Review: On June 1, 2015 the [redacted], and [redacted], on behalf of Angelo Upholstery, entered into an agreement for Angelo Upholstery to reupholster all the booths (45), counter seats (17) and 3 bench seats/backs at [redacted]. Under the agreement Angelos Upholstery was to (1)provide all the necessary materials (vinyl covering CU-120, 2 foam for the seats and 1/2 foam for the backs) at cost,(2)furnish labor associated with removal, reupholstery and reinstallation of all the items. Angelos Upholstery was to remove the items to be reupholster after the close of business (3PM) and return the same, reupholstered, the following day before the restaurant opening (6AM) so that there was no disruption of business. (3)complete the job within 3 to 4 weeks after the receipt of the material. The total cost of the project was to be $3670 of which $2470 was for the material - to be paid in advance, and $1200 for labor - to be paid up on completion of job. [redacted] paid $2470 on June 1, 2015 by a check which was cashed by [redacted] on the same day.[redacted] started the job on June 29, 2015 with one item(a seat), however, [redacted] failed bring it back the following morning before 6AM, as was required by the agreement. The next day [redacted] removed one more item (a seat) but did not bring it back until 5PM the following day. [redacted] was left without a booth on each of the two days. It was also observed that [redacted] is in no position to lift and move any of the items himself, and does not bring any helper with him. [redacted] does not even appear to have any means to dispose of the old material ([redacted] dumped it in our parking lot on both occasions).Desired Settlement: I informed [redacted] on July 1, 2015 that [redacted] was not performing in accordance with our agreement and that it was not acceptable to [redacted]. I further asked [redacted] to either return the $2470 payment made by [redacted], minus the labor for the 2 items [redacted] completed, or bring the remaining material and the corresponding purchase invoices to [redacted] assured me at the time that [redacted] would do the latter. As of to date [redacted] has not complied.
