This is in reference to ID number 1*** addressing the concern submitted by *** *** on 4/20/concerning her security deposit refund of $on apartment *** *** ** *** *** *** *** *** *** *** *** *** ** *** This is considered a landlord/tenant disputeUnder
the terms of our rental contract which is a legally binding contract and was signed by *** ***y on 12/4/in agreement to all rental contract terms and lease expiration of 12/30/Under Section of our rental contract, she agreed to notify owner's/owner's representative of any malfunction or equipment or utilities or damage, by fire, water or Act of God immediately for owner/owner representative to make repairs with reasonable promptness and rent shall not abate during such periodsResident agrees to request such repairs and services in writing except in an extreme emergency when telephone calls are exceptedShe viewed the apartment prior to submitting an application on 11/30/with no complaint and she was given a move in inspection/check list at the time of signing the lease on 12/4/The move in check list was received in the *** *** Office mail slot on 12/6/Items indicated on the move in checklist in need of repair were assigned on 12/7/and repairs were completed on garbage disposal not working properly causing water to back up into dishwasher and leaking onto the floorDisposal was simply locked up and once released it resolved the problemKitchen stopper was reported not holding water for sink and was replaced as well as tub stopper not working and it was replacedThere were no further requests for any repairs during *** *** *** occupancy I received keys along with a note in the mail slot beside the office door from *** *** and have attached a copy of the letter on 2/28/have attached a copy of this letter (Item 1)There was no mention of reason or cause for breaking the terms of the rental contract and vacating the apartment prior to expiration of 12/30/There was no statement or notification indicating there were any problemsThe first we were made aware of her claim regarding health issues from living in apartment *** was in a certified letter sent to our accounting office received on 4/25/I responded to this letter and mailed it to ** *** *ddress listed at ** *** *** *** ** *** on 5/2/have attached a copy of the letter (Item 2) that was mailed to her addressing breaking the rental contract prior to the expiration date and forfeiting of the security depositI inspected the apartment upon receiving the keys to prepare it for market againThere was no mold or mildew presentI have managed this location since and there has not been any past or present issue concerning mold or mildew at this addressIt is a second floor apartment of a three story building and surrounding apartments have not had any reported problemsIt state clearly in the rental agreement contract the residents are responsible for fulfilling the terms of the rental contract and are obligated to a one year upon signing and a day written notice is required by either party for termination at the time of the expiration of the rental contractThe rental agreement contract was broken, therefore the deposit of $she is requesting back is forfeited and she is legally responsible for the rent and utilities until the apartment is either re-rented or until the end of the rental contract termWe have not sent any further bills to attempt collecting this amount although legally she is responsibleThe medical records submitted only include one exam made during her occupancy of Apartment *** and it is dated 1/9/She reported not having any difficulty breathing or wheezing but requested a new albuterol inhaler because hers had expired, indicating this is something she has been prescribed prior to moving to *** *** ApartmentsHer symptoms of runny nose and cough were reported by her as having family members with similar symptomsShe lived alone in the apartment located at *** *** ApartmentsIt is a studio apartmentThere are no indications in her medical records to indicate she had any testing done for allergens or mold sensitivity related issues The other medical records submitted are dated after *** *** vacated the apartmentNone of the medical records submitted show any reports indicating her claim of illness due to mold in the apartment and it was not reported as such by *** *** to the practitionerDue to this being a landlord/tenant dispute I am uncertain why we are receiving a letter through the Revdex.com when it states that you do not handle claims relating to landlord/tenant concernsWe would appreciate your response that this matter is now closedThank you *** Property Manager

In Reference To ***I am requesting this case/claim remain open due to fact I am due the remainder of my deposit of $as stated on the move in application as I checked no as to if I smoked on the application, also the carpets were never cleaned prior to my move in as stated from the maintenance worker *** *** when I kept asking him about fixing the storm door and main door that was almost coming off the door frame and told him about all other issues that needed to be done on the apartment I was residing in, also I only resided at *** ***? just over months and due to many health care provider visits caused by living in Apartment *** ** *** *** Apartments and many attempts to get the issues at hand resolved I felt that it was necessary to my health and well-being that I relocate to a place that I am not exposed to such health environmental hazardsAlso in reference to scanning documents I would suggest to her that she proof reads such prior to sending before things can get easily escalated in much bigger matters and she may also need to read online reviews of complexes she manages , and I am sure that she is well aware of why I *** *** relocated from *** *** *partment in which is a separate matter, but as of right now I am requesting that this claim/case remain open until I am fully satisfied with the remainder of my deposit of $back from Apartment Management Services
