I am a Hurricane Michael victim. This company provided awful service and it took 7 months to do work. He price gouged me for mold remediation work
Contractor was fraudulent and price gouged me and I fear many others. It took 7 months to complete work and I was price gouged on top of it.

Desired Outcome

I want a fair price for work done comparable to what is being charged in local area. I also never received an estimate for work neither did my insurance company who is watching the work.

To whom it may concern:

We have serviced over 500 homes and numerous commercial properties in the wake of Hurricane Michael. As you can see we have had 0 complaints to the Revdex.com in the last 12 months. The reason that I point this out is because Mr. and his wife have attempted every way to avoid paying their invoice from day one. Now that we have moved to file a lien on their home the *** and *** want to attempt to slander our good reputation. Please take note, we will be taking the ***'s to court to foreclose on the lien as well. If we were as bad as they are attempting to portray, would we be this confident to do so? Please note that the ***'s haven't paid us a penny for the work performed. I would expect nothing less from this client, they were so awful to deal with, we refused to do their rebuild. Also, please note that we are not a member of the Revdex.com and this will be the one and only response that I give you on this case because we are going to court on this file. I'll also ask the Revdex.com why you are rating us with a B+ with this being our only complaint in the last year which is bogus) and only 2 ever which we won both in court for non payment, just like this case, considering we have serviced literally well over 1000 clients in north florida? You may want to look into correcting this rating, or you may find yourself in court with us as well, a non member. This case is closed on our end as far as the Revdex.com is concerned and the kelly's position will be determined by the courts. As far as price gouging claim he makes, we use the same estimating software that the insurance companies use and we have retired insurance adjusters on our staff that write all of our estimates. Sounds like a typical claim of someone not trying to pay a bill or at least trying to save money in an attempt to profit from an insurance claim. Slippery ground as this is a crime in the state of Fl.

This contractor accepted the assignment of. Emeritus which is his right to bull insurance company not me. The first Tim since Oct 2018 he sent a bill is this week to me and not my insurance company which my insurance company was asking why he is not sending anything in for seven months. He did not want to provide an estimate which underhanded and is part of his written contract requirement. He was to go through my insurance company and if he did would clearly know what my cap is in my policy. In addition, it took seven months to do the work and my current renovation contractor felt he was milking this job and had to clean up a mess he left including piles of wood in my garage and asked me to expense a dumpster. He subcontracted the work to Mr Restoration which would not provide clear and concise communication with me and would not work with my testing company as well. They did not want to deal with them. Based on Florida law the AIB prohibits the third party assignee from seeking payment from the home owner in excess of the applicable policy deductible unless an agreement was made to pay at my own expense. Thebassignee must provide a copy of the AOB to insurance company within theee days of following execution. He never contacted my insurance company and performed work them sending me a bill not my insurance company and threatening me to put a lien on my house without just cause. He is unprofessional and carries out managing his contractors in a haphazardly way. The AOB should have been follow which he did not do and I never or my insurance company received an estimate for the work which is clearly stated in his own contract and then seeks payment from me without contacting my insurance carrier of any costs, etc. I feel he is being deceptive and uses his advantage to prey on Hurricane victims. Not only did he not send me any work estimate but forwarded an unitemized bill to me with no details. The insurance company had to make him send in the billing details.

Like I said earlier, we hardly EVER have these complaints unless they are fraudulent. Because I felt that Mr. and his wife have been trying to run a racket, I had their criminal records pulled that are all public records and wouldn't you know... I have a 135 page report proving that he has been arrested and charged numerous times for theft alone, not to mention a myriad of other things! I would like to know where I can upload this document to and attach it to this case? Ill finish with one little point that the felonious Mr *** left out. On the contract that signed, it clearly states that he is ultimately responsible for payment. Revdex.com I will await your response as to were to send this report to.

Those are all lies. I have never been arrested and actually I had just left working in the federal government for almost 10 years and have had numerous background checks. This guy is a liar. Also, his co tract states he is required to provide a written estimate to me or my insurance company which he never did which is deceptive and now send s a bill to me. When he was supposed to call my insurance company. He never did that which he was able to do that. This allows him to play games. What he has done is against the law. What he did for me was not worth bear that. I would have never let him work in there if I knew that. I would have looked at other alternatives. He is not an upfront honest contractor

I had a leak in an upstairs bathroom and they did the repair once, misdiagnosed it and did the exact same job again all while charging me twice.
I own a rental unit and live out of state. I had a leak in an upstairs bathroom and happened to be in town. Apex opened up my ceiling (4'x4' hole) and diagnosed (with complete certainty) the problem. They said it was the toilet and I needed to hire a plumber to replace the wax ring. I hired the plumber, patched the ceiling and about $2,500 later had what I thought was a "fixed" leak thanks to the "professionals" finding and diagnosing the problem. Fast forward 3 months later and I was in town again and noticed my ceiling in the center of the previous cut hole looked like it was chipping due to being wet and drying. One shower later, the ceiling was literally dripping wet in the same spot as the prior leak. I called Apex, they cut the same hole open and this time said it was a crack in the tile (that was there the 1st time). They informed me that diagnosing the problem "wasn't their job" and tried charging me MORE money to do the same job again. I was upset, and for months battled them about doing what was right. In the end I got a "discount" and ended up having to pay for the same job twice. The owner was the most unprofessional I have ever dealt with and took my problems with the situation personal. He was full of threats and in the end said I would be going to collections or I was to pay the price he gave me. I would NEVER recommend them.

Desired Outcome

They made me pay $1,800 the second time and threatened to send me to collections if I didn't tell him right away. The owner gave me "10 minutes" of his time after trying to rectify the issues for months.

We are a Water Mitigation company. Mr *** had a plumbing leak two different times which caused water damage. He hired a separate plumbing company and paid them directly. We performed two separate Water Mitigation jobs on his property arising from two separate plumbing leaks. We also discounted services of almost $500.00. Mr *** has plumbing issues which should be addressed with them.

Apex has used intimidation in an attempt to collect an unsubstantiated services claim/bill.

On December 22, 2017 I was called by Brytney *** of the *** Home Owner Association and Jeremy ***, from a company named Apex. They informed me they had entered my condominium property due to a back-up of water coming from the building drain stack. They said Apex was drying out the unit at the time. It was my belief at the time that the HOA would be taking care of the issue and they had every right to choose someone to clean the mess caused by the HOA.

I live in Iowa (not Miramar Beach, Florida) and had no way of overseeing/verifying what had happened nor what was being done. It was my expectation the HOA would take care of the issue given it had been caused by a drain not in my control. Over the next week the HOA chose not to take responsibility for the problem and I was required to call in my insurance company. During this time Apex/*** attempted to get me to sign a contract with them. I did not sign their contract and my local contact took over clean up and repair soon after. My insurance company (Harbor Claims) began working out a settlement with Apex on their charges.

On February 12, 2018 I received a bill from Apex for their services by email. I was surprised because they had been working with the insurance company. Apparently Apex had not satisfied the needs of the insurance company *** and decided to pass the bill to me. I passed the information to *** and they asked Apex to comply with IIRC regulations for proof of work. In talking with my insurance agent she was very clear Apex was not in compliance regarding necessary documentation. On April 2 the insurance company again asked Apex to provide proof of work. This was the last communication I was aware of.

On May 29 a certified letter from a lawyer (Dion *** was signed and sent on behalf of Apex (received by me on June 9, 2018). The letter stated I was in breach of contract and my account was past due and that I was liable for $1872 plus $500 in legal fees for this claim.

I immediately contacted my insurance company, who relayed to me that they had made payment to Apex for all that had been substantiated by Apex, and that they had heard nothing further from Apex regarding the claims. They again contacted Apex asking them to substantiate their additional claims. They have refused to do so, and instead have decided to harass me through the threat of lawsuit.

Apex practices are highly questionable. They acted in my property without my authorization, yet I authorized my insurance company to pay them reasonable expenses they could substantiate. Instead of either accepting the settlement or working to resolve the issue by providing appropriate documentation according to IICRC rules, they have chosen to harass, and use intimidating practices to obtain payment for work they cannot justify.

I have registered a dispute based on the Fair Debt Collection Practices Act - as they have not substantiated their claims. And, while I may ultimately be forced into legal action in this matter I hope to allay that action, spotlight this ethics breach and prevent Apex from acting arbitrarily against other unsuspecting people struck by misfortune in the future.

I believe the company is obligated to provide documentation substantiating their claims and accept the settlement offered by the insurance company - as is required by them.

The customer authorized our company to mitigate water damage that took place at his condo. We provided all documentation that is normally required to process payment from his insurance company. The insurance company like many times, acted as if they haven't received it, in an attempt to delay full payment. We offered the client an opportunity to sign an AOB which would allow us to collect directly from his insurance company via our atty's. He refused and therefore we had our atty's send him a collection letter for payment due on services rendered. Please take note: We completed the work and have not been paid a single dime! We have a business to run and fully intend on collecting whats due us. The complaintant if really wanting to pay us, can simply sign one form that will allow us to by pass him and go directly to the insurance company. Often times when customers do this, they usually attempt to keep the insurance proceeds for themselves. We believe the Revdex.com is a good organization that's there when customers get taken advantage of... What organizations
do businesses have to turn to when we are being taken advantage of?? The judicial system and that is why our atty's are involved. You have a customer here who is trying to cover himself by hurting us with an incorrect and negative review. I trust that you all at the Revdex.com see this often and will correct it.

The misrepresentations stated by Apex in their response are consistent with their practices. Instead of acting responsibly they have decided to attack me - informative. I will respond quickly to their inaccuracies.
Statement - "The customer authorized our company to mitigate water damage that took place at his condo." Response: I did not call Apex in - there is no authorization by me to bring Apex into my property. It simply was not done. However - building maintenance called Apex and gave them access to my property before I was notified of the issue in my unit. As a result I authorized my insurance company to pay Apex what they were due for having done work on my property.
"Please take note: We completed the work and have not been paid a single dime!" Response: This is very curious. I have seen statements documenting that the building management paid Apex a share of the total bill and that my insurance company paid Apex over $900, waiting for further documentation to authorize further payments.
"the complainant . . . can simply sign one form that will allow us to by pass him and go directly to the insurance company" Response: I authorized my insurance company to work with Apex - if not there wouldn't have been a dozen emails between them and a payment made by the insurance company.
"when customers do this, they usually attempt to keep the insurance proceeds for themselves" Response: quite insulting and libelous - it does fit the character of the company management. I have worked to get this claim resolved and have acted in accord with my insurance company's instructions.

Response - my reputation is not in question, and I do not complain without provocation or cause. My professional work has been long (over 30 years) and I have sued no one and no one has sued me. In those years I have only used the Revdex.com for resolution on one occasion. I am a very fair individual and have worked in mediation for many years. Apex's practices have been coercive, and have sought to work with a customer using duress (threatening attorney letters without prior notice). This must not be allowed to continue. My resolution request was fair and should be accepted to assure this problem is resolved.

Apex has thumbed their nose at the Revdex.com - unwilling to provide a solution or justify their actions. Instead they provided false statements (documents provided) in their initial response and chose to insult me.
You have the documents to substantiate my claims and the false statements made by Apex. In sum, Apex has acted arbitrarily, and with malice.
It has been established here that regardless of the fact I did not bring Apex in to work on my property, I facilitated payment to Apex from my insurance company. My insurance company paid Apex $2359 and offered them an additional $900. As you can see in the supporting information provided, they would not provide the required documentation for insurance to pay them as they desired; Apex continues to demand payment without providing the necessary logs to be paid.
Without notice they served me by attorney with papers for collection, complete with demand for payment of legal fees. I have never experienced such arbitrary and capricious action by a business. I have paid every debt owed in my life - to think a business would take legal action without first providing necessary justification for payment is unconscionable. Their use of a demand letter by attorney is quite frankly, an act of extortion. Their behavior is disgraceful and the business should not be allowed to operate in this way.
