I am a landlord. I am in a leasing contract with the Company known as, "Apartment People". They seem to have "documentation". that holds myself accountable for actions in which in reality hold no support. The agreement I had with them, is that they secure a tenant for my property, and I send them a check. One of the agents claimed my move-in fee was "too high". I found his opinion rude, as my fee had always been $650.The tenant was secured and a check was made payable to apartment people. They made statements that I am holding the agent commission check "hostage. An ignorant statement. I have the check and ready to drop off immediately after the adjustments have been made. I had made a fair proposal, where I had a check for $1000. Due to being short for $350, because the supposed move-in fee was $250 instead of $650. I had made the offer of deducting the $350 from the $1000. I had proposed this, and the owner of the apartment people was not interested and continued to attack my character. I do believe the agent who showed the apartment, deserves the commission and does not wish to prolong his check. AS he earned it. I only feel responsibility should be shown and proper adjustments. Do I have the evidence to make a proper case? As the dispute is for $350. On more than two occasions I called them to make changes to the listing of our apartment garden unit because parking available had changed. Yet they would call me and ask if parking space was negotiable? In which I repeated that we had previously discussed that parking was NO LONGER available. Other inconsistencies are they never made me aware that they no longer handle the lease as of January 2020 again never gave us notice about their lessen services.

This person hired Apartment People to find a tenant. Please be aware we had to forward to our attorney because he has verbally tried to change his listing contract several times. He accepted a tenant and is attempting to negotiate our commission after the fact. We have in writing that he changed his move in fee and wants me to just give him $350 dollars. Miguel Also made his new tenant give him a check made payable to My company Apartment People to him which is my agents commission and is holding it hostage. So he illegally collected funds on my companies behalf, broke our contract, and will owe for our legal fees. On top of that he is slandering my business on the internet now. He tried to get $600 for a move in fee we offered it on the front end, one agents client declined, the second round the client declined, he accepted and figured he would negotiate after the fact.

Miguel owes my company $1050 and is holding a check written by the tenant we provided Joshua *** to Apartment People hostage. He needs to release that check and not use that to negotiate his move in fee. When the application was presented the parties involved could have negotiated to make the deal work but to agree to the terms and try to pull this after the fact is illegal and unethical. With the names involved please remove this post or hide the names of the tenant, my attorney and my agent. A landlord with no shame should not be aloud to just do this and as a business owner who provided a tenant to this man I question him. I could easily file a complaint on this site for the garage he owns but I do not think he understands the what laws he is breaking here. I am extremely careful about who we do business with nowadays and we have recently opened our doors at our new location. Landlords need to stop trying to break contracts and follow law with their tenants and brokers. Tenants need an advocate and that is why his tenant Joshua came to Brian. Miguel, do the right thing and give him his commission. The check is made payable to Apartment People Your lease clearly says what the move in fee is. No one wanted to pay $600 move in fee on a $1300 apartment.

I want to thank the Revdex.com for having this forum to allow the public to see the truth. We have been an accredited Revdex.com member for over 30 years and have even won the torch award for Market Place Ethics. I ignore other sites that allow for anonymous complaints because of their lack of support to the business owner. Mr ***'s business M & R Imports is not an accredited business and after seeing a criminal record stemming from simple traffic violations to felonies and theft I learned he has multiple judgments against him. We pride ourselves on the landlords we represent and will no longer tolerate this type of behavior in the market. Unfortunately their are bad people that will take advantage of others and that is why as a renter you must be aware of who you are renting from. We try very hard to screen tenants to the best of our ability and we do the same for our landlords. Our agreement as of now is terminated with Mr. and he will have another judgement put on his report by my company. Mr. Did have his tenant Joshua leave a portion of our commission and has a balance due. I will upload a copy of his signed agreement after I hear back from my attorney and he gives further instruction as to how to proceed. He has slandered my agent and my agency and I have instructed my agent to remain in contact with Joshua to make sure that the lease remained as originally agreed upon per the signed listing agreement that the move in fee for this apartment was $250 and not $650. Mr. owes Apartment People $400.

Thank you Revdex.com for being their for companies so we can defend ourselves in an open forum. We need to make sure the public, renters, and brokers are not taken advantage of by someone like this.

Best Regards,

Eric

Complaint: ***

I am rejecting this response because:

To whom it may concern:This compliant has obviously become personal. Let’s stick to the facts and not get side tracked.Once again I am appalled by the accusations and nonsensical statements that Mr. Eric *** keeps writing. In his earlier statement/response to my complaint is bothered and uncomfortable by names being “public” yet he believes that by grandstanding about things and entities that have nothing to do with his unorganized company/staff and the business transaction that went off track between I (Miguel ***) and Apartment People is the real issue. Yet Mr. Eric *** continues to attempt to defame me or Extort me Are clear pattern of his poor judgment poor leader ship and pettiness. So once again to be very clear. My position is still questioning who altered the contact/agreement without my or my wife’s consent ? furthermore since the tenant Joshua *** initially paid the Apartment People $300 plus another Check in the amount of $650 the pending amount of $350 is what I am seeking that the Apartment People for go as they clearly made an fraudulent non authorize change in the written agreement of more than 2.5 yrs ago of a previous dwelling. Then they illegally took it upon themselves to make a change without written initials nor a signature changing the move in fee from $600 down to $250. Then demanding the full amount before we could seek even discuss a civil resolution/ or common ground. Is not only extremely unprofessional but then to consistently threaten me, shame my name verbally and in writing. Hence as to why I look forward to the Revdex.com engage and request the apartment people prove to all involved what gave them the authority to Make changes and possibly how many other clients have they bullied? Because I not stand for any/all of their failed tactics.

On a side note Mr. Eric *** if you claim to have accurate information about "seeing a criminal record stemming from simple traffic violations to felonies and theft. Also you learned that I have multiple judgements against me." I say to you: Should you have what you claim to have against me. Bring it because if your were any smarter you would realize how foolish you appear Eric. I anxiously awaiting a resolution this $350 dispute because I am starting to sense that the Revdex.com would be best suited to review any and all documents that can assist all parties involved to a resolution and end this unnecessary rhetoric.

Sincerely,

Miguel

If I could give 0 stars I would. First, they lied to us before we signed a lease about something the landlord agreed to clean and repair, and basically used that to get us to sign the lease faster. After being incredibly rude about us filling out our condo paperwork and fees out on time, we moved in to find out that they had not sent any of our checks or fees to the condo - so literally took our money. I would NOT recommend this company to anyone - they will do anything to get a lease signed including lying.

I am so sorry to hear about this. Internally we take detailed notes on every transaction through the process when anyone who uses our service to find an apartment that a landlord listed with us to find a tenant. Once an apartment is chosen, the agent and their client (in this case Francesca is the client) will make detailed notes of what needs to be done to the apartment prior to move in such as any repairs that need to be completed, painting, cleaning etc. that will get passed along to the landlord to review with your application. The landlord should have had plenty of time to take care of everything before your move in. I will review everything to make certain that was completed. Being that we do not own or manage the properties that we list I do not have cleaning crews on staff or handy men to turn over units for landlords. In this case, out of customer service alone I would like to offer you a $100 discount to help with whatever cleaning costs that you must have incurred upon move in and or frustration the process may have caused. As for the condo fees, I am a bit unclear on what happened there so I will review that as well. A lot of condo's have a process and require more efforts mostly on us to coordinate lease, paperwork that both you and the landlord need to complete, as well as execution of the lease. Date of application, date the landlord gave the final approval, date you and landlord executed the lease with our processing department as well as when we received all of the completed fees so we can get it all over to the condo board to review.

I appreciate both you informing of the problem Frencesca and out of customer service please accept my gift of $100 discount and you are welcome to send me any other details in regards to your experience that you think may help us improve the process. My email is [email protected] and if you send me a copy of your executed lease I will make certain processing has a check prepared for you so you do not have to wait. If you left a credit card I may even be able to credit it to your account.

Thank you for the business, and thank you Revdex.com for informing me of the customers experience so I can make sure that we continue providing the best service we can as we have for over 35 years. As we all know their can always be room for improvement so it is important that all business owners understand the value and importance of your platform unlike some of the other less credible review sites.

The Apartment People advertise having a free service for renters. When I applied for an apartment they collected the equivalent of one month's rent ($1350) to be given to the landlord. We then chose to move into a different apartment and now they are refusing to refund us our first month's rent for an apartment that we didn't lease. This is in spite of the fact that the services is advertised to be completely free. The building is claiming the $1350 is being held for liquidated damages.

My husband and I put $460 down towards an apartment listed by Apartment People and completed an apartment application. The apartment was listed as allowing dogs. They called us later that day to say the apartment unit owner decided against allowing a dog in the unit. We were told at that time we would get a full refund for that reason. We mentioned that our dog is a certified Emotional Support Animal, and asked if that type of pet would be allowed. The business eventually told us yes, but the apartment owner required a doctor's note as well as an additional $500 fee. My husband was unable to get a doctor's note before our intended move date, so we attempted to cancel our application at that time since we would no longer be able to live there for that reason. We intended to move April 1 and it was impossible to get the doctor's note before that date. We were told we would only be refunded $300, and $160 for credit fees would not be returned to us because we cancelled our application. However, we were misled by the listing we were shown at the time that we made the $460 payment, as it did not say dogs were not allowed, and we did not know we would need to pay an additional $500 and get a doctor's note. Had we known these conditions, we would not have applied. The agent working here also promised us a full refund initially, but then we were told a full refund was impossible a few days later. For this reason, we were provided with false information twice from Apartment People.

Please forgive me for not reaching out sooner and introducing myself. My company after 35 years has gone through quite a few changes and I have just been made aware of this complaint against us that has been filed by a Mrs Rachel *** and her husband Kevin.

Before I go into detail, I need to switch the contact information you have on file because my father Robert *** has retired and as of 12/1/18 I am the new owner and president of Apartment People. Ilene is no longer affiliated with our firm. That is probably why I was unable to see this complaint until now. I appreciate you making me aware of it. I am happy to provide more details however in this case these clients simply found a better deal and instead of holing them to the minimal amount of our cancellation fee We held them accountable for the cost we incurred. By refunding anymore than that because they were in fact approved for the apartment they applied for I would be paying them off and actually lose money. They did not lose money because of a cancellation if that was the case the owner would have held them to the entire lease.

I am leaving the office but have far more details regarding this. I wish I could help them more as no one want bad business. My father expects me to stand most proud of our ethics award as well as making sure your logo is on all of our advertising.

Yours Truly,

Eric ***

Complaint: ***

I am rejecting this response. First, I would like to clear up an error in Eric's message. I am a psychologist, as clearly stated on the documents attached by Eric. I am not a psychiatrist and my career in the mental health field within the school setting has nothing to do with my husband's clinical mental health diagnoses, which were provided to him by his psychiatrist in a medical setting separate from my workplace. Again, this reply by Eric does not acknowledge the fact that his business informed us that the unit owner stated that she was requiring a doctor's note to verify my husband's mental health diagnoses. As he could not make an appointment to get this note before our intended move date, we clearly chose to find a new place to move since we had a deadline and the unit owner's requirements were impossible for us to meet in time. For this reason, we we did not reject an accepted move application. Eric stated that Apartment People cleared this up with the unit owner, but that is not true. We were informed by the employee in the office named Rachel that we were required to get the note. Additionally, Michael *** verbally confirmed with me and Kevin on several occasions that he was 100% certain that a pet dog was accepted at this location. We were misled by this agent and we would not have paid a deposit or money towards a credit check had we known the true details of this apartment application. What Eric's attached documents do not indicate is the verbal confirmation that Michael *** provided us with, continuously reassuring us that a typical pet dog with no special certifications or doctor's notes would be accepted by the unit owner. On another note, I am unsure of what Eric means when he says I was attempting to call his business when Kevin was on the phone with him, as I did not call Apartment People and have never attempted to confuse his employees. As stated by Eric, I did leave negative reviews about my experiences with Apartment People on several online platforms. I am free to share my truthful experiences through the form on online reviews and am very happy to help others who are looking for advice about whether or not to visit a local business. I am not attempting to extort money from Apartment People by leaving negative reviews, I am simply informing others about my experiences. I am once more asking for a refund for the remaining $160 that I paid to Apartment People when applying to an apartment, as I was misled by this company's agent about the apartment posting and would not have made any type of deposit had I been properly informed about the listing.

AP Realty Evanston Response • May 03, 2019

Thank you for informing me of the response. Rachel and Kevin were approved for the apartment. When asked if they have pets, Rachel and Kevin both indicated on the application that their ESA animal was a dog which the owner stated in our listing that they were negotiable on. I am very sensitive to all of the laws surrounding both service and emotional support animals. This is a problem and people do need more education on this subject. I am fortunate enough to have licensing classes to help in guiding landlords, tenants, and even condo associations in explaining rules in regards to ESA and Service animals when asked. However, By law, I or any landlord for that matter is NOT under any circumstance allowed to ask prior to an approval for proof or an explanation or any paperwork to prove this. Let me be 100% clear when I state that Rachel and Kevin were APPROVED for the one apartment they applied for through our service and they cancelled. At no time were they asked by Apartment People to show proof of any document as they never disclosed this to us nor are they required to. They said they had a dog so their application and we found out way later that their information was inaccurate and false on the applications. The part that Rachel is leaving out is both her and Kevin found another apartment across the street and decided to cancel their contract giving the landlord cold feet about them. This then turned them into a rejection. I agreed to treat them as such and return their deposit. As in all of our transactions the credit fees still remain non refundable.

Thank you,

Eric

I submitted an application fee and first month’s rent for a potential apartment. After being told that I did not receive the apartment, the agent suggested other apartments which I declined (and did not visit). Upon indicating that I needed to move forward and requested that my deposit (minus the application fee) be refunded, he said okay and that he wanted to try to also get the application fee refunded. This took place over a couple of days. I emailed again to say don’t worry about the application fee, and to return the deposit. His email address is now defunct; my emails bounced back saying his email address does not exist. No one is answering at the agency and he has not responded to my text.

Revdex.com:

I have reviewed the response made by the business in reference to complaint ID, and it is accurate. I believe they refunded the funds due to my actions. I am satisfied with the results. However, I remain concerned that they will attempt to defraud other individuals.

Sincerely,

Erika
