and her husband ***We were hired that day to start services due to the fact she had a homeless lady living in her home whom was going to care for her husband, however it was stated she was being evicted due to problems they were havingWe were to come in hrs a day and provide care of all ADL's required, (Medications not one of them ) as [redacted] stated she would be taking care of this partUpon my caregivers arrival [redacted] stated her husband was not sleeping at allI received a call from my care giver that Mr[redacted] (***) wanted her to light his Marijuana rolled jointWe had already agreed medications would be given by [redacted] his wife(Medical Marijuana-supposedly)I can not subject my care givers to any sort of request concerning these types of drugsI phoned [redacted] and explained this was not something my care giver would have any part of [redacted] agreed she would light his joints for him, as he was legally blind [redacted] did not want to agree to a deposit so she paid for three days advance hr care in the amount of Upon my care giver leaving that next morning I received yet another call that [redacted] ( [redacted] s husband) had not slept all nightIt is legal in the state of California that a care giver must have 6-hrs uninterrupted sleep during a hr periodTherefore, I called [redacted] and let her know my care giver was up all night and due to the laws if this continued I would have to raise the rate to per night as two hr shifts were in need when her husband was not sleepingThe following night I called [redacted] and informed her we could not work for her anymore unless we now went on the two hr shifts, allowing my care giver to nap during the day when her husband did [redacted] agreed and sent me the check of to advance pay for the next days of service( ) a night for two hr shift ratesThat next night I received a call that [redacted] had guests over and they were all down stairs in the kitchen late 2:amThis was a party of loud music, alcohol consumption, marijuana use and what my care giver described as other drug use ( nose inhaled )At about 4:am I received a call from my care giver that Mrs [redacted] was very intoxicated and was yelling for my caregiver to assist her up the stairs as she had fallen down the stairs trying to get up to her roomMy caregiver helped her get up the stairs and to bedThat morning I called Mrs [redacted] to let her know I can not have my care giver subjected to a house where illegal drugs are being used/ and we were not there to care for her but hired for her husbandMrs [redacted] explained to me she was a alcoholic and in treatment,(apparently she needed more help)I told her my caregiver was upset and would not come back to the home if this continuedMrs [redacted] confirmed with me apologizing that this would not happen againIt was her husband we were concerned about as elder neglect was apparent if we were not in the homeOn the 4th night things seemed to go okay, and this is when I received the call from Mrs[redacted] that supposedly my care giver gave medication and the wrong kindThis was not the facts as the care giver (homeless lady) she was trying to evict said she gave the medication to him in the morning as [redacted] was not awake and in her roomWe were not giving any medication to (***) her husbandWe spoke that day about ending services but she was worried that she would not have anyone to care for her husband and could not do it her self under her mental health conditionI spoke with caregiver and we came to the agreement we would stay in place until Mrs[redacted] could find other arrangementsOn the fifth day of service Mrs [redacted] phoned and wanted to cancel services( not a problem ) I requested as in the service agreement that she please write and or email a written request for cancellationIt is in a service agreement that she signed, that with out hrs advance notice she will be charged the full nightly rateThis was not a hr notice, I called my caregiver and asked she leave the home immediatelyServices ended on 03/23/2015, I never received a written notice and or heard from Mrs [redacted] againRefunds of excess money and or deposits go out the following two week billing cycleMrs [redacted] was refunded on 4/06/2015, that check was never cashedI called Mrs[redacted] on May 6, left a voice message that I was putting a stop payment on the check as it had been over daysI have never heard from her until I received this notice of complaintWhich might I mention is the first on record ever with my companyI have since learned you can not help every situation and I hope Mrs[redacted] is getting the help she needs and her husband is being appropriately cared forI am more than happy to send her a check again for the fees I That next night I received a call that [redacted] had guests over and they were all down stairs in the kitchen late 2:30 am. This was a party of loud music, alcohol consumption, marijuana use and what my care giver described as other drug use ( nose inhaled ). Review: I signed up for part time care and under their advisement I sent them a check to increase my requirements from part time care to full care, The day that I sent the check was the day that I had to terminate their services due to the care provider they sent to my home not only giving the medication but giving my husband the wrong medication, The in-home care provider was to be with my husband at nights and I found that she was sleeping on her shift and had to be shaken awake. If I had not been such I light sleeper his calls for help would have gone unanswered. I requested the refund of the check I sent the day that I terminated their service and was assured that my check would be refunded promptly. To date, I have not received my refund or any communication from them.Desired Settlement: I want the entire amount for full time care refunded to me since I had to terminate their services the day that I wrote the check. I went on good faith and did not stop payment of check since they had communicated to me that I refund would be issued.
