The situation was with a residents girlfriend, it was her car that got towed ( [redacted] )The girlfriend has parked at the property many time to visit her boyfriend, so she knows the policy It is up to the residents to inform their guests of the rules On this one night she asked the guard if she could park in a guest parking space, even though she had a resident parking pass (Residents are given one guest parking pass per apartment, since we have limited guest parking and it is on a first come, first served basis) one of the other roommates had already given out the guest parking pass, therefore she should not have parked on the property at all Instead, she asked the guard if she could park in a guest parking space and the guard told her that only for that night (the resident stated that he did not tell her that) A week later, she again, parked in a guest parking spot with a resident pass and did not get permission from the guard and was towed So, she put a resident pass in her car, even though she is not a resident, and parked in the guest parkin [redacted] The girlfriend is asking to be refunded the cost of the tow of $The security company has been nice enough to issue payment in the amount of $335, since the guard said it was ok one night and then towed her a week later He should have just said no from the beginning and told them what the rules were I have attached a copy of the check from Defense International The check is in the residents name, not the girlfriends name, as I did not know her full name until nowPlease feel free to contact me with any questions ______________________________ [redacted] *** | Community Manager Anavia Luxury Apartment HomesSState College Blvd.Anaheim, Ca www.rentanavia.comPhone Fax

*** ** was very persistent with the fact that she could not talk to meI am the customerI should be the one to speak with her regarding the details of the refund, situation, etcAfter *** spoke with her boss, she stated that "I can no longer talk to you, I have to talk to the resident of the apartment." When in fact, the resident had little, if no relation to this situationTo make the situation worse, *** was very rude and demeaning in her tone of voice threatening to not answer my calls if I had any questionsI believe that I am the customer hereI believe that I have the right to speak with management myself solely for the purpose of clearing the refund/making the situation clearThe Anavia Parking Rules state "all vehicles must have a visible parking pass on rear view mirror to park legally on property." This does not specify that residents needs to park in resident parking and that guest park only in guest parking This Parking rule states that ALL VEHICLES MUST HAVE A VISIBLE PARKING PASS in which my vehicle did have a "VISIBLE PARKING PASS"Guests do not sign any contract or waiver stating the rules of parking According to Anavia, residents are required to educate their visitorsWhat if the resident is not home? Security, who is educated and trained in the Anavia rules/regulations including parking should be enforcing the rulesIt should not be whether the security guard "approves it for one night"The security should enforce regulations posted by Anavia at all timesThe consequence of unreliable information that the security guard provided is the result of towing unlawfullyAnavia needs to make their rules clear, they need to enforce rules as it is expected dailyIt should not change based on security guards feelings or ability to "bend the rules"It is the responsibility of the security guard to inform especially visitors because visitors do not sign any waiver/regulation form that educates them (visitors) on parking rules
