Thank you for your inquiry and offer to provide mediation in this matterThe response herein is substantially similar tomy response to the State Attorney General's office which has also been engaged in resolving this issueMy background,in brief, includes graduation from the University of New England College of Osteopathic Medicine in and my laterengagement in the private practice of Cosmetic Surgery for the past eight yearsThe intervening six years includedcompletion of: internship in General Surgery/Otolaryngology and Facial Plastic Surgery, residency tra ining was inOtolaryngology and Facial Plastic Surgery and ultimately fellowship in General Cosmetic SurgeryI am the current VicePresident of the American Board of Cosmetic Surgery, the immediate Past President of the American Board of FacialCosmetic Surgery, and in my second term as a member of the Washington State Osteopathic Medical BoardForcomplete background and training, please find my attached curriculum vitae.Regarding Ms [redacted] 's complaint, we emphatically dispute her positionMs [redacted] had two consultations withme and a preoperative appointment with me at which I thoroughly discussed her options, chosen procedure, and herrisks, alternatives and benefits to her chosen procedure, including not proceedingMs [redacted] did elect to undergo theprocedure and agreed to no guarantee of result via her affirmative consent and financial agreementMy informedconsent expressly declares that there is risk of bleeding, damage to deeper structures, nerve injury and unsatisfactoryresultsFor your review, we have enclosed a copy of her informed consent and financial agreements.Though I am disappointed that Ms [redacted] is displeased with the results of her procedure, I utterly disagree with herposition and find her aesthetic result quite goodFurthermore, her result is absolutely consistent with our before andafter photosHer before and after photos are attached for your review.Despite several attempts, over a substantial period of time, to help Ms [redacted] find satisfaction in her results via manypost-operative appointments and meetings, we ultimately offered her the following options on May 26'h, in thehopes of resolving her disappointment in an amicable manner:1) A partial refund of $with discharge from the practice, understanding that she had failed in her duty touphold her financial agreement and consent, and mutual release.2) A $gift card with release in consideration for her allowing us to use her before and after photos inadvertisingThis would include a mutual release and afford her ongoing cosmetic care with me.3) Accept her decision to have a facelift and I would provide her with ongoing cosmetic care.4) Binding arbitration with the losing party paying all of the fees including the prevailing party's legal fees.Ms [redacted] rejected all of the above, threatening malpractice litigation and reporting me to the medical boardSherequested the contact information to my malpractice carrier; we did provide her with this informationFurther, I haveprovided my carrier with the details of her case and they are highly supportive of defense of my care of this patient.Since then, Ms [redacted] had not contacted the office in approximately months and has written slanderous reviews ofmyself and Anderson S [redacted] Cosmetic Surgery containing patently informationThis information was expresslyincluded to defame me and can readily be proven incorrectTherefore, the above amicable considerations are no longeravailable to her.I am available at your need, or pleasure, in any manner to resolve this dispute completelyHer complete medical recordfurther supports my position; however, in consideration of Ms [redacted] 's privacy, I with hold further detail until, with heraffirmative consent, you request it of me.Highest regards,Alexander WS***, DO, FAACS [redacted]
