I appreciate that [redacted] may not have fully understood every term and condition of the agreement, even though she signed stating that she had read the front and the back of the agreement We generally do not spend time pointing out the late fee paragraph because we are more concerned that the customer is aware of how our rent-to-own program works, the cost per month and how they can obtain ownership should their child succeed on the instrument We also point out that the agreement is for one month at a time and can be renewed or cancelled at any time [redacted] left our store with a fully signed copy of the agreement, front and back, so she was able to review it at home at her leisure If she had questions, we certainly would have welcomed the opportunity to talk with her - had she called.We feel it is reasonable for any consumer to assume that they will be charged a late fee should they not make payments within the specified time on any account Again, on the first late payment notice she could have called to inquire about the fee and how to avoid them If she was not happy with the agreement, she always had the option to end it by returning the instrument [redacted] did not elect either of these options.While [redacted] seems very capable of communicating about her concerns now, she did not communicate with us when we were contacting her about her account It has been 1/years now since she came to our store to begin this process and we can only rely on the written, signed agreement - the same for every customer - to determine what was presented to [redacted] still has the instrument and there is still a substantial balance due She can resolve the problem by returning the instrument and paying for the time that she had it

The resppmces im recieveing back is only addressing the problem as if their own policy was followed but in my case they was not Their own cameras should should the events as they took place as I staredI have only kept the broken instrument that hasn't been able to be used because I assumed I had over payed after being told from a worker that the instrument was and I proved to them I payed it As far as the late fees go if their bill never states any fee and the pay portal never states late fees how are customers supposed to know what's going on? We appreciate the opportunity to address *** *** complaint about the trumpet she leased from us on September 9, 2013.Buddy Roger’s Music has offered a Lease-to-Own program to students in school music programs for over years and we work with thousands of customers each year. We have
worked hard to ensure that the terms of our program are easy to read and understand yet still meet legal requirementsFor many of our customers, it is the first time of having a child in the music program and some do not fully understand how our program works. For most, we can address their questions easily when they call or write.*** *** came to our North College Hill store on September 9, to lease a trumpet. The lease program is explained by our associates by going through the physical Lease Agreement step by step and explaining the program. Once the form is completed and approved, our associate assigned an instrument by completing the “For Office Use Only” section of the agreement. Included in the information completed are the item #, brand, serial # and the Total Purchase Price. *** had elected to lease a used trumpet at the rate of $per month plus tax and the optional loss coverage of $per month. Because the first month lease is free, *** was only required to pay the onetime $enrollment fee. The customer receives an original copy of the agreement when they receive the instrument and acknowledge by their signature that they have read and agree to the terms of the agreement (a copy of the agreement is attached).Our Lease-to-Own program is a one-month agreement which is automatically renewable each month, if the customer elects to do so by paying the monthly fees. If a customer wished to terminate the contract, they simply do not pay and return the instrument.Our program allows customers to deduct the lease fee each month from the purchase price when they elect to purchase the instrument and may do so at any time. We offer an early purchase option incentive of a 25% discount off the remaining balance (defined as: Total Purchase Price less lease fees paid, not including loss coverage and enrollment fee).As of our last record of *** account, she had paid a total of $in lease fees (not counting the tax and loss coverage) all of which could be used toward the purchase of the $trumpet.We have no record that the instrument was every brought to our repair shop or store for repair. Had it been, the customer would have received a claim tag and the serial number and description of the trumpet entered into our system for repair.We also have no record of *** attempting to return the instrument, a process we go through with customers on a regular basis in our offices and stores. Procedures are in place and practiced daily for handling cases like ***.The first step to resolving any issues that *** has is to return the trumpet and pay for any damage that may have occurred while in her possession. Once returned, we can discuss the next step to close her account

II need better clarification on what this agreement means. When the instrument is placed in the possession of the company and all additional cost will not exist. What happens to the funds that have previously being asked for?

Buddy Rogers Music associate that assisted me on 9/9/13 with the rental of my trumpet ,did not follow any of the stores policy that  buddy Rogers provided in the response to my complaint. There Was No Terms And Conditions That Was Gone Over With Me. The Contract With My Signature Was The Only Paper Besides A Receipt For My $20.00 Enrollment Fee That I Have Ever Seen . The Contract With My Signature Was Filled Out Before I Was Even Approved With A Credit Check To Be able To Rent , I Waited For The Call of approval from the credit check after Filling Out My Information On The Paper And Signing It. The instrument was pulled from The back of the store and handed to me last . I was never made aware that there was any information that me and my son should of been told before leaving the store such as late fees and the total cost of the instrument and if I was late on a payment that I lost my repair coverage.
