We have received the complaint I am attaching copies of the contracts signed by the President of Lion Button The first is signed on 1/and the second signed on 7/ Under the section "agreement" on page two of both agreements it clearly states that the contract is "subject to and controlled by SCC's LLC business federal and state trariffs, as applicable, and/or by SCC,LCC standard terms and conditions of services on file at SCC, LLC Business" Lion Button resigned the second contract for months to lower their service rates The month term allows the customer the best and lowest rates possible SCC is under those terms to our business partners for that service The standard terms and conditions state the penalty and are available on our website at [redacted] ***

Yes, we have this contract but there is no direct mention about an ETF in this amount nor did we sign any document committing to an ETF. If they are referring to the website, it can be changed at any time by anybody from the provider's sideHow could we as a customer be obligated to whatever is written on a website? If they wanted us to commit to an ETF, it should have appeared clearly on the contract that we signed so we would have had a signed copy.

It is our goal to resolve this complaint amicably The customer did sign multiple service orders with SCC that all reference our terms and conditions Additionally, at the top of every order that they they signed a term was notated, IE months, months This is not a service issues, this is a contract issue which we believe based on the numerous signed agreements that they customer was fully aware of the commitments They were a client of SCC for over years At the time the customer requested to cancel the service we told them of the penalty They could have continued to use the service at the new location, however they decided to end the agreement with a few months notice In email dated Nov **, 2016, we made attempts to try to mitigate the penalties "In order to avoid paying these termination fees, SCC will be more than happy to move all your current services to your new locationIn addition, our sales team will be able to assist in making any adjustments to your account should it be necessary and ensure that this transition goes smoothly." I would be happy to entertain a settlement with Lion Button should they want to make an offer to close this dispute I cannot stop the collections process Thank you
