AmCap Mortgage, Ltdhas received the notice of the complaint submitted by Ms [redacted] to the Revdex.com of Houston, and is pleased to provide its responseAmCap regrets that Ms [redacted] has found her experience with AmCap confusing or distressing; we certainly strive to help every consumer we deal with to the best of our ability and in line with the best consumer satisfaction practices possibleThat we evidently did not succeed in satisfying Ms [redacted] expectations is a disappointmentUnfortunately, we cannot reconcile Ms [redacted] account or requested resolution with the information in our recordsDue to privacy considerations and regulations preventing us from disclosing consumer data, we are unable to go into extensive detail about the circumstances behind Ms [redacted] application; however there are certain points she has already disclosed that I can address: Ms [redacted] did contact Mr***, an AmCap employee, concerning her intention to finance a loan in order to acquire a propertyThe initial information provided by Ms [redacted] indicated her eligibility to qualify for financing; however this initial qualification is followed by an intense and thorough underwriting process to verify the value and condition of the collateral which will secure the loan as well as Ms [redacted] ability to successfully complete repayment of the loan fundsAs this process unfolds, additional questions came to light concerning the ***saction, which our underwriting department needed to resolve before issuing final approval to proceed with the ***sactionFrequently this means that documents which are submitted or questions which are answered lead to, upon further processing and investigation, additional questions which must be answeredWithout diving into specifics; such was the case with Ms [redacted] applicationWhile the vast majority of applications are processed and closed within days, each application’s circumstances are different; and the speed with which the process progresses is impacted by the quality and nature of information provided or uncovered during the underwriting of the loan as well as that supplied by Ms***We cannot substantiate all of the events that Ms [redacted] relates, and Mr***’s account of some of their interactions varies from the version she relates; but we deeply apologize to Ms [redacted] if she feels that she was not treated in a courteous and professional manner at all timesAmCap never countenances rudeness or disrespect to our customers under any circumstanceWith regards to Ms [redacted] requests for cash reimbursement; the $that she was charged for an appraisal is paid to an outside company for services associated with her loan applicationMs [redacted] property was appraised, so the service was delivered as requested, and the obligation for payment of the service is not contingent on whether Ms [redacted] loan application is ultimately approved; this was explained to Ms [redacted] at the time her application was submittedFurthermore, Ms***, having paid and received for her appraisal, is permitted to use that appraisal report in a ***saction with another lender if she chooses to pursue a loan application with them; receiving the service without paying for it would be an unjust enrichmentMs [redacted] also seems to be asking for additional funds to make a mortgage payment on the property she intended to purchase from her daughterWe do not understand her reasoning for demanding compensation on this item; she does not own the property and is not obligated to pay, or payment would be obligated in any event through the daughter’s debtIn any event, it was ultimately Ms [redacted] decision to withdraw her loan application, as stated in her letterAs a result, we deny any liability as a consequence of her independent actions Similarly, we dispute that we would have any obligation to pay any part of a future loa [redacted] ***saction at a later date, due to Ms [redacted] decision to forego a loan at this time and simply contribute towards her daughter’s paymentsAlthough we understand that the loan application process can be confusing, frustrating, and complex; we only have limited control over the details of the applicant’s processPrior to withdrawing her application, we cannot find any evidence that Ms [redacted] reported her concerns or complained about Mr***'s behavior at any time prior to the withdrawal of her applicationWe wish that she had so that we might have investigated and taken steps to address any issues or resolve any matters about which she was confusedThe application process is largely regulated by federal and state law and many delays or requirements are imposed on us and beyond our control; but we would have been happy to take the time to explain in better detail why we could not accommodate some of her requestsUnfortunately, at this point there is nothing we can do except to extend our apologies to Ms [redacted] that her experience was unsatisfactory

On September 6th, manager Chris *** of the *** *** branch contacted Ms*** in response to her request that a different loan officer handle her loan application and answer her questions about her loan processMr*** explained the current status of Ms***'s loan process, including the reasons for the charges incurred and why additional explanations were required as part of underwriting and regulatory requirements that AmCap is required to follow; given the information obtained during her application processDuring the conversation, Ms*** expressed ambivalence about proceeding with a loan at this timeMr*** offered to follow up with her in a month to see if she wanted to change her mind then;Ms*** also indicated that she would contact AmCap if she reconsidered whether to apply for a loanCurrently AmCap has closed her application file and considers Ms***'s matter resolved

An AmCap representative attempted to contact *** *** to
obtain verifying information supporting his claims that he had been approved
for a loan only to have that approval later revoked by a supervisor, as well as
evidence of a second appraisal order*** *** did not respond*** *** claims
that AmCap withdrew funds from his earnest depositAmCap does not receive escrow deposits and does not have access to any funds *** *** deposited with his escrow agent; those funds are part of the purchase contract between the seller
of the property and *** ***
*** *** evidently believes that he should have been approved for a
loan due to his statementt that his monthly principal and interest payments would
have been lower than what he was currently paying in rentHowever, *** are only part of the monthly payment obligation; and a total monthly payment is only one factor in determining the ability of a consumer to repay a
mortgageOther factors relevant to *** ***’ creditworthiness and qualifications to
repay a debt must be consideredThose elements, when evaluated, led to a determination
that we could not approve *** *** for credit on the terms he requestedThe
details of that decision are confidential and cannot be disclosed here by AmCap, but have already been furnished to *** *** along with instructions on how he
can dispute or correct that data if he believes it to be incorrect
After reviewing *** ***’ claims, AmCap has determined that
it has fully addressed his complaint, and that no additional action is
warranted

AmCap Mortgage, Ltdhas received notice that *** *** filed
a complaint with the Revdex.com on June 27,
In *** ***’ reported grievance; his chief complaint appears
to be that the approval process for his VA-guaranteed mortgage was more
rigorous than he believes to have been necessaryThis
belief is evidently
supported by a phone call to an unidentified person who supposedly has a
connection to *** ***; which is a quasi-governmental purchaser and
aggregator of mortgage loans that does not establish the guidelines for the Veteran’s
Administration Loan Program
*** *** may have spoken to an individual who works for a
company that offers loans that are eventually sold to *** ***; but it is
extremely unlikely that he was able to reach an official who is actually
connected with Freddie due to his status as a private consumerLikewise, *** ***
places great emphasis on his application being for a VA-guaranteed loan
Although the VA does provide guarantees to lenders who originate loans that
comply with the guidelines issued by the VA, status as a veteran is not a
guarantee of approvalApplicants must still qualify under the standards which
the VA promulgates and requires lenders to follow
With one exception, AmCap does not address the specific
timeline or supposed facts that *** *** alleges*** *** states that he was
approved for his loan, but then later that approval was rescinded; this is
incorrect*** *** was prequalified to apply for a loan in the amount he
requested, but that qualification required him to be able to meet the
underwriting standards mandated by the VA in order for his loan application to
be approvedWhile we strive to complete the underwriting process and make a
final credit decision well in advance of the consummation of the consumer’s
transaction with the seller of the property; many factors, including the degree
of cooperation provided by the consumer and the quality of the financial
documentation they submit, impact the length of time this process can take*** ***’ application file was begun on May and a final underwriting decision
based upon a resubmitted application and second review was rendered by June
A loan process of 30-days is not uncommon for the industryIn this
instance, AmCap could not make its determination until just before the transaction date that *** ***
had separately negotiated with the property seller; and could not approve *** *** based upon the information he submitted
*** *** has stated that his desired outcome is to receive a
refund for fees paid in connection with his applicationBefore *** *** filed
his complaint with the Revdex.com, AmCap had already provided him with a refund check
to cover the survey and inspection costs he incurredThe company therefore
considers his complaint to have already been resolved and does not feel it
would be productive to revisit the differences between the version of events
that *** *** relates and what our records reflect

They need to reimbursement me for the second survey of They need to tell the truth about the people who worked theirThey have left and now work else where The processor gave us the ok and the supervisor said no.

If you don't want to give me the money back, then I would like to get a credit of $495 appraisal fee for a new loan with your company but with a different loan officer and tell me at least upfront why a loan between my daughter and myself have a restriction because of the relationship. Kyle [redacted] never addressed that.
