Unethical bait and switch sales technique.
I believe I joined this gym in the summer of last year. I signed up with my husband after we had been repeatedly reassured that this was a month to month contract that we'd be signing with a once a year membership dues fee for the maintenance of the gym, which we thought was a great deal. I did freeze my membership for a little this year because I did not want to cancel it, but I also hadn't used it for quite some time, since I was pregnant with twins and extremely sick. I did hope to be able to feel healthy enough to start going again, soon. Unfortunately, I had a very high risk pregnancy with my twins with a few complications, which my medical records can prove. I was told that if I got a doctors note saying that I absolutely was not able to work out, I could cancel my membership, but again, I did not want to cancel my membership. Once I had my twins, they were born premature in June, and life has been extremely hard ever since, as I do not have childcare for my children or family members around, which has made getting to the gym impossible because this particular gym does not have childcare as an option and I also have an older child. I did discuss this with one of the owners and that was when I was first told that I apparently signed an 18 month contract with them, so my account would be put in collections, if I did not pay. Even though I told both Rob and Clay that I only signed my membership agreement under the false pretenses that it was a month to month contract, I proceeded to get several calls and text messages from them requesting that I keep paying them. Using a bait and switch sales technique is absolutely unethical. As if my life has not been difficult enough this year, I have to deal with this issue now just because they want to make a few more dollars off of someone. It is disgusting that people can think that this is a normal way of doing business and that there is nothing wrong with it. I will dispute this account being in collections as many times as necessary for as long as I have to because I know the truth and I should not be responsible for the way someone else lies just to make a living. I'm a good person and I do not deserve this kind of treatment.

and *** enrolled in 18-month membership contracts on May 24th of 2017. We have never offered a month to month agreement, have never advertised one, and have never mentioned or printed the words 'month to month' when selling a membership here. We have thousands of members, have been in business for almost 7 years, and have zero filed complaints about 'bait and switch' techniques, or anyone disputing that they enrolled in an 18-month contract. *** and *** mentioned they own/operate a competing fitness business (Club Pilates, Winter Garden) and instead of honoring their membership contract, just closed their checking account and let the account go delinquent and to collections. We have record of all communications, as well as signed copies of their membership agreements. We attempted for 2 months to get in touch as resolve the matter, but they ignored our communication attempts. Once they noticed that their decision effected their credit, then it was a problem. If the person reviewing this case requires any additional details, communication records or signed contract images, we'll be happy to comply. Again, if we were in the business of scamming people, the reviews/complaints would be overwhelming. It is very unfortunate that instead of dealing with their decisions, they're slandering us. We look forward to this being resolved. Thank you.

I have been using the Anytime Fitness Windermere facility for over 4 years, and it's the cleanest, friendliest and most organized gym I've ever been a member of. They are never crowded, the staff is super friendly and the equipment is better and more diverse than most mega-gyms. I have absolutely no complaints.

On 1/22, I called Anytime Fitness to cancel my personal training contract. This prompted Abbie S, our trainer to text us back and forth, saying that we owe them a $299 cancellation fee. I asked for a copy of our training agreement, which is separate from our Anytime Fitness gym membership contract. In our contract, it states that we have to give a written notice to cancel "any and all sessions". Abbie mentioned in our texts that in the new personal contract training there is this $299 cancellation fee, but ours does not have it. She then proceeds to tell me that I owe $1,200 dollars since I did not complete all 48 sessions. Nowhere in the contract says I will complete all sessions. She comes back saying I can pay $299 now or I can extend my gym membership out 3 months to cover the $299. She then refers me to Clay H, the owner of Anytime Fitness for all cancellations. On 1/22, I also cancel for our 1/24 session via text. Our sessions on Wednesday every week, so we cancel on Monday.
On 1/24, Clay, Abbie, Alexa and I all meet at the gym. I sit down and try to negotiate with them, they don't budge.
On 1/29, I pick up a copy of Anytime Fitness gym membership and cancel in writing for 1/31. In the folder of papers, he threatens to take me to his attorney. I cancel for the Wednesday session (1/31) via email.
On 2/5 we cancel in writing via email for our 2/7 session. On 2/6, he fraudulently charges my credit card $40, even though I canceled with 24 hour notice.
On 2/9, I write again via email that I cancel all sessions, following my contracts cancellation policy of written notice of 24 hours. I also dispute the charges with my bank. On 2/14, he threats me to take me to small claims court.
On 2/22, fraudulently charges my credit card $40 again after canceling all sessions again.

Refund From our AnytimeFitness PersonalTraining Agreement,it says written notice of 24 hours,one may cancel any and all sessions.Therefore,we are canceling all of our sessions from 2/9 on.We will not be paying a cancellation fee of $299 since our signed contract does not state to pay one.We will not be paying $1200 for our contract doesn't state to pay for unfinished sessions.You will stop fraudulently charging my card $40 or any amount.You will refund me $80 charged to my CC.You will stop harassing me

This member signed a Personal Training contract. She was explained that it was a binding contract when she signed it. She purchased 48 sessions and agreed to a weekly payment plan. She came into the office to cancel her contract. We offered her the option to cancel the remaining $1200.00 balance for only $299. She refused. We then offered her the option to extend her gym membership a number of months to cover the $299 early cancellation fee to which she also refused.

The clause in her contract regarding cancellation is for booked sessions. All members must give 24 hours notice to cancel any and all booked sessions. She is claiming that this clause is to cancel the contract which it is not.

Unfortunately since the member has decided not to accept any of our early termination options we have decided to pursue this matter in small claims court.

As stated in Section #1 of the Agreement- "1. Cancellation of Sessions: Twenty-four (24) hour notice, by phone or email, is required for rescheduling or cancelling any and all Sessions. Any and all cancellations with less than twenty-four (24) hour notice will result in forfeiture of the Session without refund."

For your reference, I called on January 22, 2018 canceling all personal training sessions. On February 9, 2018, I wrote an email canceling all sessions for the second time and the signed agreement, which states we must cancel any and all sessions via phone or email with twenty-four (24) hour notice. The phone call and the email where both sent with more than twenty-four (24) hour notice.

In our agreement, Anytime Fitness Personal Training Agreement, does not state that the cancellation of sessions is for booked sessions. For your reference, I have typed out the total cancellation statement above, which does not state that the sessions have to be booked. In addition, our agreement does not state we have to pay for unfinished sessions or an early termination fee of $299. Since there is no statement about paying for unfinished sessions, there is no balance of $1,200 or $299.For your reference, I have attached the agreement and email below.

You have breached Section #1 "Cancellation of Sessions" of the Agreement. You set up personal training sessions on February 7th, 21st and the 28th, without my permission, after I gave proper notice of cancellation of all sessions. You further breached the Agreement, by fraudulently charged my credit card $40 dollars three (3) times, for a total of $120, without my authorization. I cancelled all sessions with twenty-four (24) hour notice on January 22,2018 as contractually stated in our Anytime Fitness Personal Training Agreement.

Please send me a letter immediately with Anytime Fitness letterhead stating that I have canceled all personal training sessions from January 22, 2018. Please refund my credit card $120 for cancelled sessions by March 20, 2018. Please note that if I have to commence legal proceedings in order to require your performance of the Action, this will be tendered in court as evidence of your failure to attempt to resolve this matter.
