Complaint: [redacted] I am rejecting this response because: ? It does not provide closure to the request? The Deluxe [redacted] clearly does not understand that you don't claim "abandonment" after the owner has already picked up the car? Abandoned would mean that no communication was received from the vehicle owner however the vehicle owner can easily provide a listing of dates/times of phones calls made and received from the shop? This is an irrelevant point made by [redacted] and has zero bearing on the complaint made regarding my parts? ? The whole point of this complaint is that I, the vehicle owner, dropped off my car to get a front end, that there were parts that were purchased and paid for the installation on the car that was never done and those parts are legally and ethically owed back to me, the owner? [redacted] at Deluxe should do the right and legal thing? In his response so far he has agreed that I purchased parts and he agrees to what they are because they were itemized but he is also saying he is not giving them back because he is holding them for a storage bill? This is a legal point as well as an ethical one? I don't know a single person who would want to have someone like this work on their car.? ? ? There was NOT a contract or service agreement related to Storage? This would have been included in the original invoice, first there would have been a rate discussed, it would have been billed monthly, there would have been a statement etcnone of this ever existed because there was NEVER a signed agreement regarding storage? Drawing up a bill for "storage" after three years, once the owner has come and picked up the car, ? is just ludicrous? I am going to file this topic with the Attorney General's office as I believe that it falls into the deceptive trade practices under consumer protection? ? ? The Revdex.com is reviewed by many people that are looking for reputable vehicle repairs and this dispute shines a very damaging light on [redacted] at Deluxe and his underhanded business practices? People have a lot of options when it comes to finding a good mechanic so hopefully people can use this posting to shop around? Until I have my parts that I paid for I will continue to pursue this? Business owners should not be able to scam owners out of money and then extort more money out of them? It is just unfathomable how a business can stay in business with such shady practices? ? I am rejecting this response because: The business owner cannot show proof of a property storage agreement via up-front invoice or recurrent billing statements or any correspondence related to storage since there was never one discussed or signed In his letter he admits "Since then three years have passed and there never was signed agreement.....and No arrangements towards the vehicle storage" The vehicle was never abandoned as the owner never made a good faith effort to request the removal of the motor vehicle The business, in the letter provided as well as in the emails he attached, admits and acknowledges that I have purchased parts and that they are there in his shop in his possession and he is holding them because he thinks I owe him for storage If the owner is pointing to a sign that is posted somewhere in his shop (that could have been posted there yesterday for all we know) and stating that gives him authority to retain parts that I have paid for and to charge for storage that has no withstanding documentation or contractual signatures is the very concern that I have In fact I would wonder if this would fall into the Unfair and Deceptive business practice statutes for Colorado consumer protection Since this is still unresolved I would like to ask the Revdex.com to advise on next course of action and if communication with the Attorney General's office is advised regarding question about consumer protection practices Please advise

***, refusing to sign the storage invoice that was given after three plus years of abandoned vehicle and parts storage, doesn’t mean that you don’t have to pay it or that you don’t owe, and that the storage of your vehicle and parts never took placeYou have a storage invoice that shows a list of parts that you may have purchased, this was based off of a vague memory of a sale that took place plus years ago, however you were asked for the original invoice to detail and outline what parts were purchased and possibly stored here, and you stated that you no longer have the receipt and asked if I had a copyIt is the customers responsibility and due diligence to retain their receipts for such reasons and or otherDo you have a receipt? “The vehicle was never abandoned as the owner never made a good faith effort to request the removal of the motor vehicle.” This is *** words and this is correct *** never made any effort to request the removal of his vehicle for a plus year periodIn a handful of drop in visits *** only made the claims and promises that he would be bringing in startup money soonThese promises never came to fruitionAsking you to compensate for storage is not a crimeYou expecting free storage is unheard of and does not exist in the real world, nothing is freeAnd trying to take advantage of a small business owner is wrong! You have reveled yourself to be a liar, con man and a thief, let alone following through with keeping your word, which you have yet to do. You never returned the rims loaned to you for transport of your vehicle and making the claim that you did is another lieDo you have photo proving the return of the loaned rims and tires left by the gate.You were given multiple options and you chose to forgo these options and moved forward with cyber bulling me with your threats and actions, in addition to lying and stealing from my businessWithout a receipt you have no legal premiseAnd you have had plus years to pull your act together and instead you claim deceptive business practiceYou and your actions are what is questionable… This will be the last of our responses to you and or correspondenceYou have wasted plus years, in addition to multiple meetings/consultations, research and design time and now think that you can waste more of my timeYou are wrong! It is agreed that three plus years ago, that *** *** in fact did bring his “antique VW” into my shop with the intension of having extensive fabrication and restoration services providedHowever *** has twisted and distorted the truth of the facts and time line in manor that would have any
third party mediator questioning our “Very shady business practice” indeed, however in reality *** has already taken possession of his “antique VW” known as Volkswagen Type III Notch Back on July 14th Along with the fact that *** was loaned a pair of rims and tires in order to make your VW Notchback roll for transport that He failed to returnOn July 14, *** was presented with a storage invoice for due to his vehicle’s month abandoned Vehicle storage time accumulation, along with parts stored inside the shop for his ambitious fabrication needsIn April of after months of extensive meetings with the customer and research of pricing on which parts to be used along with designing a one of a kind suspension for *** VWAlong with potential service hours involved, a base quote and plan was conceived for *** VW Notch BackShortly after, his custom parts were special orderedOn the day of *** arrival with his “antique VW” he was once again educated in regard to our storage policies in addition to his needed signature on our Service Agreement, giving me *** owner of 23Deluxe permission to commence fabrication services, along with a startup deposit consisting of a minimum of 30% down of initial quoted numbers, the deposit would be used towards service and materialsIt was agreed that work/ services would not start right away due to *** lack of deposit funds, along with his premature arrival of his “Rusty VW Project”, that would be overlapping another high end full custom build that was already in process and it was conveyed that as soon as *** had his funds we could start on his fabrication services overlapping or not.Since then three years have passed, and there never was signed agreement nor a deposit for our services, and No arrangements towards the vehicles storage, thus placing it into abandoned status*** has been accommodated every way professionally possibleAlong with options to resolve this matter and his storage fees*** has chosen to disregard his options and the law and he has left 23Deluxe little to no recourse other than keeping his parts stored here in payment of his storage feesAlso it should be known that *** has no proof of his purchased parts nor deposits for his “front end” and a list based on our memory was listed on the storage invoicePlease see attached correspondence between *** and 23Deluxe.
