following [redacted]’s request and our normal business practices, the check was made payable to [redacted]’s bank account that had previously been used for fundings such as this. [redacted] requested that a stop payment be issued after learning the funds had been sent to the bank account that we had on file. This would, as was explained, result in a $25 fee. Apex deeply values its client relationships and ensures that there are no hidden fees. We have provided [redacted] with a refund of the stop payment fee and issued him a replacement check.

in being transparent when it comes to the terms of our Factoring Agreement. All terms are reasonable and provided to every client before entering into a Factoring Agreement with Apex. Our Factoring Agreement is also viewable by any client at any time in our online client portal. As the Factoring Agreement states, Apex only requires 60 days’ notice to terminate our relationship. Apex received [redacted]’ termination notice on August 11, 2016. After that date, [redacted] continued to send invoices to Apex for purchase through October 3. Although our Factoring Agreement has terminated, Apex cannot release accounts until payment has been received on all invoices which we have purchased. Since [redacted] asked Apex to purchase invoices through October 3, Apex cannot release accounts until we receive payment on those invoices. Once [redacted]’ customer pays those invoices, we will release all accounts.
