so my kids wouldn't step on them!
 
We also found out that whomever started the work left your company because when we called you acted like you did not know about our job.  Your company is extremely disorganized.  How can anyone not come to thus conclusion.  
 
The owner himself did not even come to our property until a year after the work was supposedly done!  Is it reasonable for me to wait a year to finish his work.  They didn't even bill us until this year almost a year after work started.  We even called to get billed.  We assumed it would be discounted, but the bill did not come until THIS year.
 
I feel these guys are shady, sloppy, disorganized and from their response disingenuous!  I feel it is important to "call these kinds of guys out" and to do my part for the community so others don't have to go through this kind of nightmare.
 
In addition, in my phone call to Yuri she threatened me with collection while my threat to her was to contact the Revdex.com.  Is contacting the Revdex.com cyber bullying?  Further she says she offered to discount the bill $90.  She never said this to me.   If she had offered even an inch of effort to make this right I probably wouldn't be writing the Revdex.com.  But she did not and basically said "too bad, give us the money or we will mess up your credit!"  So, we paid.  I just want to make sure they don't do this to others.

Our communication with Mr Snyder started a few weeks back when we found out he hadn't paid his bill from last year. He got very offensive about his outstanding balance and threatened us...

with retaliation if we would try to collect the money he owes my company.  There has never been any phone calls from Mr Snyder to my knowledge; if there had been we would have caught the outstanding balance and this would have unfolded at that time.
He has exaggerations within his story which tells me he's not telling the complete truth. From my review and from what was said, my company missed to repair a minor $90.00 item (out of the $3,300.00 of work performed) , and that was his grounds for not wanting to pay any of his bill despite the other $3,200.00 of work that was completed without any complaints until now. When we had requested payment we had offered to waive the $90.00 as we had missed it according to Mr Snyder.
From my past 15 years as owner of Anacapa Termite & Pest Control, and our track record as you know, this client is simply trying to get out from paying his bill.
I request that you remove his negative review on trustlink.org as this all cyber bullying to get out of his bill, or part thereof.
 
I have attached the invoice from April of 2013 for the work performed (again, a year passed with no contact or complaints from client), and below I will paste our last communication with said client.
I believe you will see that we are being "bullied" by this client and ask that you resolve accordingly.

I have spoke to the owner of the company and was advised that payment must be received for the outstanding balance no later than  05/15/2014 or we will be forced to take further action in which we have discussed in the phone conversation we had today.  I also advised him that you are threating us with slander via media sites, as a professional company we do not tolerate cyber bulling of any kind. As all we are trying to do is collect payment on a job that has been completed over a year ago. Please take into consideration we that we also have not charged you the interest for non payment as of yet, please cooperate.

Review: It started ok. We called with a termite problem. They came out, inspected and then gave us a quote. We said ok and then it got fishy! First they scheduled a date and didn't show. We called, no response. Then they just showed up and spent an afternoon working on our house . When I came home after work I found wood shards, nails, rags and trash littered across our patio. They only did half the work, so there were a handful of openings into our walls left unsealed. The next day, no one returned. We called the following day - no response. We called again in two days - no response. Anyhow, after a zillion calls, false dates, etc., they finally came back in 2 1/2 months! This time I only had to pick-up half the garbage they left! We repainted the deck a few weeks later and found areas they missed... These guys were a terrible experience. Then they forgot to bill us. We called again, no response. 3 months later we were billed.Desired Settlement: These guys offer unreasonbly bad service. It is not fair that I have to make 20 calls to get them to finish their work. It is not fair that they took almost 3 months to finish a 2 day job! It is not fair that I had to pick-up after them.I want a 20-50% discount!
