I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

I have not received the check from Apt Hunters /updated vendor sheets from services provided (I had already requested that information a month ago and never received despite several emails which is why I wrote this complaint).

I am not satisfied with another “partial” refund from my security deposit. I stand firm that I did the necessary cleaning to make the home at [redacted] “move in ready” by the time I left.  In addition, as stated before I even set up a walk through with Apt Hunters to find out if I needed to do any additional cleaning or upkeep that they expected from me. I moved out on the 23rd, but had plenty of time (since my rent was paid up until the end of the month) to return to the home if necessary to clean. Apt Hunters were neglectful to notify me of any necessary cleaning and I left with a clear conscious since I was never notified. They have already taken a $200 NON-refundable cleaning deposit (listed on MLS which I have a copy of) and I left the house in better condition than received.

To be satisfied I would like my FULL security deposit back. I look forward to getting my full deposit back,

As we stated in our original reply, we have reviewed this account & feel the security refund amount is very fair. The [redacted] were not charged for any deductions that were not accounted for.  We sent the [redacted] all supporting invoices regarding the deductions to their refund.

The owner & Apartment Hunters remain firm in our final accounting.

Apartment Hunters completed a review of Ms. [redacted] complaint.

 

We would like to make sure you are aware Ms. [redacted] did receive the majority of her Security Deposit with our initial accounting. $763.50

 

We have since received the final invoices from our...

vendors and sent Ms. [redacted] a second statement, and an additional check in the amount of $71.50.

 

Included with the revised accounting were copies of each invoice for the deductions.

 

If a previous tenant has a complaint or problem, it is the goal of Apartment Hunters to reach out to them and hopefully resolve their issues.

There are no laws in place for the remediation of Toxic Black mold in AZ. This home had a deadly finding of toxic black mold 2/12/2015 where the property management company asked us to immediately leave the property to hotel for 3 weeks. The management company brought in 2 companies for remediation. Although the water damage under sink was noted on move in paperwork August of 2014. At the time Property manager stated not to worry we would not be charged upon move out. Please note the picture attached is after remediation and only one of many cabinets still showing the mold. We did report this to the [redacted], and the response was report to AZ Slumlords as there is no laws in place for the remediation of Toxic Black Mold. After the work was complete a second test was performed and the results show it is worse, now mycotoxins have been released in the March 9th report. Owner of ROC licensed mold remediation company states they did not know what they were doing and this house is polluted with Toxic Mold. Our mattresses and all wood fabric furniture is contaminated with mycotoxins. Also after remediation there are still visible signs of mold in kitchen cabinets and bathroom cabinets reported immediately to property manager. The State of AZ/AZ Department of Health licensed mold company has deemed house uninhabitable, We as Tenants still occupying because they are not returning our deposit and still demanding March rent after they agreed to pro-rate for February and apply to March. Only to change the verbal agreement and serve us with eviction after we noted the visible mold and retest results.. We are leaving this home and the management company has no plan of any further remediation. Which leaves the next renter victim of the Landlord technicalities of no laws being established. This is a rental scam. We have been paying $1,517.00 a month for a 5b 3b home in Gilbert, AZ that according to the professionals been uninhabitable for some time. To note the entire back patio roof, visible signs of mold, wood falling and breaking. This has all been discovered in the last 6 weeks but increasingly over the last 7 months my family has suffered from long term high levels of mold exposure including, rhinitis, neurological symptoms such as headaches, mood swings, clogged ears, dizziness, anomalies on lungs, Asthma, cyst in brain. . Our family service dog has had two visits to the emergency vet for toxic exposure and has double eye infection which required medicine. We are all healthy individuals without any prior symptoms as above. The service animal is now only 9 months old. We have retained a lawyer in the matter to deal with the civil suit. But my concerns are they have succeed on a technicality to have us removed from property without fixing properly. After the remediation the company painted with "high cover up" paint and a BioHazard company came to clean carpets and air ducts. The second test was done after this and still shows on air quality, mycotoxins released and 7 more molds in addition to the 230,000+ PeniclliumApersgillius. 02/12/2015 had a reading of 2.1 Million Penicillium Aspergillus. No that is not a typo that is 2.1 million a deadly reading. I want to prevent another family experiencing the pain we have. They evicted us in retaliation to the second test showing worse conditions. When in court they plead we were rent striking when in fact they agreed to pro-rated rent from Feb and changed their mind after our report of visible mold and second test was complete. We of course would not continue to stay here as it is hazardous to our health but in that same breath will not pay them additional monies for rent when our deposit was not returned. A reference letter was written stating we were being released from our lease and will be issued our full refundable deposit. They have determined the deposit will now be held for March rent.

In response to Mr. [redacted] complaint, the property manager emailed Mr. [redacted] photographs of the home after he vacated. The owner of the property also did a move-out inspection. I would like to apologize for our property manager not responding to Mr. [redacted] telephone messages. Although Mr. [redacted]...

was an excellent resident and the property was not left in a damaged condition, the yard did require clean up and the interior a light house cleaning.  Apartment Hunters no longer manages the property as the owner has the home for sale.If you need any additional information, please feel free to contact me directly.
